To get ready quickly, you might wonder if\nyou should put a clause in your contract to announce you\u2019re selling the house <em>as-is<\/em>.\n<\/p>\n\n\n\n<p>A seller may use the term <em>as-is<\/em> to point out that the\nhouse isn\u2019t in pristine condition. The unspoken message? The home is available\nat a discount to those who\u2019ll upgrade it themselves. In other words, <em>as-is<\/em>\nhints to buyers: Please don\u2019t come back after the inspection to request\nrepairs, replacements, and price concessions!<\/p>\n\n\n\n<p>But you can always speak with your agent about contractual\nlanguage that limits the buyer\u2019s leverage in an inspection contingency. Selling\nthe home <em>as-is<\/em> adds vagueness to the transaction, and might not be your\nbest strategy. <\/p>\n\n\n\n<p>Let\u2019s flesh this out with some general considerations for\nsellers.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">As a Seller, You Need to Make a Full Disclosure in Any Case<\/h2>\n\n\n\n<p><em>As-is <\/em>is redundant. You&#8217;ll already disclose the\ncondition of your home\u2019s systems and features on the legally required disclosure\nform. The typical state law says you must disclose known <em>latent defects<\/em>\nthat pose health or safety risks. If a home shopper is unlikely to notice these\nissues in a careful visual inspection, they\u2019re latent, and must be pointed out\non the disclosure statement. <\/p>\n\n\n\n<p>Additionally, agents must follow professional ethics rules.\nFor example, the Maryland Code of Ethics requires agents in the state to reasonably\nfind out the significant facts about a property, and to avoid error, exaggeration,\nmisrepresentation or concealment.<\/p>\n\n\n\n<p>Full disclosure protects the seller as well as the buyer. A\nseller who neglects the proper disclosure process can be held responsible later.<\/p>\n\n\n\n<p><strong><em>Pro tip:<\/em><\/strong>&nbsp;Your <a href=\"https:\/\/www.deeds.com\/articles\/your-real-estate-agents-fiduciary-duties\/\">real\nestate agent has a&nbsp;fiduciary duty<\/a> to represent your best\ninterests. Most states and professional ethics codes direct agents to offer\nreasonable disclosure of facts that materially impact value. As for\nnon-material facts, an agent should disclose negative information if the buyer\nasks. Check your home state\u2019s real property disclosure laws to learn more. <\/p>\n\n\n\n<p>Small details need to be accounted for too, when sellers make\npromises. If you stated all the windows\nhave shades, all those shades should be present and accounted for. Sellers\nshould keep their promises to buyers, whether or not they use words like <em>as-is<\/em>.\n<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Buyers May Ask for Fixes or a Lower Price on the House \u2014 <em>As Is<\/em> or\nNot &nbsp;&nbsp;<\/h2>\n\n\n\n<p>It\u2019s a fact of the seller\u2019s life. Buyers often request repairs\nor additional discounts over various items that turn up on the inspector\u2019s\nreport. And the buyer\u2019s lender might need to see certain issues resolved before\nthe final loan approval. <\/p>\n\n\n\n<p>If you\u2019re concerned that your house isn\u2019t the right fit for\neveryone, the level of detail expected on today\u2019s listing sites should\nalleviate much of that concern. The online photos of homes for sale offer a\nvisual idea of the updates needed. Prospective buyers can learn a lot from\nbrowsing the descriptions and photos on the listings. They can use this\ninformation to strike the homes that won\u2019t work for them from their shopping\nlists. <\/p>\n\n\n\n<p>Assume that you\u2019ll need to do some maintenance before\nclosing \u2014 to the extent the buyer\u2019s requests are in good faith and reasonable\nin light of the offer. Leaving the buyer with some work ahead is quite normal.\nPlus, jobs done after the purchase can be done to suit the buyer\u2019s personal specifications.\n<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Even in a Seller\u2019s Market, Expect Negotiations <\/h2>\n\n\n\n<p>In a competitive market, bidders may agree to waive\ninspection contingencies altogether. If you properly disclosed an issue or the\nmatter is obvious to anyone who looks, you can expect the buyer to stick with\ntheir agreement to waive contingencies. But\u2026<\/p>\n\n\n\n<p>If the inspection report reveals a material defect the\nseller either neglected to disclose or understated, then expect new\nnegotiations. The buyer is not stuck with the deal, <em>as-is<\/em> or not.<\/p>\n\n\n\n<p>And, of course, the seller doesn\u2019t have to sell to any\nprospective buyer, whether or not the house is <em>as-is.<\/em> It\u2019s just usually\na wise idea to be reasonably accommodating rather than lose pending deals and\nhave the listing keep resurfacing on the internet. When that happens, other\npotential buyers may understandably wonder what is going on with the house. <\/p>\n\n\n\n<p>So, if you\u2019re selling a home that needs work, you might\nsimply list it without the <em>as-is<\/em> descriptor, in order to attract more viewers\nand more offers. We\u2019re assuming it\u2019s a habitable home for sale, with all the\nnecessary systems running as they should be. Unless a home is in a truly distressed\ncondition, there may be no benefit to the <em>as-is<\/em> tag \u2014 while there <em>can<\/em>\nbe certain pitfalls in using it. Some professional investors look for <em>as-is<\/em>\nproperties to take advantage of their sellers. Online tours help today\u2019s buyers\nunderstand the homes they put on their short lists. And if a picture is worth a\nthousand words, your online tour will be far more expressive than the phrase <em>as-is<\/em>.\n<\/li><\/ul>\n\n\n\n<p>Finally, remember that your home\u2019s surroundings are important.\nIf you have attractive amenities in the area, point them out. Many of today\u2019s\nbuyers are not just living in their homes, but also working in them. They need\nto know about the parks, running and cycling trails, local coffee shops and\nother attractions near their new homes. Show visuals of subtle traits your potential\nbuyers might not otherwise notice. The way the sunlight washes over your\nsouth-facing patio and garden, for example, can be a positive disclosure!
