Standards for Recording a Real Property Transfer in Durham County, North Carolina
Easements, warranty deeds, and other instruments pertaining to real property located in Durham County can be recorded with the Register of Deeds. The Register of Deeds acts as legal custodian of all land titles and land transaction documents in Durham County.

The recording act in North Carolina is a race act. This is also known as “race to the courthouse.” Under this statute, the document that is recorded first wins and will have priority over any later recordings.

RECORDING STANDARDS

• Submit documents on 8.5x11 inch white paper or 8.5x14 inch white paper.

• At the top of the first page, include a blank 3-inch top margin. All other margins should be at least ¼ of an inch.

• Immediately below the 3 inch top margin, include a document title.

• Black type, in a minimum font size of 9 point, on white paper is required. Blanks in an instrument may be completed in pen. Printing should be one-sided only.

• The grantor must sign the document and must have his/her signature notarized.

• On the first page, provide the name and address of the person who drafted the instrument.

• The grantee’s name and address must appear on the deed for tax billing purposes.

• Under the new indexing standards (to take effect July 1, 2012), names will be entered into the database as they appear on the document.

• A legal description of the real property must be included. Legal descriptions can be obtained from the Durham County Tax Administration website or from a deed.

RECORDING COSTS

If an instrument does not meet the requirements, the Register of Deeds will charge the $25 non-standard fee. However, if an instrument fails to meet the font size requirements, but is determined by the Register to be legible, it may be recorded without the non-standard fee.

To record a deed, the fee is $26 for the first fifteen pages and $4 for each additional page.

A deed of trust or mortgage is $56 for the first fifteen pages and $4 for each additional page.

Multiple instruments in one document will be $10 each.

Additional subsequent instrument index references are $25.

The current North Carolina excise tax stamps are $1 per $500 or fraction thereof of the value of the property conveyed. It is the duty of the person presenting the instrument to report the correct amount of tax due.

Cash or checks are acceptable methods of payment. A self-addressed stamped envelope should accompany documents.
