Across the\nUnited States, official-looking letters are convincing homeowners to pay for\ndocuments to certify the obvious \u2014 that they own their homes. Homeowners who\nsend payments in response to these letters are not receiving the documents for\nwhich they paid.<\/p>\n\n\n\n<p>Those most likely to fall prey to this scheme are recent and\nfirst-time home buyers, and the older generation. New homeowners are swamped\nwith paperwork and offers. They can mistake solicitations for legitimate bills.\nAnd older people may be impaired, or simply less able to do research on this\ntype of activity. Some of the solicitations are addressed to the names of the <a href=\"https:\/\/www.deeds.com\/articles\/holding-real-estate-in-a-trust-or-an-llc\/\">living\ntrusts<\/a> of older homeowners. Survivors of recently deceased\nhomeowners are getting the notices, too.<\/p>\n\n\n\n<p>Some recipients might be startled by the letters, thinking\nthat someone is attempting to steal their deeds. Others might simply pay the\namount without much thought, because the total sum requested is under $100. <\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">New Emergence of the Infamous Deed Notice Letter<\/h2>\n\n\n\n<p>In April 2021, a letter is making the rounds from an entity\nnamed Records Recovery Services, billing homeowners $87 for copies of their\ndeeds as verification of ownership. Records Recovery Services is not traceable to\na registered company; it\u2019s just a P.O. box. It has sent letters in\nofficial-looking envelopes to addresses across the country. <\/p>\n\n\n\n<p><strong>Multiple recording offices are warning homeowners<em> not<\/em> to pay Records Recovery Services.<\/strong> They remind homeowners that copies of deeds are always available from their county Recorder of Deeds. If there is a fee to obtain a copy, it usually runs no more than a few dollars for the full document. For example, in <a href=\"https:\/\/www.ag.state.mn.us\/consumer\/Publications\/RealEstateDeedSolicitation.asp\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Minnesota<\/a>, the cost for a copy of your house deed runs about $1 per page. If a certified copy is needed, the charge is typically $10 per document, depending on the specific county\u2019s fee schedule.<\/p>\n\n\n\n<p><strong><em>\u261b<\/em><\/strong><strong><em>\nAlways know how to locate proof of your homeownership yourself.&nbsp;See more\nabout <a href=\"https:\/\/www.deeds.com\/copy-of-your-deed\/\">Getting\na Copy of Your Real Estate Deed<\/a>. <\/em><\/strong><\/p>\n\n\n\n<p>Wherever you live, if you have misplaced your original house\ndeed, you can order a certified copy from your own county Recorder of Deeds. A\ncertified copy of your house deed has the same weight and effect as the original\ndeed. To respond to a legitimate request for a copy of your house deed, ask if\na certified copy is required. In some cases, a simple copy of the deed is\nenough.<\/p>\n\n\n\n<p>Additionally, homeowners in many counties can simply review and\nobtain their property information using the local Recorder of Deeds website. And\nthey can call the office to get reliable information about requests for deed\ninformation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Everything Old Is New Again: This Scheme Has Been Around for a Decade<\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/04\/this-scheme-has-been-around-for-a-decade.jpg\" alt=\"Image of a person studying a legal document.\" class=\"wp-image-1375\" width=\"300\" height=\"401\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/04\/this-scheme-has-been-around-for-a-decade.jpg 400w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/04\/this-scheme-has-been-around-for-a-decade-225x300.jpg 225w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/figure><\/div>\n\n\n\n<p>Deed notice scam letters have been making the rounds throughout the pandemic. One version of the letter targeted residents of <a href=\"https:\/\/www.thereporteronline.com\/news\/deed-scam-targets-montgomery-county-homeowners\/article_2ac789f6-f3a3-11ea-8570-97b97ff3858b.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Montgomery County, Pennsylvania<\/a> in late 2020, asking for $95. Fees near $100 are also being requested in Minnesota and elsewhere.<\/p>\n\n\n\n<p>This round of deceptive mailings picks up a scheme that emerged years ago. Back in 2012, as reported by <a href=\"https:\/\/www.tn-elderlaw.com\/free-resources\/blog\/august-2019\/deed-scam-resurfaces\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Takacs McGinnis Elder Care Law<\/a> of Tennessee, a series of letters came from the so-called Record Retrieval Department of Nashville. After that, letters started making the rounds from state to state. They came from entities called Records Transfer Service, Local Records Office, and Secured Documents Services.