It is used by the assessor to ensure the property is assessed properly and receives the correct taxable value. It must be filed by the new owner with the assessor for the city or township where the property is located within 45 days of the transfer. If it is not filed timely, a penalty of $5/day (maximum $200) applies.

This form must be filed when you choose not to enter the amount paid for real estate on the deed. It is not necessary when the amount paid is entered on the deed.

A certificate of trust existence and authority contains specific information about an existing trust agreement. According to § 565.435 of the Michigan Compiled Laws, a “purchaser or other party relying upon the information contained in a recorded certificate of trust existence and authority shall be afforded the same protection as is provided to a subsequent purchaser in good faith.” Note that under § 565.433, only settlor or grantor; an attorney for the settlor, grantor, or trustee; or an officer of a banking institution or an attorney if then acting as a trustee may sign the form if it pertains to real property. Sign the completed form in a notary’s presence, then submit it to the county register of deeds office for recording.

Veronica W. Said: Nowadays it no longer surprises me to discover that there are people who prefer to do things on their own. But when I found out that legal forms can be filled out without the help of an attorney I was really amazed at how far technology has gone! All I thought was ‘now why didn’t they think of inventing that sooner?’

Ethelanne Sherman Said: The only thing I did not like was that the form was not in the legal size. Its a waste of paper to use the standard size.

Deb B Said: I found the forms to be most helpful and just what I needed. Thank you! NOTE TO THE COMPANY (for a suggested changeimprovement on the SAMPLE quit claim deed) You may want to change the state listed at the bottom of the first page of the sample from Iowa to Nebraska since these quit claim forms are for Douglas County Nebraska and all other references are to Nebraska.
