For your deed to be recorded, it is\nnotarized first. Recording puts the world on notice of the conveyance, by updating\nthe county\u2019s public land records. <\/p>\n\n\n\n<p>Today, with so much documentation first going (first) digital\nand (now) remote, can real estate deeds be notarized from afar? In most states\nthey can. The signers and the notaries can sign and notarize a document\ndigitally (eSigning and eNotarizing it); and notaries are now taking it all one\nstep further: performing their work without the need for in-person appearances\nby signers. <\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Doesn\u2019t Notarization Have to Be In-Person, By Definition?<\/h2>\n\n\n\n<p>Traditionally, that\u2019s been the case. But technology is\npressing changes in property law \u2014 especially since the 2020 pandemic closed\noffices and complicated in-person business.<\/p>\n\n\n\n<p>To be specific, a number of states are now getting on board\nwith <a href=\"https:\/\/www.deeds.com\/articles\/remote-notarization-of-real-estate-deeds\/\">remote\nonline notarization<\/a> (RON). States that use RON allow their notaries\nto use audio-video tools, including webcams, to officiate and record the remote\nsigning \u2014 in-state and sometimes interstate, too. Interest in RON was greatly accelerated\nby state governors\u2019 stay-at-home rules, because once offices closed, states\nwithout RON suddenly found themselves lagging behind. So, 2020 was a milestone\nyear for the RON trend. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Lawmakers in Nearly All States are Developing or Have Already Implemented\nRON.<\/h2>\n\n\n\n<p>This includes&nbsp;Maryland,&nbsp;Washington, and Wisconsin.\nArizona\u2019s governor issued an Executive Order to speed up the state law that to\nenable signers and notaries to meet virtually, so its RON legislation is now in\nfull effect. New Jersey\u2019s legislature enacted a remote online notarization law\nin April 2020. Alaska\u2019s RON law was enacted in April as well. Nebraska&nbsp;and\nIowa&nbsp;have sped up adoption through those states\u2019 emergency rules.&nbsp;RON\nbills were also recently introduced by legislators in Colorado, Louisiana,\nMassachusetts, and Mississippi.&nbsp;And at last, South Carolina has a bill in\nthe works to enable and standardize RON.<\/p>\n\n\n\n<p>States are implementing remote data security standards from the <a rel=\"noreferrer noopener\" href=\"https:\/\/www.mismo.org\/standards-and-resources\/emortgage-specifications\/remote-online-notarization-standards\" target=\"_blank\">Mortgage Industry Standards Maintenance Organization<\/a>, which are intended \u201cfor broad use across the entire residential mortgage industry.\u201d Moreover, mortgage specialists can now refer to guidance from <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/blog.alta.org\/2020\/03\/gses-issue-new-guidance-on-ron-powers-of-attorney.html\" target=\"_blank\">Fannie Mae and Freddie Mac<\/a> for <a href=\"https:\/\/altaonline.typepad.com\/.a\/6a0192ac343706970d0240a51c24c5200b-pi\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">RON use in 42 states<\/a>. Both entities direct the remote online notary public to use:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Multi-factor identity verification, a government\nphoto ID with a signature, and credential analysis.<\/li><li>Tamper-sealed documents \u2014 meaning the remote\nonline notary would attach the e-Signature and seal to the RON certificate with\na method that automatically flags any future alterations to the notarized\ndocument. <\/li><li>Ample system security.<\/li><li>A secure electronic journal, which holds audio-visual\nevidence of identity.<\/li><li>A backup of the files.<\/li><li>Storage for seven years or as directed by state\nlaw. <\/li><\/ul>\n\n\n\n<p>The hope for many in the property technology (\u201c<a href=\"https:\/\/www.deeds.com\/articles\/category\/proptech\/\">proptech<\/a>\u201d)\nfield is that closing on homes can be done electronically from start to finish.\nGiven that federal standards are already in the works, states that have\nresisted the trend are now satisfied that the notary component can be done\nsafely, and are moving forward with policy-making. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What About the RON Holdouts?<\/h2>\n\n\n\n<p>Oregon and a handful of other states have been RON holdouts.