We should now expect 20 named storms, says CSU. This, after\u00a0the unprecedented 2020 hurricane season. <\/p>\n\n\n\n<p>Disaster relief funds will be vital this year. And this brings\nup multiple problems for people in the hurricanes\u2019 paths with no clear title to\ntheir homes.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Heirship Property and Financial Stress<\/strong><\/h2>\n\n\n\n<p>Hurricanes are hard on Texas, Florida, Louisiana, Georgia, the\nCarolinas, Alabama and Mississippi, and other coastal states. Many residents of\nthese same areas hold <em>heirship property<\/em>. This means their homes have\nbeen passed from owner to owner without paperwork. This also means the current\nresident lacks the basis to insure the house, or to claim disaster assistance\nafter storms and climate-related emergencies. Often, a record of paid property\ntaxes is not enough. Owners need to present clear titles to get long-term\ndisaster recovery assistance.<\/p>\n\n\n\n<p>Throughout the Southern states, heirship property comprises\nmore than a third of Black-owned land. Other affected communities include whites\nin Appalachia and other rural areas, indigenous groups, and Mexican-Americans. Without\ntitles, the homeowners cannot tap into their real estate as a source of wealth.\n<\/p>\n\n\n\n<p>An opinion piece by <a href=\"https:\/\/thehill.com\/opinion\/civil-rights\/548809-fema-dont-drive-the-gullah-geechee-from-their-land\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Albert George<\/a> points to the Gullah-Geechee communities along the islands dotting the South Carolina, Georgia and Florida coasts. The descendants of West African people enslaved for their expertise in growing rice, they legally received the lands they cultivated after the Civil War. Yet much of their heirship property has already been taken over by hotel and condo developers. A hurricane could wipe out all they have left.<\/p>\n\n\n\n<p><a href=\"https:\/\/ncseagrant.ncsu.edu\/ncseagrant_docs\/coastallaw\/pubs\/heirs_property.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">A report<\/a>\u00a0produced by North Carolina Sea Grant shows how easily heirs\u2019 land can be taken away from homeowners in partition sales \u2014 made when developers pit heirs against each other to extract the value of the land. Low-income homeowners are left without the means to defend themselves from real estate developers and timber speculators.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Rebuilding: The Importance of Home Titles <\/strong><\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/07\/rebuilding-the-importance-of-home-titles.jpg\" alt=\"Image of an upset house laying on a vehicle after a natural disaster.\" class=\"wp-image-1530\" width=\"370\" height=\"235\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/07\/rebuilding-the-importance-of-home-titles.jpg 740w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/07\/rebuilding-the-importance-of-home-titles-300x191.jpg 300w\" sizes=\"auto, (max-width: 370px) 100vw, 370px\" \/><\/figure><\/div>\n\n\n\n<p>After Hurricane Katrina in 2005, the heirship property issue\nsurfaced in full force. Thousands of people with severe damage claims were\nturned away for lack of titles or for not having power of attorney from everyone\nelse who might have inherited the property in probate. Some of these people\nwere not allowed to return home.<\/p>\n\n\n\n<p>And after Hurricane Matthew in 2016, many thousands more faced\nthe same problems. Name a hurricane, and it happens. <\/p>\n\n\n\n<p>The issue stems from a general aspect of real estate law. If\nsomeone leaves no will behind, and there is no deed showing someone else has\nthe right of survivorship, then the legal identity of the next owner of the\nhome may be unclear. Perhaps there are many heirs with claims to the home under\nstate <a href=\"https:\/\/www.deeds.com\/articles\/dont-be-the-intestate-homeowner-write-your-will\/\">intestacy\nlaw<\/a>. If so, then they all have to give permission or renounce their\nclaims to the title if any one homeowner is to act on behalf of the home.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Methods of Proving Heirship <\/strong><\/h2>\n\n\n\n<p>State law may allow various methods of conveying ownership\nand clearing title to a house, preventing future problems. <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The Texas <em><a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/ES\/htm\/ES.203.htm\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">affidavit of heirship<\/a><\/em> becomes evidence of title five years after it is recorded in the Texas county where the property is located. The affidavit includes a legal description of the property and empowers named heirs to resolve the affairs of a deceased homeowner. Note, though, that this instrument can be contested. