But it carries higher\nassurances than a quitclaim \u2014 which doesn\u2019t declare a property free and clear\nof <a href=\"https:\/\/www.deeds.com\/articles\/category\/liens\/\">liens<\/a>&nbsp;or&nbsp;other\nissues. A&nbsp;special warranty deed&nbsp;tells us that the party conveying it\nhas the right to do so, and that any known burdens on the title are obvious on\nthe deed. There is no guarantee against any title defects dating from earlier\nowners, though.<\/p>\n\n\n\n<p>Limited warranty deeds, also called special warranty deeds,\nare uncommon in standard home purchase agreements. But they are frequently\nchosen for transferring title when a general warranty deed is too risky for a\nseller to offer, or simply inappropriate for the transfer. <\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Standard Practice: Where Limited Warranty Deeds Are the Norm <\/h2>\n\n\n\n<p>Limited warranty deeds commonly appear in certain\nsituations. These are just a few of them:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>In\nprobate court, to transfer a home out of an estate. This is normal, especially\nwhen the personal representative is unfamiliar with the property. In this\nsituation, the personal representative is promising that nothing has been done\nto compromise the title during the probate period, but stops short of\nguaranteeing the chain of title before that.<\/li><li>In\nshort sales, tax sales, and foreclosed or real-estate-owned (REO) properties,\nwhich are more likely than other homes to carry unknown title issues and debt\nbaggage. The title holder only guarantees the title to prospective buyers for\nthe period it held that title. The buyer receives no warranty for the\nproperty\u2019s earlier title history.&nbsp;<\/li><li>In\ncommercial real estate deals, as the properties can frequently change hands,\npotentially passing along old claims and debts. Grantors of a limited\nwarranty deed only assure a good, clean title for the time period they had\ncontrol over it.<\/li><li>In\ntransactions involving HUD or Fannie Mae, or other parties that use limited\nwarranty deeds routinely. Here again, these parties do so because they want to\nrestrict the risk of title defect problems to the period of time when\nthey actually held the title.<\/li><\/ul>\n\n\n\n<p>In some places, the limited\nwarranty deed and its words \u201cspecially warrant\u201d have been dropped because <em>special<\/em>\ncould sound more protective than <em>general.<\/em> Maine, for example, previously\nhad special warranty deeds but renamed them <em>quitclaim deeds with covenants\nof warranty<\/em>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Temporary Title Holders: Using the Limited Warranty Deed to Place a Home\nInto a Trust<\/h2>\n\n\n\n<p>When fiduciaries or trustees hold titles on behalf of\nbeneficiaries, special warranty deeds are common. So, this type of deed may be\nappropriately used by private owners who put their homes into trusts. <\/p>\n\n\n\n<p>With the trusts as with other transfers, the deed must\nfollow procedures for being signed, acknowledged, and recorded at the county\nrecorder\u2019s office. The recording of a Statement of Authority may be required (such\nas <a href=\"https:\/\/www.deeds.com\/forms\/colorado\/statement-of-authority\/\">this\nexample, for Colorado<\/a>) together with the conveyance to the trust,\nexecuted by the trustee.&nbsp; <\/p>\n\n\n\n<p>A benefit of the warranty deed \u2014 either general or limited \u2014\nin the trust situation? It does not disturb the title insurance policy.<\/p>\n\n\n\n<p>\u200bLimited Warranty Deeds in Property Sales: What Buyers Should\nKnow<\/p>\n\n\n\n<p>You may be asked to sign a purchase agreement that says a\nlimited warranty deed will convey the title. If so, it means no liens or\nencumbrances exist&nbsp;that aren\u2019t obvious on the deed. This means you won\u2019t face\nunexpected deed problems, boundary disputes, unstated&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/the-real-estate-easement-a-guide-and-glossary\/#more-712\">easements<\/a>,\nprior claims, liens or other problems arising on account of the party conveying\nthe property (called the <em>grantor<\/em>). it\u2019s the grantor\u2019s obligation to stand\nbehind the promises made on the deed, and to remediate any title claims\nincurred on the grantor\u2019s watch. In other words, the buyer is covered for any\ntitle problems caused by the grantor\u2019s own actions or omissions.