A notary readies the property deed for recording with the county for\nall the world to see. <\/p>\n\n\n\n<p>Notarizing a document means&nbsp;witnessing a&nbsp;signature,\nand verifying that the right person signed a document, knowingly and voluntarily.\nYet bad actors can, and often do, turn up at the recorder\u2019s office with bad\ndeeds, wrecking the rightful homeowners\u2019 lives. The notary system is vulnerable.\nIs it obsolete? <\/p>\n\n\n\n<p>Consider a squatter in San Antonio who, in 2019, faked a notary seal to \u201cverify\u201d the signatures of a long-dead couple. The point of this was to file a <a href=\"https:\/\/www.ksat.com\/news\/defenders\/2020\/06\/08\/squatter-accused-of-forging-signatures-of-dead-couple-on-a-fake-deed-so-why-wasnt-she-charged\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">fraudulent general warranty deed<\/a> and thereby sell the property to an investor. The squatter botched not just one but <em>both<\/em> of the deceased owners\u2019 names \u2014 but also got away with filing a corrective deed for the property. <\/p>\n\n\n\n<!--more-->\n\n\n\n<p>Sometimes, abuse happens right under the notaries\u2019 noses. In a September 2019 article in <em>The National Notary<\/em> magazine titled <a href=\"https:\/\/www.nationalnotary.org\/notary-bulletin\/blog\/2019\/11\/loose-notary-seals-sink-deals\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Loose Notary Seals Sink Deals<\/a>, Michael Closen writes about the ease with which a notary\u2019s tools, if not properly kept in locked drawers or filing cabinets, are deliberately misused in office settings. Lawyers or co-workers can just grab and use notaries\u2019 seals and journals. Seals that have expired sometimes show in thrift shops, or in online marketplaces. An expired seal is attractive to a fraudster who knows how to fake signatures and backdate documents. <\/p>\n\n\n\n<p>Moreover, notaries themselves are only human. They can\u00a0fail to <a href=\"https:\/\/www.nationalnotary.org\/notary-bulletin\/blog\/2014\/09\/matching-faces-to-id-harder\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">fail to detect fakes<\/a> when checking document signers\u2019 ID cards.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Three Technologies: eRecording, eNotarization, and Remote Online\nNotarization<\/h2>\n\n\n\n<p>Today\u2019s electronic notarization and recording technology deters\nfraud. Someone trying to manipulate the technology would leave a digital\nfootprint that was never a factor in the traditional method. If some aspect of\nthe document authentication process is challenged later, every facet of the\nverification and recording can now be digitally traced.&nbsp;<\/p>\n\n\n\n<p>The coronavirus pandemic served as a catalyst for a quick shift\nto three remote technologies in many states, counties, and cities. The\nimmediate pain point was the inconvenience of doing business during\nhealth-related shutdowns. In March 2020, people were having trouble contacting\ndeed recorders and completing transactions. And they asked: Why can\u2019t the signing\nand recording of paperwork be done from anywhere? <\/p>\n\n\n\n<p>They can be, where electronic and remote notarizations\nbecome accepted practices. And they will become accepted, when they are\nunderstood as safe and secure. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Popping Up Everywhere: eRecording<\/h3>\n\n\n\n<p>As we\u2019ve reported previously, <a href=\"https:\/\/www.deeds.com\/articles\/pandemics-property-transfer-breakdowns-the-digital-real-estate-industry-is-coming\/\">Cook County, Illinois<\/a> led the pack, proving the feasibility of remote deed recording. In March 2020, it issued an announcement that deed recording would continue despite physical office closures. Settlement agents could file legal instruments that follow the county guidelines by way of\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/cookrecorder.com\/e-record-deeds-cook-county\/\" target=\"_blank\">eRecording<\/a>. Taking a similar tack, Sarasota County\u00a0deployed\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.sarasotaclerk.com\/e-services\/online-filing\/e-recording\" target=\"_blank\">eRecording for deeds and other real estate documents<\/a>. And so on. Very soon, this will be standard. In 2020, Kentucky <a href=\"https:\/\/www.businesswire.com\/news\/home\/20200122005191\/en\/Kentucky-Goes-Live-with-E-recording-Using-Simplifile\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">joined 48 other states<\/a> and adopted eRecording for real estate documents. (Vermont was the last holdout.)<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">A More Gradual Entrance: eNotarization and Remote Online Notarization<\/h3>\n\n\n\n<p>Recording is one thing; notarization is another. There are\ntwo types of electronic notarization:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Electronic notarization: Jurisdictions are\nadopting the eSigning feature, by which deeds or other real estate documents\nare signed on an electronic device, with the notary present in person to attach\nan electronic seal. Tamper-resistant&nbsp;eNotarization seals digitally flag\nattempts at fraud.