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Many states have small-estate proceedings that pass\nproperty to the heirs in a streamlined alternative to full probate, if the property\nvalue is under a set amount. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>A growing number of states allow homeowners to\nuse <em><a href=\"https:\/\/www.deeds.com\/articles\/update-the-state-of-the-transfer-on-death-deed\/\">transfer\non death deed<\/a><\/em> forms. The <a href=\"https:\/\/www.deeds.com\/transfer-on-death-deed\/\">form<\/a>&nbsp;includes\na legal description of the property and directs it to be conveyed upon the\nhomeowner\u2019s death to the named beneficiaries. <\/li><\/ul>\n\n\n\n<p>Such options may not be available for heirship properties\nthat have passed under the legal radar for an extended period of time. In many\ncases, an heir or heirs simply stayed in the home or moved in without dealing\nwith the county court system, and this might have happened over generations. There\nmay, therefore, be <a href=\"https:\/\/www.deeds.com\/articles\/escheat-homes-and-the-bizarre-business-of-heir-tracing\/\">missing\nheirs<\/a> with legal claims to the property. This situation calls for\nlegal assistance to obtain a clear title.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Help in South Carolina<\/strong><\/h2>\n\n\n\n<p>The&nbsp;nonprofit <a href=\"https:\/\/www.heirsproperty.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Center for Heirs\u2019\nProperty Preservation<\/a>&nbsp;in Charleston, South Carolina is devoted\nto the preservation of heirship property. The founders could not stand by and watch\nthe further loss of African-American family land. The group proactively works\nwith family networks to establish clear title to the land, to create homeowner\neligibility for home repair assistance, and to facilitate estate planning for\nhomeowners. <\/p>\n\n\n\n<p>Early support for the Center came from the Ford Foundation, the South Carolina Bar Foundation, and South Carolina Legal Services. By 2020, the group was celebrating its 15<sup>th<\/sup> anniversary, serving 18 counties, and also running a <a href=\"https:\/\/www.heirsproperty.org\/wp-content\/uploads\/2020\/09\/Spring2020-web-low-res.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">sustainable forestry initiative<\/a>. The group encourages property owners not to sell timber for quick money, but to learn how to manage their land and keep profits within family networks.<\/p>\n\n\n\n<p>Once a title is cleared, what can the owners do to safeguard\nit? Writing a will is important. Paying property taxes faithfully also creates\nan important paper trail to show ownership, and it keeps tax claims (liens)\nfrom being attached to a home and clouding the title.<\/p>\n\n\n\n<p><strong><em>\u261b<\/em><\/strong><strong><em> Vesting a title is as important as having a\nwill. <\/em><\/strong><strong><em><a href=\"https:\/\/www.deeds.com\/articles\/hows-your-property-vested-it-matters-as-much-as-your-will-or-trust\/\">Do\nyou know how your title is vested? See our guide here<\/a><\/em><\/strong><strong><em>.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>A Need for New Legal Solutions<\/strong><\/h2>\n\n\n\n<p>The Federal Emergency Management Agency (FEMA) could change\nthe way it addresses heirship property holders, Albert George argues. It could\nwork with the resident of the home who was there when disaster struck. That\nresident could be deemed the agent for the collective heirship, so that every\nniece and nephew wouldn\u2019t need to be tracked down for power of attorney before\nassistance could be offered.<\/p>\n\n\n\n<p>As for a national policy change, Prof. Thomas Mitchell spearheaded a commission to lay the groundwork. The result came in 2010 with the Uniform Partition of Heirs Property Act. Grassroots support got it into law in Florida, Georgia, South Carolina, Texas, and several other jurisdictions. This model law offers heirship property owners a way to obtain due process and distribute the value of the land among the heirs, conserving their wealth and fending off real estate speculators. Homeowners\nin minority communities may lack access to estate planning services yet need it\nmost. The heirship problem needs attention and it needs solutions.
