Congress has approved Covid-19 stimulus payments including <a href=\"https:\/\/www.businessinsider.com\/biden-stimulus-treasury-rental-aid-46-billion-4-percent-evictions-2021-7\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">$46 billion in rental support<\/a>. But can the government distribute it fully before time runs out? <\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\"><strong>A Crisis for Owners and Renters Alike <\/strong><\/h2>\n\n\n\n<p>Many renters are on the verge of losing their leases (and\ndealing with evictions on their credit records to boot). Anticipating droves of\ndisplaced renters after July, charities are fortifying their staffs where the\nneed is highest. In North Carolina, for example, one in every seven renter\nhouseholds are behind in payments, and county courts are inundated with eviction\ncase files with some cases involving $10,000 and more. <\/p>\n\n\n\n<p>Even renters who have managed to benefit from the rent moratorium still have to pay off their accumulated debts. And their grace periods will be over in August. Many don\u2019t think they can hold on much longer. As of early June, about 3.2 million\u00a0U.S. residents said they would likely be evicted from their homes within two months, according to the U.S.\u00a0<a href=\"https:\/\/www.census.gov\/data\/tables\/2021\/demo\/hhp\/hhp31.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Census\u00a0Bureau&#8217;s Household Pulse Survey<\/a>.<\/p>\n\n\n\n<p>Landlords will need support, too. Not all of them are\nwealthy commercial property owners. More than 40% of rental properties are held\nby individual investor-owners, many with <a href=\"https:\/\/www.hamiltonproject.org\/blog\/an_eviction_moratorium_without_rental_assistance_hurts_smaller_landlords_too\" target=\"_blank\" rel=\"noreferrer noopener\">modest\nincomes<\/a>. Because the U.S. moratorium didn\u2019t allocate assistance for them\nfrom the start, some property owners have been going without rental income\nsince March 2000.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The State of the Moratorium<\/strong><\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/07\/the-state-of-the-moratorium.jpg\" alt=\"Image of an open mail box with an eviction notice letter in it.\" class=\"wp-image-1534\" width=\"368\" height=\"319\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/07\/the-state-of-the-moratorium.jpg 491w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/07\/the-state-of-the-moratorium-300x260.jpg 300w\" sizes=\"auto, (max-width: 368px) 100vw, 368px\" \/><\/figure><\/div>\n\n\n\n<p>Congress placed a hold on evictions in March 2020, as many\nworkers were asked to stay home during the Covid-19 pandemic. The hold helped\nrenters who lost income and could no longer afford their rent. <\/p>\n\n\n\n<p>When the rent suspension lapsed in September 2020, the Centers\nfor Disease Control and Prevention (CDC) stepped up to order an eviction freeze\nof its own, in the name of public health. The CDC\u2019s rationale? Evictions could lead\nto people living in shared spaces, where the risk of spread is greater. The\nCDC\u2019s relief measure helped renters stay put, by targeting people coping with\nfinancial need or extraordinary medical costs during the pandemic.<\/p>\n\n\n\n<p>Landlords, developers and listing agents promptly challenged\nthe CDC\u2019s authority to declare a moratorium. In May 2021, a federal judge in\nWashington, D.C., agreed with real estate industry groups that the CDC had\noverstepped its boundaries, yet left the moratorium in place until the CDC\u2019s\nappeal could be considered. In June 2021, the U.S. Court of Appeals for the D.C.\nCircuit upheld the CDC\u2019s action. <\/p>\n\n\n\n<p>The industry groups quickly appealed to the U.S. Supreme\nCourt. In June, the <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/alabama-association-of-realtors-v-department-of-health-and-human-services\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a> in left the CDC eviction moratorium in\nplace \u2014 by that time knowing it would wind down on its own within two months.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Financial Situation of U.S. Renters<\/strong><\/h2>\n\n\n\n<p>According to census data, more than seven million&nbsp;U.S. households\nhave overdue rent bills. Some of these renters are already in conflict with\nlandlords as the moratorium has never applied to them. To benefit from the CDC\norder, renters had to know it existed. Then they had to give their landlords\nsworn statements on CDC forms declaring their pandemic-related hardships. They also\nneeded to show good-faith attempts to get government rent aid, and to pay what\nrent they could.<a href=\"file:\/\/\/C:\\Users\\LEE\\Desktop\\WORK%20SPACE\\CONTENT%20ELF\\'Oncoming%20Tsunami':%20With%20CDC%20Eviction%20Moratorium%20Ending%20...https:\\www.mediate.com&nbsp;\u203a%20articles%20\u203a%20french-tsunami\"><\/a><\/p>\n\n\n\n<p>\u261b <strong><em>Important note\nfor landlords:<\/em><\/strong><em> <\/em>Any building owner financed by a government-backed or conventional\nmortgage, or receiving any federal assistance, must supply a 30-day notice\nbefore evicting a renter from the property.