But recently they ran into trouble paying their mortgage. That was when they <a aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.nbcmiami.com\/responds\/couple-says-they-were-tricked-into-signing-over-their-home\/2175330\/\" target=\"_blank\" rel=\"noreferrer noopener\">mistakenly transferred their home deed<\/a> to another Miami resident, who offered to help them rent out their home. Thinking they were signing a Section 8 housing application \u2014 which would help them rent out space affordably to low-income people \u2014 they in fact signed a <a href=\"https:\/\/www.deeds.com\/quitclaim-deed\/\">quitclaim deed<\/a>.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>Quitclaims have appropriate uses. They can work perfectly to convey property interests between trusted people in the right situations. Unlike a&nbsp;transfer by <a href=\"https:\/\/www.deeds.com\/warranty-deed\/\">warranty deed<\/a>, a quitclaim doesn\u2019t involve a title search, so it is an efficient way to convey a home from one person to the next, without surveys, appraisers, inspectors, or agencies in the middle. But the same traits that make quitclaims convenient also make them easy to manipulate. Having recorded the quitclaim in the county records, a deceptive person can apply for loans on the property\u2019s value, sell the house, or rent it out. The person who took advantage of Evelio and Milagros had the third option in mind.<\/p>\n\n\n\n<p>That new owner became their landlord. Suddenly, Evelio and\nMilagro found themselves squeezed into a bedroom as other people started\nrenting rooms in what used to be their house. A surreal story? Wait. It gets\neven worse. A quitclaim deed conveys property ownership \u2014 not the mortgage. The\nduped homeowners still owe the mortgage payments that created this scene in the\nfirst place. <\/p>\n\n\n\n<p>Although they did not mean to sign their home away, Evelio\nand Milagros did just that. To the Economic Crimes Bureau in Miami-Dade County,\nit\u2019s an all-too-common situation. Elderly homeowners especially fall into such\ntraps, agreeing to \u201csign here, initial there\u201d because they think the other\nperson is helping them. They might even be signing a number of legitimate\npapers \u2014 and fail to notice that one in the stack that\u2019s a problem.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Meanwhile, in Connecticut\u2026<\/h3>\n\n\n\n<p>A lawyer called the police to report what seemed to be a falsely notarized quitclaim deed. The owner of the house was in a care home and had nothing to do with the notarization. The notary involved is now being investigated and could be charged in connection with the fraud. The alleged fraudster, who <a href=\"https:\/\/www.theridgefieldpress.com\/news\/article\/Police-Man-allegedly-forged-property-transfer-15575740.php\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">lived in the Fairfield County house<\/a>, is free on bond until arraignment.<\/p>\n\n\n\n<p>While scammers are drawn to quitclaim deeds for easy transfers of property, <a href=\"https:\/\/www.deeds.com\/articles\/modernizing-an-archaic-notary-system-for-real-estate-documents\/\">the archaic system of notarizations<\/a> is yet another issue. This makes the abuse or falsification of notarial documents a major problem in real estate conveyances. By the time the instrument gets to the recorder of deeds, the fraud is usually a fait accompli. Under the law of most states, it is not the county recorder\u2019s role to investigate documents for fraud or false signatures. &nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Around the Same Time,\nin Wisconsin\u2026 <\/h2>\n\n\n\n<p>An Oshkosh resident who <a href=\"https:\/\/www.wbay.com\/2020\/09\/11\/oshkosh-man-charged-with-stealing-thousands-from-92-year-old-woman\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">held the power of attorney for a 92-year-old care home resident<\/a> was charged with wrongly taking the house from the nonagenarian, using \u2014 you guessed it \u2014 a quitclaim deed.<\/p>\n\n\n\n<p>A <a href=\"https:\/\/www.deeds.com\/articles\/conveying-real-estate-through-a-power-of-attorney\/\">power of attorney<\/a> might be drafted for estate planning, along with a will. It appoints someone as an agent, so that when a person loses the ability to make legal decisions, a representative\u2019s decision-making power can be used.\u00a0As you see, the selection of the agent can backfire. Urge your elder relatives to do the same.\nGranted, this advice may be useless to the homeowner who goes into cognitive\ndecline with age. But forewarned is forearmed. Here\u2019s what we all should do as\nwe plan to protect ourselves and others later in life. <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Check up on your deed. County records are available online in many localities. Put a monthly reminder in your calendar to look at your records and make sure no expected activity is recorded. Sign up for a fraud alert account if your recorder of deeds offers the feature. For example, here is <a aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.phila.gov\/media\/20191023090257\/Fraud-guard-tip-sheet.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Philadelphia\u2019s fraud guard<\/a> information sheet. An account is offered by the city records department free of charge.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Monitor the records of family members who have<br>passed away, have age-related disabilities, or are in care. Open probate promptly<br>in a family member passes. Keep a watch on the registry of deeds, and pay<br>special attention to homes the elder or deceased person no longer occupies.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.deeds.com\/articles\/new-homeowners-document-checklist-storage-plan\/\">Organize your real estate papers<\/a> (the deed, mortgage documents, insurance papers<br>and so on). Store it all carefully, so if you ever need proof of ownership what<br>you\u2019ve invested in your home, you\u2019ll be able to produce it. <\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Monitor your <a aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.annualcreditreport.com\/index.action\" target=\"_blank\" rel=\"noreferrer noopener\">credit reports<\/a>. Sign up for large deposit and withdrawal notices from your banks. Learn about your credit cards\u2019 identity theft protection services.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Find out what\u2019s going on if you or your loved<br>ones receive unexpected utility bills or past due notices of any kind. They<br>could be signs of someone tampering with your identity. <\/li>\n<\/ul>\n\n\n\n<p>Finally, to the extent possible, speak with your loved ones openly about your wishes and expectations surrounding your property should you become unable to explain those wishes. Those diagnosed with conditions impacting their <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.nia.nih.gov\/health\/legal-and-financial-planning-people-alzheimers\" target=\"_blank\">physical or cognitive abilities<\/a> should take time to \u201c<a href=\"https:\/\/www.nia.nih.gov\/health\/getting-your-affairs-order\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">get their affairs in order<\/a>\u201d before they become vulnerable to exploitation. It\u2019s best to involve a real estate lawyer or financial professional who is familiar with both the state law and the person\u2019s life circumstances. A neutral party can help predict risks and ensure a person\u2019s goals and priorities are respected when that person becomes unable to defend them. <\/p>\n\n\n\n<p>The bottom line? We all become vulnerable at some point. Why? Surely it should be no problem to recover a\nhome that\u2019s been taken by a manipulator? Not so. Once a homeowner signs a\nquitclaim deed, that ownership has ended. Reversing property fraud involves\nlegal action and will require a judge\u2019s order. In some cases, recovering a title\nand evicting a fraudster can amount to tens of thousands of dollars in legal\nbills. That doesn\u2019t even get into the cost of fixing any damage to, or losses\nfrom, the home.<\/p>\n\n\n\n<p>And if you are buying a home, guard against possible fraud in the chain of title. Have a title search done, and strongly consider obtaining a <a href=\"https:\/\/www.consumerfinance.gov\/ask-cfpb\/what-is-owners-title-insurance-en-164\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">homeowner\u2019s title insurance policy<\/a>. Some frauds do not get discovered until after the culprit sells the house. Your home may be the most important asset you have.
