It offers effective ways to market properties\nfor property owners and managers, now that marketing messages can be placed\nonline to show loan options for interested applicants to use instantly. But for\nsome home seekers, a big concern is how real estate tech profiles apartment and\nmortgage loan applicants. Are apps, at least in some situations, having\nracially skewed effects? Can the slant be changed to better fit fair housing\nlaw and policy? These questions are now ripe.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Emerging Issue: Algorithmic Discrimination <\/h2>\n\n\n\n<p>Most any prospective apartment shopper, of course, goes through background checks. And today\u2019s\u00a0<a href=\"https:\/\/www.deeds.com\/articles\/pandemics-property-transfer-breakdowns-the-digital-real-estate-industry-is-coming\/\">mortgage apps<\/a>\u00a0scan loan applicants\u2019 financial accounts to quickly assess how much the hopeful home buyers are eligible to borrow. Both apartment property owners and mortgage companies must follow anti-discrimination laws. But what about their online screening tools?\u00a0<\/p>\n\n\n\n<p>In the best of scenarios, apps can make totally neutral,\nunbiased decisions. People may submit remote applications without their\nappearances being judged. They can obtain their pre-approval letters online, then\nadjust their terms and conditions, with Rocket Mortgage, Roostify, SoFi, Better.com,\nBlend.com and others. All background information is handled by the online software.\n<\/p>\n\n\n\n<p>What\u2019s more, a loan approval can be found online for just half\nthe price of a standard mortgage agreement. And the digital loan product is the\nsame in the end, as mortgage apps sell mortgages to banks, Fannie Mae, and the\nother usual players in the secondary loan market. Digital screeners assess\nfinancial data to discern a borrower\u2019s default risk \u2014 using criteria developed\nby the Consumer Finance Protection Bureau \u2014 the same way brick-and-mortar banks\ndo: by looking at the applicant\u2019s credit profile, debt, income and assets and so\non. &nbsp;&nbsp;<\/p>\n\n\n\n<p>But the other side of this is the way tech gets in the\nmiddle, possibly shielding companies from their legal responsibility to make\nfair and equitable decisions. <\/p>\n\n\n\n<p>In the 2015 case <em>Texas Department of Housing and\nCommunity Affairs v. The Inclusive Communities Project,<\/em> the&nbsp;U.S.\nSupreme Court said apartment applicant screening technology violates the Fair\nHousing Act if it creates discriminatory approval (\u201cdisparate impact\u201d) rates. Yet\nfaced with a recent challenge in federal district court against its tenant\nscreening tools, tech company CoreLogic claimed it is <em>not <\/em>subject to the\nFair Housing Act&nbsp;because its screener doesn\u2019t actually decide who can move\nin. A human being greenlights approval based on a review of the screener\u2019s\nresults. <\/p>\n\n\n\n<p>Right in the middle of this tension, the Department of Housing and Urban Development is making it\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.federalregister.gov\/documents\/2020\/09\/24\/2020-19887\/huds-implementation-of-the-fair-housing-acts-disparate-impact-standard\" target=\"_blank\">harder for people to claim they\u2019re facing discrimination<\/a> due to the use of screening apps. Fair housing advocates\u00a0and\u00a0groups addressing algorithmic discrimination are alarmed. And they aren\u2019t alone. The National Association of Realtors\u00ae <a href=\"https:\/\/www.nar.realtor\/newsroom\/nar-disappointed-in-administrations-final-affirmatively-furthering-fair-housing-rule\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">publicly objected<\/a>, in July 2020, that HUD changes then underway were eroding the long-standing policy of inclusivity that the Fair Housing Act stands for. NAR also observed that the problem is even worse because of Covid-19\u2019s outsized economic impacts on those coping with racial bias in many other facets of their lives.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Home Hunting While Black: Frustration and Hope in the Digital Era<\/h2>\n\n\n\n<p>We\u2019ve had the Fair Housing Act since 1968. Over these five\ndecades, though, the rate of U.S. Black home ownership has hardly increased. What\u2019s\nstanding in the way? It\u2019s usually the mortgage approval process.<\/p>\n\n\n\n<p>In 2019, the <a href=\"https:\/\/files.consumerfinance.gov\/f\/documents\/cfpb_2019-mortgage-market-activity-trends_report.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Consumer Finance Protection Bureau<\/a> found that Black borrowers take out the smallest loans; and, moreover: <\/p>\n\n\n\n<p><em>\u201cBlack and Hispanic White\nborrowers continued to be much more likely to use nonconventional loans insured\nby Federal Housing Administration (FHA) or a guarantee from the Department of\nVeterans Affairs (VA), the Farm Service Agency (FSA), or the Rural Housing\nService (RHS) than other racial and ethnic groups.