The Register of Deeds office is responsible for recording legal documents that protect the rights of public citizens, especially those rights pertaining to real estate.
Recording an instrument gives public notice of its contents. Any instruments first registered (recorded) or noted for registration shall have preference over an earlier instrument; unless, according to the rules of the court, that the party claiming under the subsequent instrument had full notice of the previous instrument.
REQUIREMENTS FOR DOCUMENTS
• Submit a deed or other real property document on 8.5x11 inch white paper or 8.5x14 inch white paper.
• The first page should have a 3-inch top and bottom margin. Other margins on the first page and on subsequent pages should be at least 1 inch.
• To ensure legibility throughout the document, use black ink and a font size of at least 12 point.
• Printed or typed names should be beneath all signatures in the document. The grantor’s signature must be acknowledged by a notary. Two witnesses are required if a notary acknowledgment is not present.
• Deeds should include the name and address of the property owner in addition to the name and address of the person responsible for the payment of real property taxes.
• The name and address of the preparer of the instrument should be given on the first page in the following format: “This instrument was prepared by NAME and ADDRESS.”
• A legal description of the real property is required for deeds and mortgages. If the property has been improved, there should be a notation at the end of the legal description that indicates the improvement, followed by the street number and post office address.
• At the end of the legal description, provide the name, license number, and address of the surveyor who prepared the boundary survey from which the description was prepared.
• A parcel identification number is required on all documents. The format of this number is MAP, GROUP, and PARCEL.
• Instruments should contain recitals designating the deed, will court decree, or other source from which the grantor received equitable interest. If the source of equitable interest is a deed or other instrument recorded in the Register of Deeds office, the type of instrument, office, book, and page should be cited on the document being presented for recordation. If no preceding instrument has been recorded, this should be cited on the current instrument.
• The document referencing system is a book and page format.
Deeds must include the following statement: “I/we hereby swear or affirm that the actual consideration for this transfer, or value of the property in interest in property transferred, whichever is greater is _____________, which amount is equal to or greater than the amount which the property or interest in property transferred would command at a fair and voluntary sale.” This statement is to be signed and notarized.
Trust deeds, mortgages, modification agreements and assignments must include the following statement: “Maximum principal indebtedness for Tennessee recording tax purposes is $_____.”
RECORDING FEES
The fee to record a deed, deed of trust, or mortgage is $12 for two pages. Each additional page is $5.
Multiple assignments or releases are $5 per reference after the first.
Deed transfer tax is $0.37 per $100.
A self-addressed stamped envelope is requested for return purposes. Checks should be made payable to “Maury County Register of Deeds.”
