Essentially\nthis means the agent you hire must act in your best interest.<\/p>\n\n\n\n<p>This is only the case if you and the agent signed an agency\nagreement, naming <em>you<\/em> as the agent\u2019s client. It\u2019s vital that you know if\nyour broker is also your agent. Check your contract. Note, too, that the\nagent\u2019s fiduciary duties must be followed, as long as you are the client \u2014 whether\nor not they are fully laid out in your agency contract. <\/p>\n\n\n\n<p>The key specifics of a agent\u2019s duties to the client appear\nin your state\u2019s real estate statute. But in general, fiduciary duties are the\nhighest of legal standards. Think of trustees, guardians, and personal\nrepresentatives. To act on another\u2019s behalf requires an unwavering sense of\nethics and care.<\/p>\n\n\n\n<p>The following are the fiduciary duties an agent must model. <\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Client First: The Duty of Loyalty&nbsp;<\/h2>\n\n\n\n<p>In representing you, your agent may not put their interests&nbsp;ahead\nof yours. Whether you\u2019re the seller or the buyer, your agent steps into your\nshoes when negotiating and leveraging opportunities. <\/p>\n\n\n\n<p>For example, your agent cannot rise to a meet competing\noffer just because that means a higher commission. Another example of\ndisloyalty involves the agent who buys your property, then flips it for a\nhigher price. House-flipping is fine and legal when the parties aren\u2019t\nconnected, but a fiduciary who flips your house is stealing your opportunity.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Following Through: The Duty of Obedience&nbsp;<\/h2>\n\n\n\n<p>A closely related fiduciary duty is obedience. As long as\nyou adhere to the limits of your contract with your agent, and you aren\u2019t\nasking that anything be done unethically, your agent must carry out your\ninstructions.<\/p>\n\n\n\n<p>Can an agent agree to a lower price than you said you\u2019re\nwilling to pay? No. The agent can advise you to be more flexible about the\nprice, but cannot negotiate outside your set limits unless you agree to change\nyour mind.<\/p>\n\n\n\n<p>Can a seller\u2019s agent refuse to lie for the seller about a\nrecurring flood problem in the basement? Yes. Should a buyer\u2019s agent let the\npotential buyer know if the agent spots evidence of sinkholes on the property?\nYes. <\/p>\n\n\n\n<p>If an agent is wondering whether some issue with the home\nshould be disclosed to the buyer, the right action is always disclosure. It\nmight just be a minor thing, but the buyer should have the opportunity to\ndecide. There are other things that should be disclosed, too\u2026 <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Transparency Matters: The Duty to Disclose<\/h2>\n\n\n\n<p>Are you putting your home on the market? Your real estate agent\nhas to tell you the facts that could impact your sale price, and also must tell\nyou about: &nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>All offers and who\u2019s making them, and whether\nthey are firm or negotiable. <\/li><li>Any relationship the agent might have with a\npotential buyer. <\/li><li>A buyer\u2019s likely intent to flip or subdivide the\nproperty.<\/li><\/ul>\n\n\n\n<p>Are you buying a home? Then your agent\nneeds to tell you about the history of a given home on the market and if there\nare competing offers. The agent must also tell you:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Whether you\u2019d be likely to successfully\nnegotiate the price.<\/li><li>Facts that impact a property\u2019s worth, including\nanything notable the agent learns about why the seller isn\u2019t keeping a given\nproperty. <\/li><li>Any relationship the agent might have with the\nseller of a home you might buy. <\/li><\/ul>\n\n\n\n<p>Generally, knowledge that could help you understand\nthe property\u2019s real value and help you get your best possible deal is something\nyour agent should communicate to you. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Loose Lips Sink Deals: The Duty of Confidentiality&nbsp;<\/h2>\n\n\n\n<p>You are going to tell your agent some personal things about\nyour life and financial situation. You can expect your agent to keep your\npersonal information private. Also, your agent should not divulge any knowledge\nthat undermines your bargaining position. This means, for example, if you\u2019re a\nseller, and your agent knows you will take a lower price than what\u2019s listed,\nthe agent should keep that under wraps until you\u2019re ready and willing to\nnegotiate. If you\u2019re a buyer and are prepared to pay more than your bid, a\nparallel rule applies.