We\u2019ll start with a broad-brush Q&amp;A. Then\nwe\u2019ll get into the investment visa and the eligibility rules as of 2021.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Frequently Asked Questions: Here\u2019s What People Are Asking About Immigration\nby Real Estate Investment<\/h2>\n\n\n\n<p><strong>Q. Can I get legal permanent resident (LPR) status by\nbuying U.S. real estate? <\/strong><\/p>\n\n\n\n<p><strong>A.<\/strong> Not exactly. Without more, owning property in the\nUnited States won\u2019t earn you a visa or immigration benefits. But investors<em>\ncan<\/em> get LPR status by funding U.S. real estate projects. <\/p>\n\n\n\n<p><strong>Q. What about the EB-5 Investor visa? Does it pertain to\ninvestments in U.S. real estate?<\/strong><\/p>\n\n\n\n<p><strong>A.<\/strong> That\u2019s the one. It\u2019s often called the\ncash-for-visa provision. In return for their investments in major projects that\nimprove properties and bolster the U.S. economy, EB-5 petitioners are granted\nimmigrant visas for themselves and their spouses, plus their unmarried children\nunder 21. <\/p>\n\n\n\n<p>The status of the EB-5 visa has experienced political\nvolatility. Before November 2019, you could qualify for permanent residence as\nan EB-5 immigrant investor by injecting $1 million into a U.S. business, or you\ncould do it with $500,000 for a business in a Targeted Employment Area (TEA). In\n2019, the U.S. government raised the minimum funding amount. From that point\non, an investor would have to put $1.8 million into a business, or $900,000 in\na targeted employment area. TEA criteria became stricter, pressing the investors\nto select truly distressed and rural development projects. That made\ninvestments in, say, Palm Springs, Washington, D.C. or New York City real\nestate a lot tougher to do. <\/p>\n\n\n\n<p><strong>Q. Didn\u2019t a judge just decide the entry barriers are too\nhigh? Have the lower minimum investment amounts been reinstated?&nbsp; <\/strong><\/p>\n\n\n\n<p><strong>A.<\/strong> You\u2019re right on top of it. And the lawsuit was\nbrought by a real estate investment company: Colin Behring, CEO of Behring\nCompanies. On June 22, 2021 the federal judge presiding over the case struck\ndown the 2019 investment amount hikes, stating that the acting U.S. Homeland\nSecurity Secretary at the time had been improperly appointed. This new ruling\nhas effectively restored the previous rules that didn\u2019t require investor-immigrants\nto spend so much. <\/p>\n\n\n\n<p>Watch for further legislative debate on the EB-5 rules.\nIowa\u2019s Republican Senator Chuck Grassley and Vermont\u2019s Democratic Senator Patrick\nLeahy are keen to steer more investment to rural regions. Meanwhile, other\nsenators from both major political parties are trying to relax the\nqualifications for the EB-5 visa, to make it easier to draw investments.<\/p>\n\n\n\n<p><strong>Q. What are the basics of the process?<\/strong><\/p>\n\n\n\n<p><strong>A.<\/strong> You\u2019ll need an EB-5 approved commercial real estate project. A personal residence doesn\u2019t qualify. You\u2019ll collect supporting documentation, invest your funds, and <a href=\"https:\/\/www.uscis.gov\/i-526\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">file your petition<\/a>. If it\u2019s approved, you\u2019ll get a two-year <em>conditional<\/em> green card. During that time, you\u2019ll invest the funds and create a need for at least ten U.S. jobs. <\/p>\n\n\n\n<p>After you meet the requirements in the two-year period, you\u2019ll be ready to\u00a0<a href=\"https:\/\/www.uscis.gov\/i-829\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">file the petition to remove the conditions<\/a>\u00a0on your status, and receive a 10-year green card (legal permanent residence). You can continue to maintain your permanent resident status for good by keeping your green card up to date. Is there a waiting period to immigrate as an investor?<\/strong><\/p>\n\n\n\n<p><strong>A.<\/strong> Once the U.S. government receives the EB-5\npetition package, the investor-petitioner has established a <em>priority date<\/em>.\nEB-5 visas go to 10,000 applicants annually. Immigrants from one country can\nonly be approved for 7% of the quota. There are long approval waits for people petitioning\nto immigrate from some countries, including China and India.&nbsp;<\/p>\n\n\n\n<p>While you\u2019re waiting, you might have options, such as a temporary\nwork authorization.&nbsp;Speak with an experienced immigration attorney to find\nout. And keep your attorney informed about your travel plans. If you seek permanent\nresidence, take care to avoid visa mistakes now that could impact your case\nlater.