\u201d<\/em><\/p>\n\n\n\n<p>Why are these nonconventional loans particularly\nsought-after in minority communities? Why are conventional loans less likely to\nbe available? What underlies the loan approval obstacles? <\/p>\n\n\n\n<p>For one thing, the problem of race-based <a href=\"https:\/\/www.deeds.com\/articles\/is-a-hurtful-deed-restriction-lurking-in-your-deed\/\">restrictive\ncovenants<\/a> lingers \u2014 as does the long-tail effect these clauses have\nhad across the country. In addition, fair housing advocates say government\nregulators and banks cling to assumptions and methods that should be changed to\ncreate a fairer playing field. For one thing, they believe housing applicants\nshould be able to offer a different fact set for credit scoring. For example, an\napplicant\u2019s good history of paying rent should make a difference. Credit scoring\ncompanies usually don\u2019t account for rental payments, which are the main\nfinancial obligations of most Black U.S. residents. <\/p>\n\n\n\n<p>Then again, could offering more fact sets create new sets of biases? Expect to see a lot of debate and study on this issue in the years ahead. One study, <a href=\"https:\/\/www.nber.org\/papers\/w25943\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Consumer Lending Discrimination in the FinTech Era<\/a>,\u00a0finds reason for hope. Here are its two key findings, in the researchers\u2019 own words:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>\u201cWe find that lenders charge\nLatinx\/African-American borrowers 7.9 and 3.6 basis points more for purchase\nand refinance mortgages respectively, costing them $765M in aggregate per year\nin extra interest.\u201d <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>\u201cFinTech algorithms also discriminate, but 40%\nless than face-to-face lenders.\u201d<\/li><\/ul>\n\n\n\n<p>In short: traditional lending is apt to discriminate, and\ndiscrimination takes a heavy financial toll. Digital lending might be able to\nhelp even things out. Additionally, the researchers point out, online platforms\nmight be boosting competition, and their user-friendly style could be inspiring\nmore people to think about buying, and to go ahead and apply for a home loan. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Unwelcome Practices: Taking Advantage of the Contract for Deed<\/h2>\n\n\n\n<p>Another major issue on our radar screen is the unfair use of\nthe contract for deed. When used fairly, <a href=\"https:\/\/www.deeds.com\/articles\/what-is-a-contract-for-deed\/\">contract-for-deed\narrangements<\/a> create options for people who might not otherwise be\nable to own a home. Used unfairly, these rent-to-own style agreements arguably\nviolate the Fair Housing Act and other anti-discrimination provisions.<\/p>\n\n\n\n<p>In communities that have suffered most in recessions, where people\u2019s credit ratings have been battered, many residents are being offered contract-for-deed deals. They\u2019re agreeing to these offers when they feel unable to get homes in any other way. Harbour Portfolio is one of the companies purporting to sell houses in low-income areas with contract for deed agreements. A legal aid group, the Atlanta Legal Aid Society, helped bring a legal action claiming Harbour has dealt in <a href=\"https:\/\/www.theatlantic.com\/business\/archive\/2018\/04\/rent-to-own-redlining\/557588\/\">predato<\/a><a href=\"https:\/\/www.theatlantic.com\/business\/archive\/2018\/04\/rent-to-own-redlining\/557588\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"ry loans \u2014 a charge the corporation, while charging interest rates of around 10% (opens in a new tab)\">ry loans \u2014 a charge the corporation, while charging interest rates of around 10%<\/a>, denied. The issues presented to the court were:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The real estate company buys distressed homes and\ninvests no money into renovations. <\/li><li>The new occupants are expected to fix the\nhouses, insure them, and pay the tax bills. <\/li><li>These same occupants can face eviction if they\nfall behind even a month in their payments. <\/li><li>Most of the hopeful homeowners were not expected\nto receive their deeds. Most would never obtain homeownership; they\u2019d be\nevicted first. &nbsp;<\/li><\/ul>\n\n\n\n<p>The <a href=\"https:\/\/www.consumerfinance.gov\/about-us\/newsroom\/cfpb-settles-companies-engaging-deceptive-acts-practices-violating-credit-reporting-rules\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Consumer Financial Protection Act<\/a> also comes into play when companies use misleading and harmful practices. In June 2020, the Consumer Financial Protection Bureau settled for $35,000 with Harbour for violating the Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Closing the Gap: Can Mortgage Tech\nStep Up?<\/h2>\n\n\n\n<p>Practices like the\nabove-described misuse of the contract for deed must end if we\u2019re serious about\nclosing the U.S. homeownership gap. Justice-minded legal aid groups are doing\ntheir best. At the same time, what\u2019s needed is more opportunity, so people\naren\u2019t constantly driven into bad deals for lack of options.<\/p>\n\n\n\n<p>And the need is critical. Fifty years after we got the Fair Housing Act, the rate of <a href=\"https:\/\/www.urban.org\/urban-wire\/breaking-down-black-white-homeownership-gap\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Black homeownership is still under 50%<\/a>, whereas the white homeownership rate is above 72%. In the midst of a global conversation about racial fairness, mortgage companies have a major role to play.
