This\nmight come into play when: <\/p>\n\n\n\n<p>(1) A <a href=\"https:\/\/www.deeds.com\/articles\/what-is-a-deed-of-trust\/\">deed of trust<\/a>\ncomes off the title and the homeowner now owns the house free and clear. <\/p>\n\n\n\n<p>(2) Or it could refer to clearing a\ntitle of an obsolete restriction. <\/p>\n\n\n\n<p>(3) It could also refer to the deed\nof release or <em>fiduciary deed<\/em> in Massachusetts.<\/p>\n\n\n\n<p>In this article, we take a look at all three scenarios, and\nwhat homeowners should know about them.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Part One: Releasing a Deed of Trust<\/h2>\n\n\n\n<p>In some states it\u2019s common practice to use a deed of trust in\nplace of a mortgage. The deed of trust sets forth the loan\u2019s terms. If the\nborrower defaults on the loan, the deed of trust enables the trustee to sell\nthe house without having to go through a full-blown judicial foreclosure\nprocess. <\/p>\n\n\n\n<p>So, in contrast to a&nbsp;straight mortgage agreement that only\ninvolves a lender and a borrower, with the deed of trust, a <a href=\"https:\/\/www.deeds.com\/articles\/property-title-deed-whats-the-difference\/#:~:text=Title%20refers%20to%20ownership%2C%20including,property%20to%20the%20other%20party.\">trustee\nholds the house title<\/a> as collateral until the borrower fully prepays\nthe debt, or makes the final loan payoff. After the very last payment, a <em>full\ndeed of release<\/em> is used to take the lien off the borrower\u2019s home. The lender\ntransfers (grants) the title&nbsp;to the owner (grantee) through a deed of\nreconveyance, also recorded to enter the home\u2019s chain of title. (If the\nhomeowner is refinancing the home, the first loan is similarly released upon\npayoff.)<\/p>\n\n\n\n<p>The lender\u2019s attorney has the documents signed, notarized,\nand recorded, thus removing the deed of trust (lien), in the county where the\nhouse is situated. Release and full title, as well as any funds left over in\nthe escrow account, are conveyed to the homeowner, who now owns the home free\nand clear. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Title Status Checklist &nbsp;<\/h3>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/01\/deed-of-release-end-1024x684.jpg\" alt=\"Image of two colorful doors on a house.\" class=\"wp-image-1189\" width=\"512\" height=\"342\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/01\/deed-of-release-end-1024x684.jpg 1024w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/01\/deed-of-release-end-300x200.jpg 300w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/01\/deed-of-release-end-768x513.jpg 768w\" sizes=\"auto, (max-width: 512px) 100vw, 512px\" \/><\/figure><\/div>\n\n\n\n<p>For the owner who pays off a straight mortgage, after payoff\nthe lender records a release of the mortgage. After making the last payment, a\nhomeowner should expect the lender to release the mortgage lien and send a copy\nof the payoff statement to the borrower within about a month. The mortgage\nservicer can offer a timeline so a borrower will know when to expect important\npayoff documents, including the final statement, evidencing the full and final\npayoff. (The mortgage servicer\u2019s contact information is on the monthly\nstatements or the site through which the borrower pays.)<\/p>\n\n\n\n<p>For an owner who signed a deed of trust, the lender records\na deed of release. <\/p>\n\n\n\n<p>In either case the borrower should check to see that the lender\nhas filed proof of the final payoff and release in the property\u2019s county.\nOtherwise, the borrower may need to file it. And once the release is file in\nthe public record, it is a good idea for a borrower to call the title company and\nother insurers to double-check that the companies show the home\u2019s title cleared\nof the lien. <\/p>\n\n\n\n<p>The final loan documents are important papers that should be\ncarefully <a href=\"https:\/\/www.deeds.com\/articles\/new-homeowners-document-checklist-storage-plan\/\">stored\nwith home-related documents<\/a>, so the homeowner is prepared when the\ntime comes to sell or convey the home to its next owner.<\/p>\n\n\n\n<p><strong>\u261b<\/strong><strong> <\/strong><strong>Read more on <em>Deeds.com<\/em>\nabout the steps to take <a href=\"https:\/\/www.deeds.com\/articles\/youve-paid-off-the-mortgage-what-happens-now\/\">after your mortgage payoff<\/a>.<\/strong><\/p>\n\n\n\n<p>Homeowners can always visit their county recorder of deeds\u2019\noffices to obtain copies of filings associated with the property. Additionally,\nat any stage, a homeowner should be able to look through the county records\nonline for any transactions, claims, and restrictions affecting the property \u2014\nand the surrounding homes. <\/p>\n\n\n\n<p>Checking the county records is a good habit. It enables the\nowner to find anything that looks out of place, be sure releases are accounted\nfor, and know that property taxes are up to date, now that the owner is paying\nthem directly instead of through the mortgage escrow account.