Recording requirements for real estate deeds in Arizona
• A real estate deed in Arizona cannot be recorded unless it is accompanied by a completed and signed Affidavit of Property Value form. If a deed is claiming an exemption, the exemption number must be listed on the face of the deed. Exemption numbers can be found on the back of the Affidavit of Property Value form. The form can be found at the Arizona Department of Revenue webpage.
• Documents should include a title that briefly explains the nature of the instrument. (warranty deed, quit claim deed, for example).
• Deed documents should be submitted on 8.5x11 inch white paper or 8.5x14 inch white paper, with a font size of at least 10 point.
• Documents should be originals with original signatures.
• Deeds must be signed by the grantor and must list a valid name and mailing address for the grantee.
• The following language may be used for a quit claim deed: ‘For the consideration of_______________, I hereby quit claim to A.B. all my interest in the following real property. (followed by a description).’
• Any document that is modifying a previously recorded document should state the recording date, docket and page or year and sequence number of the document being modified.
MARGIN STANDARDS
• The first page of a document should have at least a 2 inch top margin. This is reserved for recording purposes.
• The left 3.5 inches of the top margin on the first page should give the name of the person requesting the recording. The name and address of the person to whom the document should be returned after recording should also be in this space.
• All other margins should be at least ½ inch on the top, sides, and bottom. |