\nLet\u2019s face it: switching to online methods isn\u2019t exactly easy for a process\nfocused for so many generations on in-person witnessing. The transition to RON\nwasn\u2019t immediately universal, and there is plenty of concern about this new way\nof working. <\/p>\n\n\n\n<p>Significantly, California is still not allowing RON. How do people in the state handle the need for remote services when offices are closed? Some essential services (UPS and FedEx) provide notaries. Or people call on mobile notaries. Some attorneys <a href=\"https:\/\/sapphire.law\/covid-19-remote-online-notarization-and-notarization-alternatives\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">recommend the use of out-of-state notary<\/a>. RON can be done from Nevada, Florida, Virginia or elsewhere for Californians, insofar as the remote online notarization is valid in the state in which the notarization occurs.\u00a0In contrast, some RON-enabling states \u2014 Maryland and Utah are two examples \u2014 require the remote notary and the signer to be in the same state when notarization occurs. \u00a0<\/p>\n\n\n\n<p>Potential legislative change in California could arrive through new notary provisions. A bill was introduced to permit RON during a state of emergency, but it died. As California did not issue emergency authorization for RON, the <a href=\"https:\/\/calawyers.org\/trusts-and-estates\/letter-regarding-covid-19-remote-online-notarization-by-california-notaries\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">California Lawyers Association<\/a> has pressed the Secretary of State for action on the matter. In the long term, AB 2424 could make RON permanently available in California. We shall see.<\/p>\n\n\n\n<p>The Mortgage Bankers Association and the American Land Title\nAssociation (in a collaboration called MBA-ALTA) have created model legislation\nfor states to follow. Several states have temporary versions of RON, or provisions\nthat do not comport with MBA-ALTA standards. And even where states have enacted\nlaws to support robust RON provisions, in-person notarization is still\navailable and some lenders expect it to be used. Applying RON to a real estate\ntransaction, notaries and title companies must review and follow their state\nRON provisions, and the rules put in place by the underwriters and lenders as\nwell.<\/p>\n\n\n\n<p><strong><em>Is your state updating its notary laws? Check with the <a href=\"https:\/\/www.asnnotary.org\/?form=notarylawupdates\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">American Society of Notaries<\/a>, which keeps tabs on new and pending legislation<\/em><\/strong>. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Will a Uniform, Nationwide RON Standard Look Like?<\/h2>\n\n\n\n<p>As noted above, MBA-ALTA model legislation is available as a guide for states. The associations note that it\u2019s essential to label the RON as an online notarization, differentiating it clearly from an in-person event. As <a href=\"https:\/\/www.alta.org\/media\/pdf\/ron\/remote-online-notarization-checklist.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">ALTA explains<\/a>, to be consistent with MBA-ALTA rules, a state RON law would \u201crequire disclosure of the fact of remote online notarization in the notarial certificate.\u201d<\/p>\n\n\n\n<p>Signers should have the choice to opt for RON or\nconventional notarization, according to MBA-ALTA, and the associations also\ninsist that limits on the technology or brands <em>not<\/em> be adopted by federal\nlaw. The idea is to support fair competition in the marketplace for RON and eClosing\nplatform vendors, and to allow innovation. <\/p>\n\n\n\n<p>Of course, there are minimum security standards in the\nMBA-ALTA model, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Several forms of identity verification required,\nincluding photo ID, proofing and credential analysis.<\/li><li>Storage of an audio\/video recording to show the\nact of notarization.<\/li><li>Conformity to already existing laws covering\nelectronic recording.<\/li><\/ul>\n\n\n\n<p>The MBA-ALTA model was designed to promote interstate RON standards,\nand to align government agencies with other entities and affirm best practices\nin real estate documentation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Nationwide RON Implementation Is Now in Sight.<\/h2>\n\n\n\n<p>It looks like the next step will be a nationally uniform law\nauthorizing RON. The <em>Securing and Enabling Commerce Using Remote and\nElectronic Notarization Act of 2020<\/em> would set national standards for both\neNotarizations and RON. If enacted, it will enable notaries throughout the\nUnited States to perform RON for customers who opt in. It will mandate\nfraud-resistant technology to prevent <a href=\"https:\/\/www.deeds.com\/articles\/category\/deed-fraud\/\">deed fraud<\/a>. The Secure Act\nhas widespread, bipartisan support.<\/p>\n\n\n\n<p>Not only does this developing legal story point to more\nconsumer convenience; it also stands to make the U.S. real estate market much\nmore accessible to interstate and international buyers, for whom a physical\ntrip to the closing is currently a major hurdle.<\/p>\n\n\n\n<p><strong><em>Buying a\nhouse <\/em><\/strong><strong><em>from outside the United\nStates.