<\/p>\n\n\n\n<p><strong>Q. Don\u2019t. There\nare many nuances and potential changes to the rules that a brief guide cannot\ncover, but your lawyer will. Lawyers who work with investor immigrants are good\nat sensing what the U.S. government will reject and what it will accept. They also\nhave the staff and informational resources to see you through the administrative\nprocesses.<\/p>\n\n\n\n<p>Start by setting up initial, free consultations (in person,\nby phone, or with an electronic meeting platform such as Zoom) with more than\none immigration attorney. Select the best one to take on your case. Your\nattorney\u2019s office can see you through every stage of the petition process \u2014\neven the initial stage, when you\u2019re selecting the right investment opportunity\nto succeed with your petition. <\/p>\n\n\n\n<p>You might wish to have a lawyer in the area where you\u2019ll live and work, so you can develop an in-person relationship, but this is not necessary. You\u2019ll be doing most of your collaborating remotely in any case. When trying to decide between lawyers, look for members of AILA \u2014 the <a href=\"https:\/\/www.aila.org\/about\/immigration-lawyer-search\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">American Immigration Lawyers Association<\/a>. <\/p>\n\n\n\n<p><strong>Q. Is this a costly process, putting aside the cash\ninvestment required?<\/strong><\/p>\n\n\n\n<p><strong>A.<\/strong> It\u2019s a very high-cost undertaking. There are your investments,\nand the administrative fees for those investments. There are fees for your\nimmigration law firm. There are government fees for biometrics and reviewing\nyour paperwork. The government fees alone run upwards of $9,000.<\/p>\n\n\n\n<p>You might be wondering if selecting an attorney with the\nmost reasonable fees will help you budget for this process. Decide carefully. An\nexperienced attorney will strengthen your case and work through any problems.\nNote that immigration law is a special area of federal practice, and the EB-5\nprocess is more specialized still. Not every immigration law firm has\nsubstantial experience with investor visas. To optimize your chances of a\nsmooth process and a successful outcome, choose a firm that handles investor\nvisas in the regular course of its business. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Earning a Green Card Through the EB-5 Visa: What Are the Rules?<\/h2>\n\n\n\n<p>The United States offers two tracks for investors who intend\nto live in the United States. <\/p>\n\n\n\n<p><strong>The Basic Program<\/strong>: Immigrants\nmay invest in real estate in order to create or improve a business. The\ninvestment doesn\u2019t only fund the real estate; it should also have a connection\n(\u201cnexus\u201d) to the creation of at least 10 full-time jobs for U.S. employees and\ncover the costs of operations. The arrangement offers multiple sources of\nprofit for the immigrant through property value appreciation and various forms\nof business income, including rental proceeds from multi-unit residences or\ncommercial properties.<\/p>\n\n\n\n<p>The adventure is not without risk.\nWith the basic EB-5 investment, you must risk <em>and<\/em> spend your investment,\nand you must be involved in the business operations.<\/p>\n\n\n\n<p><strong>Regional Center Pilot Programs:<\/strong>\nThe government-approved regional center is a kind of broker for immigrant\npartners. The investments, in which the immigrant investors take an ownership\nstake, can include hotel and restaurant properties, offices and shopping malls,\ncondominium complexes and many other types of sites. Immigrant\ninvestors take earnings, but are generally not involved in construction or titling\nprocesses. Administrative fees to enter these projects run into the tens of\nthousands of dollars. &nbsp;<\/p>\n\n\n\n<p><strong><em>Note:<\/em><\/strong> Authorization\nfor regional centers is close to its sunset date at our time of publication, so\nask your attorney for an update on that. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">If You\u2019re Financially Prepared, You<em> Can<\/em> Get Legal Permanent\nResidence by Real Estate Investing.<\/h2>\n\n\n\n<p>Impressively (and <a href=\"https:\/\/www.businessinsider.com\/hudson-yards-immigrant-visas-funding-2019-4\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">controversially<\/a>), EB-5 investment helped bring New York City\u2019s Hudson Yards into existence. It\u2019s an expensive route to residence, and more complex than simply buying property. But thousands do it every year.
