Fort Bend County Recorder Information
The recorder in Fort Bend County is responsible for recording and maintaining records related to real property situated in the County.
Recording Fees
To record a deed, deed of trust, affidavit, or other document, the fee is $11 for the first page and $4 for each additional page.

For each additional grantor or grantee over five, the fee is $0.25.

If there is no heading at the top of the first page, $5 will be added.

Any document conveying interest in property must have the grantee’s address. If this is not included, the recording fee will be doubled or a flat fee of $31 will apply, whichever amount is greater.

Any page that is illegible will have a double filing fee for that page (either $4 or $5).

If names are not printed underneath signatures, that page will have a double filing fee of either $4 or $5.
Document Formatting Requirements
Warranty deeds, mortgages, and instruments for real property located in Fort Bend County can be recorded with the County Clerk.

The recording act in Texas is a race-notice statute. Under this statute, a later buyer who pays fair value for real property, does not have notice of any other earlier conflicting interests, and records first, wins and has first priority over any later recordings.

RECORDING GUIDELINES

• A page is considered to be one side of a sheet of paper. The maximum size paper accepted is 8.5x14 inches. 8.5x11 inch size paper is also accepted.

• Pages should be of sufficient weight and substance so that printing, typing, or handwriting will not bleed through. Riders and attachments must comply with the size requirements. Only one rider or attachment can be included in or attached to a page.

• If an instrument is not in the English language, it must be accompanied by a correct English translation.

• Instruments must be signed and acknowledged by the grantor in the presence of two or more credible witnesses or acknowledged or sworn to before and certified by an officer authorized to take acknowledgments or oaths.

• A font size of at least 8 point is needed. Printing, typing, or handwriting must be clearly legible. Black ink should be used.

• At the top of the first page, provide a document heading that serves to identify the type of legal document.

• Corresponding names should be printed or typed beneath signatures.

• Provide a return name and address on the front of the document.

• A legal description of the real property must be provided.

• Any document that transfers an interest in real property must include the following “Notice of Confidentiality Rights:” NOTICE OF CONFIDENTIALITY RIGHTS: IF YOU ARE A NATURAL PERSON, YOU MANY REMOVE OR STRIKE ANY OR ALL OF THE FOLLOWING INFORMATION FROM ANY INSTRUMENT THAT TRANSFERS AN INTEREST IN REAL PROPERTY BEFORE IT IS FILED FOR RECORD IN THE PUBLIC RECORDS: YOUR SOCIAL SECURITY NUMBER OR YOUR DRIVER’S LICENSE NUMBER.