<\/p>\n\n\n\n<p>But a limited warranty deed could come along with issues\ndating back before the grantor held the title. What kinds of old claims can\nhaunt a title? Some, like <a href=\"https:\/\/www.deeds.com\/articles\/the-tax-lien-cometh\/\">unpaid property\ntaxes in the chain of title<\/a>, involve governments. Local code\nviolations could have resulted in liens. Unless the applicable title insurance\nextends back to cover the claim against an earlier owner, or a statute of\nlimitations has kicked in, the new owner might have no choice but to resolve\nthe old debts or fines.<\/p>\n\n\n\n<p><strong><em>Pro tip:<\/em><\/strong> Each state, as well as the federal\ngovernment, has its tax lien laws and limitations. The&nbsp;<a href=\"https:\/\/www.taxadmin.org\/state-tax-agencies\" target=\"_blank\" rel=\"noreferrer noopener\">state tax agencies<\/a>&nbsp;can provide specifics. The home\u2019s\ncounty recorder keeps track of existing liens and releases.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Claims Against the Title: The Role of Insurance for Buyers<\/h2>\n\n\n\n<p>Recipients of special warranty deeds should check with a\ntitle company early in the process to be sure the property can be covered. The\nbest title insurance policy is one from a major underwriter that will withstand\nthe test of time.<\/p>\n\n\n\n<p>The mortgage lender will have the borrower pay for lender\u2019s\ninsurance, but the buyer also needs to be the beneficiary of a policy. This is\nachieved by purchasing an <a href=\"https:\/\/www.deeds.com\/articles\/home-buyers-cover-your-assets-choosing-between-standard-and-extended-title-insurance\/\">owner\u2019s\ntitle insurance policy<\/a>, and knowing what it covers. For best\nassurances, buyers should have their own title attorneys run title searches, and&nbsp;purchase\nowner&#8217;s title insurance at closing. <\/p>\n\n\n\n<p>If a claim on the title arises from an interaction during the\ngrantor\u2019s time of ownership, the buyer then has access to remedies from the\ntitle insurer (and the grantor, if the insurer goes after the grantor). If the\nproblem stems from an earlier link in the chain of title, the buyer will still go\nto the title insurer to cover the lost value.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Nuts and Bolts:\nCreating a Limited Warranty Deed<\/h2>\n\n\n\n<p>Each county has requirements for the correct completion of\nthe limited warranty deed within its state. A completed limited warranty deed\ncontains: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The\nname and address for the seller (grantor) and the purchaser (grantee).<\/li><li>The\nproperty\u2019s location and full legal description, matching the legal description\non the existing deed.<\/li><li>A\nstatement that the grantor owns and has the legal right and intention to\nconvey the property to the named grantee (the standard granting clause reads: \u201cGrantor\nremises, releases, alienates, and conveys\u201d).<\/li><li>A\nguarantee that no debts attached to the property when the grantor held the\ntitle. Any encumbrances must be expressly noted on the deed. <\/li><\/ul>\n\n\n\n<p>An effective deed is signed, acknowledged, and recorded. The\ncorrect deed, with the correct language, is absolutely essential. For example,\nunder Ohio law (compliant and continually updated <a href=\"https:\/\/www.deeds.com\/forms\/ohio\/special-warranty-deed\/\">Ohio special\nwarranty deeds for all counties are available here<\/a>), the deed must\nbe signed by the grantor. It must be acknowledged by the grantor in front of a\nnotary public or person authorized to certify and sign the acknowledgment. The\nconveyance fee or exemption form must accompany the deed. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Going Forward: Best\nPractices<\/h2>\n\n\n\n<p>A limited or special warranty deed is like a general\nwarranty deed, with one key difference: it doesn\u2019t guarantee the whole chain of\ntitle. For a standard home purchase, a general warranty offers fuller\nprotections. But a special warranty is the norm in certain situations and\nplaces. And even a general warranty carries risks, as chains of title can be\nlong and complex, with various deeds in play before the deed the current buyer\nacquires. Look to title insurance to cover potential title issues for any deed.\n<\/p>\n\n\n\n<p>Best practices when accepting a limited warranty deed are\nstraightforward. Work with a professional real estate agent. Have a title\nsearch done. Get an owner\u2019s title insurance policy at closing.
