This can lead to the best\npossible loan terms and rates. <\/p>\n\n\n\n<p>Alternatively, the couple can apply for a mortgage in both\nnames and pay it off from a joint bank account. Buying a home together, as co-borrowers,\nmay seem to strengthen the couple\u2019s borrowing power. Yet it can do the opposite.\nA lender will look at the lower of the two credit scores to make approval\ndecisions. <\/p>\n\n\n\n<p>Moreover, co-borrowers need to refinance the loan if they\nlater stop co-owning and put the title into only one of their names. Handling a\nhome loan jointly can complicate the couple\u2019s future if the relationship\nchanges. <\/p>\n\n\n\n<p><strong><em>\u261b<\/em><\/strong><strong><em> <\/em><\/strong><strong><em>Before applying for your mortgage, <a href=\"https:\/\/www.deeds.com\/articles\/applying-for-a-mortgage-get-the-facts-on-credit-scores-and-how-to-improve-yours\/\">get\nthe facts on credit scores \u2014 and how to boost yours<\/a>.<\/em><\/strong><\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">How Will Your Home\u2019s Title Be Vested?<\/h2>\n\n\n\n<p>One day, even if a couple stays together for life, the house\nwill be conveyed to future owners. That\u2019s why vesting the title is so important\nfor every homeowner. Here are your key titling options:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Sole Ownership&nbsp;<\/h3>\n\n\n\n<p>You might be asking: If we\u2019re going to live together, why\nwould we put the title in one of our names only? It\u2019s not unusual for one\npartner \u2014 typically the one with the stronger financial profile \u2014 to qualify\nfor the mortgage and buy the house, while the other pays a monthly, rent-like contribution\nto the mortgage. There are additional reasons a couple might vest the title in\none partner\u2019s name:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Perhaps one of your careers carries special\nrisks of personal liability. Then you may opt to shield the value of the home by\nbuying it in the other partner\u2019s name.&nbsp; <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Some couples title the home under one name to\ndiversify their credit power \u2014 so both don\u2019t have credit issues at the same\ntime in case of a mortgage default. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>And some couples put their first house in one\nname and the second (a vacation home or investment property) under the other\u2019s\nname.<\/li><\/ul>\n\n\n\n<p>As we\u2019ve noted, if one of the partners has better credit, buying\nthe home in that partner\u2019s name may seem like the obvious way to proceed. Yet even\nwhen partners have markedly different financial resources and credit profiles, some\nco-own and co-borrow on the mortgage loan, and then compensate for their differences.\nPerhaps the co-owner with the higher income will contribute the earnest money\nand down payment, for example. <\/p>\n\n\n\n<p>So, let\u2019s turn to the to main forms of joint ownership for\nunmarried couples: rights of survivorship, and tenancies in common.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Joint Tenancy With Rights of Survivorship <\/h3>\n\n\n\n<p>When one co-owner passes away, should that partner\u2019s interest\nin the house automatically vest in the other? With the JTWROS vesting, it will,\nbecause the partners co-own the entire property \u2014 they share the whole pie rather\nthan own a piece of it. <\/p>\n\n\n\n<p>Among couples who live together, survivorship rights are\nvery popular. This way, when one partner dies there is no question who gets\nthat person\u2019s homeownership interest. The surviving partner automatically\nbecomes the sole owner. Some couples use this vesting method to avoid potential\nprobate challenges from relatives. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Tenancy in Common <\/h3>\n\n\n\n<p>Here, the partners hold shares in the title individually. Each\nmay opt to transfer their own piece of the pie to anyone else. The two people\ncan own the home 50-50%, 80-20%, or by some other percentage. <\/p>\n\n\n\n<p>Do the partners both want to designate their own\nbeneficiaries to receive their interests in their home? If so, they can vest\nthe title as tenants in common. <a href=\"https:\/\/www.deeds.com\/articles\/owning-property-in-unequal-shares-as-tenants-in-common\/\">See\nmore here about how the tenancy in common works<\/a>, and why an\nunmarried couple might choose it.<\/p>\n\n\n\n<p>In the default tenancy in common scenario, the percentage\nowned by the deceased partner goes to recipients named in that person\u2019s will.\nYet during probate, the survivor might wind up buying out the late partner\u2019s\nshare or selling the home to transfer the beneficiaries\u2019 share of the value to\nthem. <\/p>\n\n\n\n<p><strong><em>\u261b<\/em><\/strong><strong><em> <\/em><\/strong><strong><em>As you can see, <a href=\"https:\/\/www.deeds.com\/articles\/hows-your-property-vested-it-matters-as-much-as-your-will-or-trust\/\">vesting\nyour home matters as much as creating your will<\/a>. <\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why Should You Have a Non-Marital Cohabitation Agreement?