How to Prepare a Standard Real Estate Deed in Finney County, Kansas |
|
The recording act in Kansas is a notice statute. A later buyer who pays fair value for the real property and does not have notice that there were any other earlier conflicting interests, wins and will have priority over any later recordings.
All transactions involving real estate within the county are recorded with the Register of Deeds. Easements, warranty deeds, and other instruments pertaining to real property located in Finney County can be recorded with the Register of Deeds.
DOCUMENT STANDARDS
• Originals or certified copies can be submitted for recording. White paper measuring 8.5x11 inches should be used. Black ink with a minimum font size of at least 10 point will help meet legibility standards.
• Documents must be signed and notarized. Original signatures are required. Notary seals must be legible and must include the expiration date. If a raised seal is issued, the name must be typed or printed below the signature line.
• The entire document must be of sufficient legibility so as to produce a clear and legible reproduction. If a document is judged to be illegible, it shall be accompanied by a legible copy so as to produce a clear reproduction. The new document will be recorded contemporaneously with the original document and will be counted as additional pages.
• All schedules and exhibits accompanying the document should be clearly identified and labeled.
• At the top of the first page, include a margin of at least 3 inches. This should be left blank for the recorder’s use. All other margins should be at least 1 inch.
• The grantor and grantee should be identified in the deed.
• On the first page, provide the name and address of the individual who prepared the document.
• Include a return name and address so that the document can be returned after recording.
• A legal description of the real property must be on the document or included as an exhibit. City descriptions include a lot, block, and addition or subdivision name. Boundaries indicated by a metes and bounds description should include section, township, and range. If a previously recorded instrument is referenced, provide the reference book and page number.
• The consideration paid should be stated in the deed.
A completed Kansas Real Estate Sales Validation Questionnaire should be submitted with each deed presented for recording. If the document is exempt, this exemption must be clearly stated on the deed. The Validation Questionnaire, along with a list of exemptions, can be found on the Kansas Registers of Deeds website or on the Finney County website. The grantor or grantee should complete this form.
RECORDING FEES
To record a deed, mortgage, or other instrument of writing, the fee is $8 for the first page and $4 for each additional page or fraction thereof. This fee refers to documents that are not larger than 8.5x14 inches.
To record a release or assignment of real estate mortgage, the fee is $7 for the first page and $2 for each additional page. For each additional book and page assigned or released, $5 will be added.
An additional $1 will apply if names are not written, typed, or stamped beneath signatures.
To certify any instrument of record, the fee is $1.
