It\u2019s a fast, simple, and reasonable way to transfer home ownership. It\u2019s a good choice in certain situations. What are those certain situations? <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In contrast to warranty deeds, which are most often used in\nregular home sales, a quitclaim would more likely be used:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Among family members.<\/strong> In this case, when the parties know the history of the property and no title insurance policy is issued, quitclaiming can be done either with or without expert help.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>In a divorce.<\/strong> A decree stating that one ex-spouse will keep the home doesn\u2019t actually transfer a home. Yet transferring ownership to an ex is easily done by quitclaim.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>To clear up confusion about ownership, including name changes.<\/strong> Quitclaiming to clarify ownership can be achieved without expert help, but it\u2019s often requested by a title insurer.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>In a sale of a bank-owned house.<\/strong> If it will be the buyer\u2019s responsibility to make the title good, a quitclaim can be used in an REO&nbsp;auction. &nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>To place a home into an LLC.<\/strong> Some investor owners decide to transfer properties into an LLC. A quitclaim deed is one way to do this.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Quitclaiming is a simple, because it can transfer ownership\nof real estate without the need to examine current ownership or the chain of\ntitle. Historically, the quitclaim has long been the go-to method of\ntransferring property while avoiding bureaucracy. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In that spirit, without further ado, here\u2019s more on five top\nreasons homeowners decide to use quitclaim deeds. <\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">1.&nbsp;&nbsp;\nQuitclaiming Property Among Family Members<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"497\" height=\"332\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/03\/top-5-reasons-for-using-a-quitclaim-deed.jpg\" alt=\"Image of the outside of a house in a wooded setting, Captioned: Top 5 Reasons for Using a Quitclaim Deed.\" class=\"wp-image-1301\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/03\/top-5-reasons-for-using-a-quitclaim-deed.jpg 497w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/03\/top-5-reasons-for-using-a-quitclaim-deed-300x200.jpg 300w\" sizes=\"auto, (max-width: 497px) 100vw, 497px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Quitclaim deeds may be used for\nconveying property within families. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You may want to quitclaim a home to a relative for a price less than the property\u2019s market value. There\u2019s a gift tax question to anticipate here, because gift taxes are due for any \u201cgift\u201d value transferred (the value not paid for). The homeowner can make untaxed gifts up to the annual exclusion (that\u2019s up to $15,000 in 2021), but the transfer may need to be reported, so it\u2019s a good idea to speak with your accountant if you plan to use a quitclaim this way. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Note:<\/em><\/strong> <a href=\"https:\/\/www.deeds.com\/articles\/the-life-estate-deed\/\">If you continue to live in the house<\/a>, the IRS will probably <em>not<\/em> consider any part of the value a gift. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sometimes families quitclaim their\nhomes into trusts. They might do this to let the home bypass probate after they\npass away, or to reduce the risk of losing assets to debt collectors. It\u2019s best\nto do this with a house that\u2019s owned free and clear. Refinancing a home in a\ntrust can get complicated. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That said, even a mortgaged home\ncan be quickly placed into a trust by using a quitclaim from the name of the\ncurrent owner(s) to the name of the trust, then recording the deed with the\ncounty. State law might direct the mortgage to be passed to the beneficiary\nwhen the home title is passed. Or, the trust language might require a home loan\npayoff before the title passes to the beneficiary. But the lender\u2019s <em>due on sale<\/em>\nclause is not triggered when the title to residential real estate of less than\nfive units is conveyed to a living trust, thanks to the Garn-St. Germain Act,\nif the mortgage borrower is a trust beneficiary and isn\u2019t transferring the\nright of occupancy. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Pro tip:<\/em><\/strong> Alert the insurance\ncompany before making title changes so the policy can be updated if necessary.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2.&nbsp;&nbsp;\nQuitclaiming Property Between Co-Owners<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright\"><img loading=\"lazy\" decoding=\"async\" width=\"547\" height=\"365\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/03\/quitclaiming-property-between-co-owners.jpg\" alt=\"Image of two people in a house during a divorce situation. The court order might say who gets the house, but\nby itself it does not transfer the home. Yet transferring a property interest to\nan ex can easily be handled by&nbsp;quitclaiming.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Note that the mortgage is a separate\nmatter. So, one spouse may quitclaim the property to the other, but this does\nnot remove either spouse\u2019s name from the mortgage and the responsibility to pay\nit. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If both divorcing spouses are\nnamed as co-borrowers, both are still responsible for the mortgage \u2014 even after\none quitclaims their interest in the home. The only way to change this is through\na lender\u2019s agreement that the person who remains in the house may assume the\nloan, individually, going forward. It\u2019s more likely that a sale or refinancing\nwill be necessary to get the absent ex-spouse off the home\u2019s mortgage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Work out the mortgage funding plan\nwith your divorce lawyer before signing a quitclaim. In this way, the legal\nagreement between the ex-spouses will not be a cause for major issues over the\nmortgage in the future. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Pro tip:<\/em><\/strong> Consider\ntaxes before drafting or accepting a quitclaim. Either or both sides may be\nresponsible for the transfer tax bill under state law. And if a sale legally\noccurred through the quitclaim transfer, the seller may owe capital gains\ntax.&nbsp;The question of whether homestead tax breaks are kept after the\ntransfer should also be examined.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3.&nbsp;&nbsp;\nUsing a Quitclaim Deed for a Name Change or Otherwise Clarify\nOwnership<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A quitclaim can change your name\non your deed. Your previous name will appear as grantor, and your new name will\nbe the grantee (recipient) of the property interest. Once you file your\nquitclaim with the county clerk or recorder of deeds, title searches will bring\nup your new name. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Note these sensible preliminary\nsteps to take:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Check with your title company for <em>Formerly\nKnown As <\/em>forms before proceeding with the quitclaim. <\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Speak with your county recorder of deeds in\nadvance to ensure that you will not need to pay transfer taxes when the title\nis changed.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Call your mortgage specialist if you have a home\nloan and let them know a quitclaim will be filed. Be sure it won\u2019t trigger a<em>\ndue on sale <\/em>clause and make the whole loan come due. You need to be sure\nit\u2019s clear you\u2019re quitclaiming only to clarify ownership. <\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If there is some question about someone\nelse possibly having an ownership right in a home, that person can sign a\nquitclaim deed to declare no interest. A title company might request this to\nclear up ambiguity in the chain of title. In some cases, title companies will need\nto pay other parties to quitclaim potential interests in a property for sale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then, the buyer will be able to\ntake free and clear title. Additionally, the company can then insure the\nproperty.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4.&nbsp;&nbsp;\nQuitclaiming a Bank-Owned House to a New Owner<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">What about REO\u00a0auctions? In some sales, the buyer is responsible for the title. Lenders selling foreclosed homes do not want to be sued, and may avoid making any promises about a property or its title. And there are states, such as <a href=\"https:\/\/www.deeds.com\/articles\/buying-property-with-a-quitclaim-deed-in-massachusetts\/\">Massachusetts<\/a> and <a href=\"https:\/\/www.deeds.com\/forms\/rhode-island\/quitclaim-deed\/\">Rhode Island<\/a>, in which a quitclaim is not an unusual deed for property sales. For these reasons and others, it\u2019s possible to encounter a foreclosed home being offered through a quitclaim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nevertheless, before accepting a\nquitclaim deed for a bank-owned home, buyers should carry out due diligence and\nwork with experienced closing agents. Because the buyer of a bank-owned home\nmay have to use the lender\u2019s selected title company, it also makes sense to\nhire a local real estate lawyer to make sure good title is conveyed. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Why do we emphasize the value of\nexpert assistance? A quitclaim, you\u2019ll recall,&nbsp;legally transfers only the\ngrantor\u2019s ownership interest, without further promises. Even if that\u2019s a\nfraction of the whole ownership. Or none. It might seem strange to think anyone\nis conveying zero value to a buyer through a quitclaim, but it happens.\nExample: The former owner might have owed back taxes, the government might have\ndibs on the property, and the recipient of a quitclaim deed might receive no\nactual value.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">5.&nbsp;&nbsp;\nQuitclaiming Property to an LLC<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Quitclaims in most states do not\ndeclare that the grantor (the person offering the deed) has an interest in or a\nright to transfer the property. They don\u2019t promise that the property is free\nfrom tax liens, mortgage liens, or other burdens that could be left as clouds\non the new owner\u2019s title.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those assurances are integral to\nthe warranty deed, but are usually<em> not<\/em> integral to the quitclaim.\nQuitclaims are used when no warranty is needed or expected. For example, a\nproperty owner needs no guarantee of ownership when transferring the title into\nthe owner\u2019s company.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Owners who wish to quitclaim real\nestate into an LLC are reminded that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Advice from a tax expert is helpful so the\ntransfer avoids creating a taxable event. <\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>This type of transfer can nullify the owner\u2019s\ntitle insurance. <\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A lack of title guarantees could be an issue if the\nowner plans to sell the business one day. <\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Pro tip:<\/em><\/strong> Transferring a title to a condo or\nco-op? For a valid transfer, the owner must adhere to the rules of the homeowners\u2019\nassociation, its by-laws and restrictions. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Homeowners Have the Right to Quitclaim Their Property<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Homeowners may transfer their ownership.
