So, if you are an\nexecutor or a beneficiary who expects to sell real property from an estate, here\nare the steps to take, and tips to help you prepare.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Selling Through the Probate Court<\/h2>\n\n\n\n<p>To follow the will or satisfy debts, real estate might need\nto be sold. The beneficiary could want the house to be sold during probate, and\nnever take title. This way the estate itself conveys the house to a buyer. <\/p>\n\n\n\n<p>Sale proceeds satisfy the estate\u2019s debts. When creditors are\nduly satisfied, and the fees and taxes are paid, the remainder of the proceeds\ncan be distributed to the beneficiaries. If one wishes to sell and another objects, for\nexample, the court might need to step in. Sometimes there is no possible\nresolution except a <em>partition action<\/em>, by which the court orders a sale.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Step 2. Petition the Probate Court to Sell the House. <\/h3>\n\n\n\n<p>Start off by getting a current value on the house. The tax\nassessment is usually lower than the actual value of the home. The current bid will be stated in court, and others may submit\nhigher bids as instructed by the judge. Anyone planning to make a bid must be\nprepared to offer a cashier\u2019s check. Check with a professional to be absolutely\nsure the check is properly made out to the estate, for a deposit of 10%+ of the\nbid. <\/p>\n\n\n\n<p>The terms of the sale and the comparable properties\u2019 values\nshould be reviewed in advance. Passing a home on through your will means your heirs get a&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/homeowner-estate-planning-real-estate-tips\/\">break on capital gains tax<\/a>.\nIf you <a href=\"https:\/\/www.deeds.com\/articles\/transferring-a-deed-without-a-lawyer-heres-what-you-should-know\/\">transfer a\ndeed without a lawyer, here\u2019s what you need to know<\/a><\/em><\/strong><strong><em>. <\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A Few Words on Selling After Inheriting<\/h2>\n\n\n\n<p>If the homeowner is not survived by a co-owner with\nsurvivorship rights, and there is no valid <em><a href=\"https:\/\/www.deeds.com\/articles\/update-the-state-of-the-transfer-on-death-deed\/#:~:text=The%20transfer%20on%20death%20deed%2C%20where%20available%2C%20lets%20a%20homeowner,one%20owner%20to%20the%20next.\">transfer\non death deed<\/a><\/em>, then the home will be transferred as directed by\nthe deceased owner\u2019s will. Be prepared to pay the taxes and\ninsurance premiums.<\/p>\n\n\n\n<p>Of course, you can always sell later. The timing of that decision\nis the key in tax planning.<\/p>\n\n\n\n<p>Consider an example. You inherit a home valued at $300,000.\nLater, you decide to sell it for $330,000. You must pay capital gains tax, but\nonly on the $30,000 gain. (This is a good thing, as you needn\u2019t worry about the\nprofits that the deceased person would have realized. Inherited homes come with\na <em>stepped-up tax basis <\/em>\u2014 the fair-market value of the property upon the\nprior\u2019s owner\u2019s death.) The tax rate would equate to income tax if you sell within\na year. You get the benefit of the long-term capital gains tax rates if you\nhold the property more than a year.<\/p>\n\n\n\n<p>Best of all, if you decide to treat the home as a primary\nresidence for <em>two<\/em> (out of five) years before selling, you can exclude up\nto $250,000 of your profit ($500,000 for couples filing jointly) from the\ncapital gains tax. Another benefit of living in the home? Keeping the homestead\nproperty tax break.