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Remote online notarization: Notarization <em>from a distance,<\/em> using a webcam to record the notarial act, is now a reality, although it\u2019s taking longer to catch on. Traditionally, notaries have believed that face-to-face meetings are essential to an authentic verification of the signer\u2019s identity. With remote notarization platforms, a document\u2019s signers will be asked to undergo credential analysis and other processes, such as fielding a series of personal questions to prove who they are, using the remote identification process known as <a href=\"https:\/\/www.nationalnotary.org\/notary-bulletin\/blog\/2020\/04\/identify-signers-remote-online-notarization\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Knowledge Based Authentication<\/a>, or KBA. To be verified, the signer could have to choose one out of five possible balances that matches their mortgage debt, or a former address.<\/li><\/ul>\n\n\n\n<p>The industry has many questions. Can <a href=\"https:\/\/www.deeds.com\/articles\/remote-notarization-of-real-estate-deeds\/\">remote\nonline notarization<\/a> (RON) take the place of face-to-face meetings? Will\nthe platforms be fraud-resistant? Will underwriters who today demand ink\nsignatures and physical notary stamps be assured of the safety and security of\nremote notarizations? <\/p>\n\n\n\n<p>There is also the matter of uniformity. Will all states\naccept these authentications? One of the major concerns underwriters and title\ncompanies have had is the different approaches that&nbsp; various states have taken when <a href=\"https:\/\/www.alta.org\/media\/pdf\/ron\/remote-online-notarization-checklist.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">regulating RON at the state level<\/a>. These questions\nare now finally being answered at the federal level. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How State and Federal Law Are Updating the Notary System <\/h2>\n\n\n\n<p>Guided by the belief that technology could better serve people conveying their homes, <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/web.ubcc.org\/news\/newsarticledisplay.aspx?ArticleID=1658\" target=\"_blank\">New Jersey and Pennsylvania lawmakers<\/a> want their states to adopt a new norm, in which the counties and cities use\u00a0RON \u2014 as well as eRecording and eNotarization \u2014 so that fully remote closings can happen. A growing number of states\u00a0facilitate remote online notarizations using audio-visual conferencing technology; and now, <a href=\"https:\/\/blog.alta.org\/2020\/03\/gses-issue-new-guidance-on-ron-powers-of-attorney.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Fannie Mae and Freddie Mac are creating standards for the use of RON<\/a>. We can expect lawyers, title companies, and their customers across the country to follow suit. <\/p>\n\n\n\n<p>In March 2020, the Securing and Enabling Commerce Using Remote and Electronic Notarization Act (<a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/senate-bill\/3533\" target=\"_blank\">Senate Bill 3533<\/a> \/ <a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/house-bill\/6364\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">House Bill 6364<\/a>, the \u201cSECURE Act\u201d) was introduced to standardize both eNotarizations and audio-visual RON for documents affecting interstate commerce. <\/p>\n\n\n\n<p>Assuming this federal law is enacted, all U.S. notaries will\nbe able to accept remote notarizations using tamper-resistant technology. With\na federal law, the industry will finally have uniform rules and standards to\nensure authenticity of documents and prevent <a href=\"https:\/\/www.deeds.com\/articles\/category\/deed-fraud\/\">deed fraud<\/a>. The Mortgage\nIndustry Standards Maintenance Organization is ready. The group has issued a\ndirectory of&nbsp;<a href=\"http:\/\/www.mismo.org\/standards-and-resources\/digital-mortgage-resource-center\" target=\"_blank\" rel=\"noreferrer noopener\">remote notarization providers<\/a>, calling RON \u201cone important\ntool\u201d to support convenience and security alike.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Remote Notarization as a Key Aspect of Tomorrow\u2019s Digital Real Estate Market\n<\/h2>\n\n\n\n<p>Will tomorrow\u2019s buyers and sellers handle their full real\nestate transactions from the comfort of their homes? The signs are here: the\nday is coming. The benefits in convenience and control over the process appeal\nto the <a href=\"https:\/\/www.deeds.com\/articles\/buying-real-estate-are-the-generations-really-different\/\">new\ngenerations of homebuyer<\/a>. <\/p>\n\n\n\n<p>Meanwhile, the industry and lawmakers are working on the standards we need to have confidence in a modernized system.\u00a0Can they do it? Inevitably, they will, and the notary system will be much better for it. Think back to those notary tools left out of the locked file cabinet, sitting in the open on the notary\u2019s desk. Now, consider the scenario in states where RON is already standard practice. Here\u2019s what happens in the modernized system. Some of these details are explained in the <em><a href=\"https:\/\/www.nationalnotary.org\/notary-bulletin\/blog\/2020\/09\/faq-remote-online-notarization-journals-and-recordings\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">National Notary Bulletin<\/a>:<\/em> <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The notary must permanently keep both the journal\nand the webcam recording in a tamper-resistant file.<\/li><li>The notaries must also keep a backup file for\nthese materials.<\/li><li>The materials must be held securely by the notary\nin a password-protected format, using automatic sign-off feature in idle time. <\/li><li>The notary has to use an encrypted system, and open\nfiles after using multi-factor authentication. <\/li><li>There is no way to alter the entries made in the\nnotary\u2019s journal.<\/li><\/ul>\n\n\n\n<p>Interested in knowing more about the status of electronic recording and notarizations where your home is?
