Preparing a Standard Real Estate Deed for Recordation in Clearwater County, Idaho
The County Clerk is responsible for recording, filing, and indexing a large number of documents. Warranty deeds, quit claim deeds, and other instruments pertaining to real property located in Clearwater County can be recorded with the County Clerk.

Idaho is a race-notice jurisdiction. A later buyer who pays fair value for the real property, does not have notice of any earlier conflicting interests, and records first, wins and will have priority over any later recordings.

REQUIREMENTS FOR DOCUMENTS

• Documents presented for recording must be notarized originals or certified copies.

• Page size may not exceed 8.5x14 inches and may not be smaller than 8.5x11 inches.

• Each page of the document is to be typewritten or legibly handwritten. The text should be in Times New Roman, black ink, and a font size of at least 12 point.

• Provide a 2-inch top margin on the first page. All other margins should be
at least 1 inch.

• Provide a document title immediately below the 2-inch top margin.

• The grantee’s name and mailing address must be on all deeds.

• Provide a legal description of the property being conveyed.

Idaho does not have a statutory deed format. A document of conveyance is a warranty deed by virtue of words of warrant being included in the instrument. A quit claim deed is an instrument of conveyance that does not make any warranties and simply releases the grantor’s current right, title, and interest.

A summary of an instrument creating an interest in, or affecting the title to or possession of real property may be recorded if the requirements are substantially met. A summary should be signed and acknowledged by all parties to the original. The following information should be clearly stated in the summary: the names of the parties to the original, a description of the interest or interests in real property created by the instrument, and the legal description of the property. If the requirements are met, the summary may be recorded and, as to the contents of the summary only, it shall have the same force and effect as if the original had been recorded, and constructive notice shall be deemed to be given concerning the contents of the summary and the existence of the instrument to any subsequent purchasers that acquire an interest in the real property.

RECORDING COSTS

To record the first page of a document, the fee is $10. Each additional page is $3.

Copies of recorded documents are $1 per page.

A certified copy is $1 per document.

Fees must be paid before a document can be recorded.
