Bartholomew County Recording Information
REQUIREMENTS

• Documents should be on white paper no larger than 8.5x14 inches.

• Black ink in at least 10 point font should be used.

• On the top and bottom of the first and last page, a blank 2 inch margin should be provided. Side margins should be at least ½ an inch. Interior margins should be at least ½ an inch for top, bottom, and sides.

• An instrument of conveyance or a mortgage must be acknowledged by the grantor in order to be recorded.

• Names must be typed or printed underneath signatures.

• If the instrument is a copy, it shall be marked “Copy.”

• For each document affecting real estate, the name of the person preparing the instrument is required to be on the first page.

• Notarized documents require county residence of notary and commission expiration date.

• Transfer of deeds for taxation requires an endorsement by county auditor before they can be recorded.

• For a deed, a land contract, or other document transferring land, a sales disclosure must be submitted.

A fee simple conveyance:
A conveyance of land that is:
(1) worded in substance as “A.B. conveys and warrants to C.D.” (insert a description of the premises) “for the sum of” (insert the consideration); and
(2) dated and signed, sealed, and acknowledged by the grantor;
is a conveyance in fee simple to the grantee and the grantee’s heirs and assigns with a covenant as described in subsection (b).


Incorporating by reference recorded encumbrances:
Sec. 17. A conveyance of land may incorporate by reference a recorded covenant, restriction, easement, or other encumbrance on the use of the land with a clause that is substantially similar to either of the following:
(1) “Subject to the __________ (insert the type of encumbrance) recorded on _____ (insert the date of recording) in ___________ (insert the book and page number on which the encumbrance is recorded or the instrument number in which the encumbrance is recorded).”
(2) “Subject to ___________ (insert the type of encumbrance) of record.”

RECORDING FEES

To record the first page of a deed (not to exceed paper size 8.5x14), the fee is $16. Each additional page is $2.

To record the first page of a mortgage (not to exceed paper size 8.5x14), the fee is $14. Each additional page is $2.

Affidavits are $11 for the first page (not to exceed paper size 8.5x14) and $2 for each additional page.

Each cross reference of a recorded document is $1.

Any document exceeding 9x15 is $20 for the first page and $5 for each additional page.

A nonconforming fee of $1 per page will be applied to each nonconforming page, in addition to regular recording fees.
