If you co-own in a joint tenancy, a tenancy by the entirety, or community property&nbsp;with survivorship rights,&nbsp;review your state\u2019s law to make sure you follow it. Co-owners, of course, must sign the deed with you to make a valid transfer. One way is making a gift of the house. A properly\ndrafted&nbsp;gift deed immediately conveys the home for no&nbsp;consideration \u2014\nthat is, with no money or anything else expected in return for the gift. It makes\nan immediate <em>delivery<\/em> of the owner\u2019s interest to the recipient, too. The\nconveyance can\u2019t just be a promise that your child will get the house later.\nNor can you revoke your gift. <\/p>\n\n\n\n<p>First, be sure your child is ready for the responsibilities of homeownership. A <a href=\"https:\/\/www.deeds.com\/articles\/refusing-to-accept-a-deed\/\">gift of property can be refused<\/a>; but once your recipient takes possession of the home, your gift cannot be contested. When real estate is given to people other than spouses for free (or for only token consideration), expect federal gift and inheritance taxation, plus state gift taxation, as applicable. <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/frequently-asked-questions-on-gift-taxes\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">The IRS explains it here<\/a>. The IRS doesn\u2019t regard the home\u2019s value as income, but if your child rents out the property after receiving it, normal income taxes are due on the rental income.<\/p>\n\n\n\n<p>Taxes can be significant if you give your home to your adult\nchild while you\u2019re alive and the child needs to sell the home within two years.\nLong-term capital gains taxes will be due \u2014 if the property has appreciated in\nvalue since your initial investment in it \u2014 on the profit made between your\ncost basis to your child\u2019s sale proceeds, if you yourself owned the home for at\nleast a year before giving it away. There are two major types:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>A <em>revocable <\/em>living trust is a legal\ninstrument you control. You can revoke the trust or change its terms at any\ntime (until you pass on or become incapacitated, and the named trustee takes\nover). Though it keeps the home among your estate assets, the living trust\nbypasses probate \u2014 while still offering the benefit of a stepped-up&nbsp;tax\nbasis. As with a will, the beneficiary doesn\u2019t receive actual ownership rights\nbefore you pass on.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>A trust can, alternatively, be <em>irrevocable<\/em>.\nThe assigned trustee controls the account, including the tax payments, in\nkeeping with your goals \u2014 until you pass on and your child or children get the\nproperty. The irrevocable trust&nbsp;is subject neither to probate nor estate\ntax, but you\u2019ll be giving up your options to refinance or otherwise take loans\nout on the property. <\/li><\/ul>\n\n\n\n<p><strong><em>You can hold your property for your child without\nmaking a taxable gift. <a href=\"https:\/\/www.deeds.com\/articles\/holding-real-estate-in-a-trust-or-an-llc\/\">See\nmore options here<\/a>.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Where Allowed: The Transfer on Death Deed<\/h2>\n\n\n\n<p>Does your state allow\u00a0a <a href=\"https:\/\/www.deeds.com\/articles\/update-the-state-of-the-transfer-on-death-deed\/\">transfer on death\u00a0deed<\/a> for your home? This instrument works very much like the beneficiary forms you sign to ensure your financial accounts go to a specific person or persons when you pass on. You\u2019ll need to complete an Affidavit of Death form, and have it notarized. The form lets the home pass to your adult child later \u2014 without leaving the process to your personal representative in probate court.\u00a0<\/p>\n\n\n\n<p><strong><em>Pro tip:<\/em><\/strong> If you use a transfer on death deed, be\nsure to check with your county\u2019s records for liens and resolve them. Liens and\nany mortgage payments due will become your child\u2019s responsibility once you\u2019ve\npassed on.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Which Deed? Warranty or Quitclaim?<\/h2>\n\n\n\n<p>If you decide to convey your property, <a href=\"https:\/\/www.deeds.com\/articles\/transferring-a-deed-without-a-lawyer-heres-what-you-should-know\/\">review the necessary steps to create a valid deed<\/a>. Then record your deed promptly (some states have strict time limits!) in the home\u2019s county. There are two broad categories of deeds:<\/p>\n\n\n\n<p><strong>Warranty deed.<\/strong> The&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/you-have-the-deed-and-keys-to-your-new-home-what-about-a-guarantee\/\">warranty\ndeed<\/a> will need professional support, including a title search to\nfind outstanding liens, mortgages, defects or encumbrances. The recipient can\npurchase&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/real-estate-title-insurance-a-brief-explanation\/\">title\ninsurance<\/a>&nbsp;to cover many kinds of clouds on the title that a\ntitle search might miss. You can write\nit into your will, and it will&nbsp;effect the distribution of your assets at\nthe appropriate time \u2014 when the child reaches a certain age, for example. Note\nthat there are fees for this, as the probate court will need to review the\ntrust yearly until the assets have been distributed and the trust is closed. <\/p>\n\n\n\n<p>Set up the trust by describing the house and other included assets, identifying the beneficiaries, and naming a trustee. Include the timing of the distribution. After you pass away, your \u201cwill trust\u201d is irrevocable, <a href=\"https:\/\/www.nycbar.org\/get-legal-help\/article\/wills-trusts-and-elder-law\/trusts\/testamentary-trusts\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">unless the trust says the trustee can change its terms<\/a>. Obviously, the trustee should act in your child\u2019s best interests.