<\/p>\n\n\n\n<p><strong><em>Pro tip:<\/em><\/strong> &nbsp;Some people have attempted to get released from paid-off mortgages to clear their titles, but find out the mortgage holders went out of business before recording the release. if your lender shut its doors during the financial crisis, contact the FDIC for support in <a href=\"https:\/\/www.fdic.gov\/resources\/resolutions\/bank-failures\/failed-bank-list\/lien\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">obtaining a lien release<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Part Two: Release From Restrictive Covenants<\/h2>\n\n\n\n<p>If you\u2019ve accepted a deed subject to restrictive covenants, those\npublicly recorded restrictions prevent you from doing certain things with your property\n\u2014 displaying signs, perhaps, or doing certain types of business, or even\npainting your door in a certain hue. And unless a real estate covenant has a\nstated end date, it runs with the land. In other words, it lasts indefinitely,\nbinding every future owner.<\/p>\n\n\n\n<p>Typical examples of restrictive covenants include the Covenants,\nConditions and Restrictions (CC&amp;Rs) issued to condo buyers. The usual justification\nfor the restrictions involves preservation of surrounding property values,\ncommunity aesthetics, or the historic value of the buildings. <\/p>\n\n\n\n<p>Some owners go to court to challenge restrictive covenants\nthat become oppressive, that are routinely violated by many properties without\nenforcement, or that become otherwise obsolete. Thus, if a <em><a href=\"https:\/\/www.deeds.com\/articles\/zeroing-in-the-subject-to-clause-in-your-real-estate-deed\/\">subject-to<\/a><\/em>\nclause is unduly burdensome or if it\u2019s hard to understand or follow, the owner\nmight decide to seek a release of restrictions in the deed. <\/p>\n\n\n\n<p>In some situations, adjacent homeowners or others who might\nbe able to enforce the deed restrictions assist by supplying signed releases. A\n<em>release addendum<\/em> might subsequently be recorded with the deed, under the\ncounty\u2019s rules for such documents. <\/p>\n\n\n\n<p>The most effective document is a notarized <em>termination and\nrelease<\/em> of a restrictive covenant. A typical example affirms that the\ncounty does not require the covenant, that the homeowner seeks a release, and\nthat the county has agreed to it. The document should also set forth the issues\nthat make the restriction obsolete. Unreasonable, ambiguous, illegal, or <a href=\"https:\/\/www.deeds.com\/articles\/is-a-hurtful-deed-restriction-lurking-in-your-deed\/\">unconstitutional\ndeed restrictions<\/a>&nbsp;are unenforceable.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Part Three: The Massachusetts Release Deed <\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/01\/deed-of-release-mid-1.jpg\" alt=\"Close up image of two hands embraced in front of a house.\" class=\"wp-image-1190\" width=\"320\" height=\"213\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/01\/deed-of-release-mid-1.jpg 640w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/01\/deed-of-release-mid-1-300x200.jpg 300w\" sizes=\"auto, (max-width: 320px) 100vw, 320px\" \/><\/figure><\/div>\n\n\n\n<p>If you\u2019re in Massachusetts, you might have heard of the <em>fiduciary\ndeed<\/em> or <em>release deed.<\/em> This is the third of three common Massachusetts\nreal estate deeds. The first two, you might have guessed, are the <em>warranty\ndeed<\/em> and the <em>quitclaim<\/em>. <\/p>\n\n\n\n<p>The release deed works in the right circumstances to\nrelinquish a possible interest in the property. That\u2019s all. A <a href=\"https:\/\/www.deeds.com\/articles\/buying-property-with-a-quitclaim-deed-in-massachusetts\/\">Massachusetts\nrelease deed<\/a> does not offer any guarantees. It does not even assert\nthat its grantor holds any valid interest in the property. It simply\nrelinquishes the title or whatever claim the grantor releases on the deed. In\nthis way, it can clear up clouds or ambiguities on a title, and the property can\nbe insured.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Whatever Form It Takes\u2026<\/h2>\n\n\n\n<p>And whatever its purpose or locations, a deed of release has\none goal: to release past obligations. The forms and requirements for deeds of\nrelease are state-specific, though, and the procedures to follow can vary\nwidely among counties.