<\/p>\n\n\n\n<p>Similar scam letters bill their recipients a so-called service\nfee of $82 to $86 for a property assessment profile and a copy of a deed. Sent\nby Property Profile, Inc., of Glendora, California, the letters carry the heading\nRECORDED DEED NOTICE over a scanner code. They include real property\nidentification numbers and they announce deadlines for payments. <\/p>\n\n\n\n<p>In 2019, in California, the Randolph County Register of Deeds distributed a warning. Daily, residents were getting letters from Property Profile, Inc. soliciting payments from homeowners for copies of their deeds. Another version of the <a href=\"https:\/\/www.latimes.com\/business\/story\/2019-11-12\/property-records-deed-letter\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">California deed notice letter<\/a> demands $89 and comes with a serious-sounding notice: &#8220;$2,000 fine, 5 years imprisonment or both\u201d for impeding the delivery of the notice. (The delivery of<em> all<\/em> mail is protected by law.) \u00a0<\/p>\n\n\n\n<p>In short, the deed notice scheme is as rampant as it is\nmanipulative. And it\u2019s still going on, despite efforts by the Register of Deeds\nAssociation to ban it. <\/p>\n\n\n\n<p><strong><em>\u261b<\/em><\/strong><strong><em>\nWell-known scams are being rehashed to exploit vulnerabilities created by\nCOVID-19. See more about real estate frauds, and how to steer clear, at <a href=\"https:\/\/www.deeds.com\/articles\/viral-fraud-more-deed-crime-targets-in-the-coronavirus-economy\/\">Viral Fraud: More Deed Crime Targets in the\nCoronavirus Economy<\/a>.<\/em><\/strong><\/p>\n\n\n\n<p>Several state legislatures have managed to at least restrict the advertising copy for these solicitations. <a href=\"https:\/\/codes.ohio.gov\/ohio-revised-code\/section-1345.032\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Ohio<\/a> law, for example, requires such advertisements to include disclaimers \u2014 significantly, in 24-point or larger typeface \u2014 stating the cost of getting a copy of the deed from the county recorder. No entity may never ask for more than four times the fee charged by the county for the same service. Instructions on contacting the county recorder to order a copy of a deed must be set forth in the solicitation letter. <\/p>\n\n\n\n<p>The issuer must further state that it is not a government\nagency. It must inform its Ohio recipients that no law requires them to respond\nto the solicitation. The use of deadline language is prohibited. The actual\npeople behind the solicitation must state their names and physical addresses.\nThey must register with the county recorder of deeds, submitting their proposed\nadvertisements to the county at least 15 days before sending them out. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Got an Unexpected Bill or Solicitation? Ask Questions <\/h2>\n\n\n\n<p>Tell those you know about these notices. Don\u2019t pay them. Consider reporting them to the Federal Trade Commission by calling 1-877-FTC-HELP or using the reporting tool on the <a href=\"http:\/\/ftc.gov\/complaint\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">FTC website<\/a>. The Recorder of Deeds in Jackson County, Missouri has asked recipients to notify the FBI. <\/p>\n\n\n\n<p>Thousands of people lose money in real estate scams every\nyear. According to the Attorney General of Minnesota, it\u2019s important for\nhomeowners to know the circumstances in which they actually need copies of\ntheir deeds. These situations may include mortgage refinancing, sales\ntransactions, or otherwise transferring their home titles. But in each case,\nthe county register of deeds has your back, and so do we.<\/p>\n\n\n\n<p><strong><em>\u261b<\/em><\/strong><strong><em>\nYour original deed is best stored in a secure yet accessible place. To help you\norganize everything you\u2019ll need at some point, here\u2019s your <a href=\"https:\/\/www.deeds.com\/articles\/new-homeowners-document-checklist-storage-plan\/\">New Homeowner\u2019s Document Checklist &amp; Storage\nPlan<\/a>.<\/em><\/strong><\/p>\n\n\n\n<p>Whenever you get an unexpected letter, text, call, or email\nrelated to your home or other assets, trust your suspicions. Avoid clicking\nlinks or returning messages. Do not offer information or money. Research the\nsources before making decisions, and report obvious scams. <\/p>\n\n\n\n<p>Protect yourself and all homeowners by staying alert.