<\/p>\n\n\n\n<p><strong><em>Important note: <\/em><\/strong>The duty of confidentiality\ndoes <em>not <\/em>mean an agent may knowingly mislead a buyer about the condition\nof the seller\u2019s property. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mindfulness Exercises: The Duty to Apply Reasonable Care and Diligence&nbsp;<\/h2>\n\n\n\n<p>\u201cReasonable\u201d might seem subjective. But it means an agent must\napply the standard of care expected in the industry of a competent\nprofessional. <\/p>\n\n\n\n<p>Licensed agents should have acquired a particular skill set.\nTheir duty is to use their skills appropriately and diligently to pursue the\ngoals of the client. As with a lawyer or doctor, the real estate expert has an obligation\nto learn about and understand the client\u2019s specific situation and needs. <\/p>\n\n\n\n<p>What about information and support that\u2019s outside the scope\nof an agent\u2019s expertise but relevant to the deal? When additional expertise is\nneeded, an agent should know how to refer the right experts to the client.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Following the Money: The Duty of Accounting&nbsp;<\/h2>\n\n\n\n<p>It\u2019s an agent\u2019s duty to understand the elements of the\nfinancial transaction and to attend to them in a professional manner. An agent\nwho is asked to handle money, property, or deeds has a duty to safeguard them\nand to avoid commingling the agent\u2019s and the client\u2019s money.<\/p>\n\n\n\n<p>An agent may receive money for an escrow account. If so, it\nmust be deposited in the account.<\/p>\n\n\n\n<p>A seller\u2019s agent should keep track of all potential buyers,\nand keep the home locked and secure when leaving a showing.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Different Standards? The Transaction Brokers Who Aren\u2019t Agents<\/h2>\n\n\n\n<p>Let\u2019s get back to the point about actually hiring an agent\nwith fiduciary duties. Today, in several states, buyers and sellers can hire transaction\nbrokers. There is a difference between a broker and an agent. An agent\u2019s role\nis to represent, negotiate for, and be an advocate for one of the parties \u2014 not\nsimply facilitate the paperwork and act as a neutral broker of the deal.<\/p>\n\n\n\n<p>Transaction brokers are not agents. They do not advocate for one side. They may prepare purchase contracts, present purchase offers, and keep the parties on a timeline. They are usually less expensive to hire than agents. In some states this arrangement is the norm, while in other states, it\u2019s not allowed. In Florida, it\u2019s normal, and <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.tampabaynewswire.com\/2018\/03\/08\/floridas-dirty-little-secret-transactional-brokerage-leaves-consumers-as-clueless-as-ever-65968\" target=\"_blank\">some people aren\u2019t happy<\/a> about it. Transaction brokers are also common in <a href=\"https:\/\/www.coloradorealtors.com\/2019\/11\/05\/peterson-why-i-hate-transaction-brokerage\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Colorado<\/a>.<\/p>\n\n\n\n<p>Transaction brokers do not have to adhere to the set of fiduciary\nresponsibilities we\u2019ve listed above. And this means they might have no\nliability if a problem crops up. That said, a transaction broker must, under\nthe law, behave honestly and fairly, apply due diligence, and bring\nprofessional skill into a transaction. State law typically also directs all&nbsp;real\nestate brokers, whether or not they are classified as agents, to disclose any material\nfacts bearing on the parties\u2019 decision to carry out their transactions.<\/p>\n\n\n\n<p>A big issue here is that many people assume their real\nestate professional is working for them, when state law and custom might tell\nanother story. If their state uses brokers as the default relationship, does\nthe client know? Does the client fully understand the ramifications? Add to\nthis potential confusion the fact that states can and do modify their statutes.\nReal estate brokers\u2019 responsibilities and roles can change. <\/p>\n\n\n\n<p>So, when going into a transaction, understand whether your\nbroker is your agent.
