Recording real estate deeds in Preston County, West Virginia.
The County Clerk is responsible for recording and maintaining real property documents. Warranty deeds, mortgages, and many other documents related to real property located in West Virginia are recorded by the County Clerk.
Recording Act: Every such contract, every deed conveying any such estate or term, and every deed of gift, or trust deed or mortgage, conveying real estate shall be void, as to creditors, and subsequent purchasers for valuable consideration without notice, until and except from the time that it is duly admitted to record in the county wherein the property embraced in such contract, deed, trust deed or mortgage may be.
RECORDING GUIDELINES
• The grantor must sign the document and have his signature acknowledged or proved by two witnesses.
• The name of the person or governmental agency who prepared the document must be given at the conclusion of the form. The name should be printed, typewritten, or stamped in a legible manner.
• Use white paper measuring 8.5x11 inches and a legible font. Originals or certified copies may be recorded. Printing should be single-sided only. Pages with double-sided printing will be charged as two pages.
• Provide a legal description of the property being conveyed.
• The consideration exchanged for the property should be listed on the document, as this is how the state excise tax is calculated. |