<\/p>\n\n\n\n<p><a href=\"https:\/\/home.treasury.gov\/policy-issues\/coronavirus\/assistance-for-state-local-and-tribal-governments\/emergency-rental-assistance-program\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Using federal money<\/a> from the 2020 CARES Act Coronavirus Relief Fund, states have supplied rent aid to renters. Some states banned evictions. (Most bans are now expired.) <\/p>\n\n\n\n<p>Yet federal aid distributions have been erratic, and at times <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.newsobserver.com\/news\/coronavirus\/article247108872.html\" target=\"_blank\">states delayed or even turned away numerous applications for help<\/a>. Millions of people have lived with possible eviction hanging over their heads for months. As of the end of June 2021, more than 16% of promised funds still hadn\u2019t been received by owners and renters, says the <a href=\"https:\/\/publicintegrity.org\/inequality-poverty-opportunity\/covid-divide\/rental-assistance-did-not-go-to-tenants-landlords\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Center for Public Integrity<\/a>. Some states used rental funds for other needs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What Action Is the U.S. Government Taking Now?<\/strong><strong> <\/strong><\/h2>\n\n\n\n<p>The <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/06\/24\/fact-sheet-biden-harris-administration-announces-initiatives-to-promote-housing-stability-by-supporting-vulnerable-tenants-and-preventing-foreclosures\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Biden-Harris administration has announced<\/a> several actions to help prevent evictions at this critical turning point, declaring: \u201cMoney is available in every state to help renters who are behind on rent and at risk of eviction.\u201d<br> <br> In addition to urging landlords and courts to avoid eviction actions against renters, the administration is:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Directing courts to federal resources and\ndispute mediation tools \u201cto keep families hard-pressed by the COVID crisis in\ntheir homes while helping make landlords whole.\u201d<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Liaising with attorneys\u2019 associations to create\nsupport systems for vulnerable households \u2014 especially for people coping with\nhomelessness, disability, and language barriers.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Recommending streamlined payment options\nfor&nbsp;commercial landlords and utility companies. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Urging inter-agency collaborations and the use\nof automation in application processing.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Implementing a \u201cwhole-of-government\u201d effort to raise awareness about emergency aid for renters and property owners, using the U.S. Treasury\u2019s\u00a0<a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/home.treasury.gov\/policy-issues\/coronavirus\/assistance-for-state-local-and-tribal-governments\/emergency-rental-assistance-program\/program-index\" target=\"_blank\">website<\/a> and <a href=\"http:\/\/www.cfpb.gov\/housing\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">consumer finance resources<\/a>.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Working with the Department of Housing and Urban\nDevelopment (HUD) to spread information about rental assistance. Plus, the Department\nof Agriculture and the Social Security Administration have been asked to advise\nrecipients of social security payments, SNAP, and other social services about\nrent aid and emergency housing vouchers.<\/li><\/ul>\n\n\n\n<p>To supplement this all-hands-on-deck approach, HUD is\nworking with the Melville Charitable Trust to support community-based\norganizations and to ensure fair distribution of federal funds.<\/p>\n\n\n\n<p>\u261b <strong><em>Foreclosure\nPrevention Update:<\/em><\/strong> <em>Conventional\nand federally backed mortgage foreclosure freezes end at the same time as the\neviction moratorium does: July 31, 2021. The Biden-Harris administration is\nurging the FHA, VA, and USDA, as well as conventional loan companies Fannie Mae\nand Freddie Mac, to seek \u201chome retention solutions prior to any referral to\nforeclosure.\u201d The FHA, VA, and USDA are formulating additional loan relief\noptions.<\/em><\/p>\n\n\n\n<p><strong><em>Homeowners\nwho have not requested COVID-related forbearance yet may still apply, up until September\n30, 2021.<\/em><\/strong><\/p>\n\n\n\n<p>In the American Bar Association\u2019s Practice Points, Attorney John Austin from Raleigh, North Carolina writes about \u201c<a href=\"https:\/\/www.americanbar.org\/groups\/litigation\/committees\/trial-practice\/practice\/2021\/landlords-tenants-eviction-litigation\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">an avalanche of eviction cases that have been stayed for a year<\/a>\u201d and will take yet another year before they work their way to resolutions. Legal services are asking attorneys, nonprofits and churches to help them. <\/p>\n\n\n\n<p>Ultimately, healing from the pandemic is more than a physical\nstruggle, and more than a public health struggle.