<\/h2>\n\n\n\n<p>When two people live together, they assume the relationship will\nlast. It\u2019s best to plan for the unexpected anyway. Where there\u2019s a marriage or\na civil union, there\u2019s a legal pathway for dissolving the relationship. Most unmarried\ncouples don\u2019t have the same legal protections for the value each partner builds\nup in a home. <\/p>\n\n\n\n<p>If you separate in the future, then, how will you agree on splitting\nup the property you\u2019ve shared over time? Prepare by creating a cohabitation contract\nthat fits your personal circumstances. While break-up scenarios aren\u2019t romantic\nto consider, if you\u2019re in the position to buy a home, you\u2019ll need to be able to\nhave the discussion together.<\/p>\n\n\n\n<p>Even if you never need it, a legal agreement will make the\nterms of co-ownership easier to understand and carry out. So, take time to consult\nwith a local attorney who regularly handles such agreements. You and your\npartner need to be ready to answer these questions:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">How Are Your Ownership Interests Shared? <\/h3>\n\n\n\n<p>Are both names going on the title? If so, how will you vest your\nownership interests? If you co-own, your lender will want you both on the\nmortgage, and may have important input when you decide how much equity you\u2019ll\neach own, and how much of the mortgage payment you will each handle. And how are\nyou dividing the purchase costs? For example, will one of you cover the closing\ncosts while the other pays the earnest money and down payment? <\/p>\n\n\n\n<p><strong><em>\u261b<\/em><\/strong><strong><em> <\/em><\/strong><strong><em>First-time home buyer? <a href=\"https:\/\/www.deeds.com\/articles\/first-time-home-buyer-pro-tips\/\">This\nchecklist of steps and services in the home purchase<\/a> can help you\nstart planning your and your co-buyers\u2019 roles. <\/em><\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">How Will You Share Home Upkeep and Expenses? <\/h3>\n\n\n\n<p>Write this into your plan. Include utilities, exterior and\ninterior upkeep, cable and wireless services, <a href=\"https:\/\/www.deeds.com\/articles\/real-estate-title-insurance-a-brief-explanation\/\">title\ninsurance<\/a>, homeowners\u2019 insurance, property taxes, and any applicable\ncondo fees or assessments. Establish a record of what you each put into the\nhome. Keep the document file with your legal agreement. A regularly updated agreement\ncan protect a partner who contributes to upkeep but is not named on the title. <\/p>\n\n\n\n<p>In addition to being fair, be practical. For example, the\nperson who will keep the home in the event of a split might be the sole\nborrower and the one who pays for home upgrades, while the other make rent-like\npayments. The non-borrower might pay for interior d\u00e9cor and furnishings as\nthese can be taken out of the house if the two go their separate ways.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Who Keeps the Home in the Case of a Separation? <\/h3>\n\n\n\n<p>If you co-own, will the house be sold? How will the equity (including\nhome maintenance work contributed by either party) be divided up? Your agreement\nmay empower either of you to force a sale and pay the proper percentage of the\nhome\u2019s market value to the other partner. <\/p>\n\n\n\n<p>Why is this necessary? Consider a common situation. The\npartners are co-owners and co-borrowers. One keeps the house but <em>both<\/em> are\nresponsible for the mortgage. What if the one staying won\u2019t agree to buy the\nother one out? There are several\nways to do this, such as <a href=\"https:\/\/www.deeds.com\/articles\/using-a-quitclaim-deed-top-5-reasons\/\">using\na quitclaim deed to transfer your interest<\/a> from your sole name to both\nnames: yours, and your partner\u2019s. <\/p>\n\n\n\n<p>Before carrying out future deed changes, let your mortgage servicer\nknow what you are doing. Notify your insurance company before making any title\nchanges, allowing the company to make any needed updates. It\u2019s also good to\nplan ahead for your tax returns. Though your taxes should be handled just the\nway they would if you were married filing separately, communicating your plans\nto your tax expert ahead of time is still wise. Tax laws change often, and there\nare tax benefits at various stages of homeownership. You\u2019ll want to hear any\nadvice an expert can offer before signing purchase or cohabitation agreements. <\/p>\n\n\n\n<p>Consider too what terms you\u2019ll want to follow if you and\nyour partner sell the home later on. How should the property value be\nredistributed if you sell, or if one of you passes on? If the home is jointly\nowned <em>without<\/em> rights of survivorship, how are the owners passing their share\nafter death \u2014 through a will or trust?
