The late\nNorman Johnson signed a deed from the grave, transferring a South Philadelphia\nrowhouse for only $15,000 to Amen Brown. Dawn Presbery, the daughter of the deceased\nand the home\u2019s real owner, fought for two years to recover the deed.<\/p>\n\n\n\n<p>In some cases like this, the D.A. prosecutes, and the person\nnamed on the deed ultimately has to sign a new deed to restore the title to its\nrightful owner. Here, the forgery was pursued in the criminal courts, but the\ncase against Brown was thrown out. <\/p>\n\n\n\n<p>Brown claims to have parted with the $15,000 at the urging of a scammer on Craigslist. But regardless of Brown\u2019s story, as <a href=\"https:\/\/billypenn.com\/2021\/06\/30\/amen-brown-deed-fraud-philadelphia-corruption-190th-district-pennsylvania-state-house\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Max Marin noted for <\/a><em><a href=\"https:\/\/billypenn.com\/2021\/06\/30\/amen-brown-deed-fraud-philadelphia-corruption-190th-district-pennsylvania-state-house\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Billy Penn<\/a><\/em>, it\u2019s astonishing that even criminal charges didn\u2019t induce Brown to return the house title to its rightful owner. <\/p>\n\n\n\n<p>The Philadelphia Court of Common Pleas finally ordered the forged deed returned to Dawn Presbery. Later, with remarkable chutzpah, Brown won an election to Pennsylvania\u2019s House of Representatives, assumed office on December 1, 2020, and set out this year to pass tough-on-crime bills and to <a href=\"https:\/\/whyy.org\/articles\/west-philly-state-rep-to-introduce-bill-banning-sheriff-sales-through-august\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">defend the rights of homeowners to keep their homes<\/a>.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Tangled Webs of Harm<\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/07\/tangled-webs-of-harm.jpg\" alt=\"Image of a padlock securing a wooden structure.\" class=\"wp-image-1538\" width=\"184\" height=\"231\"\/><\/figure><\/div>\n\n\n\n<p><a href=\"https:\/\/www.inquirer.com\/news\/a\/house-sales-fraud-theft-philadelphia-real-estate-dead-owners-william-johnson-20190124.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Stealing deeds from the dead<\/a>\u00a0is surprisingly common in the gentrifying regions of Philadelphia. <\/p>\n\n\n\n<p>These are forgery cases, and they often create tangled webs\nof harm. When someone forges the late owner\u2019s name and has the signature\nnotarized, the heirs lose the house and its accumulated value. When the house\nis flipped to a buyer, there\u2019s a new deed holder in the chain. New buyers may\nmove in and start investing in repairs. Then the heirs notice something is\ngoing on. All at once, the heirs and the buyers are pitted against one another.\nThe forger, by then, has skittered off to the next opportunity. <\/p>\n\n\n\n<p>Forgery makes a deed void. But the heirs need legal help to\npursue a <a href=\"https:\/\/www.deeds.com\/articles\/what-is-a-quiet-title-action\/\">quiet title\naction<\/a> in court, prove forgery, have the illicit deed set aside, and\nhave a new need notarized for the record. <\/p>\n\n\n\n<p>The buyers also need legal representation. The heirs are\nwresting the home back from them \u2014 now with repairs done, and maybe new\nfeatures added \u2014 while the buyer who paid for it all is stranded without a\ndeed. Needless to say, these cases are harrowing for all involved. <\/p>\n\n\n\n<p>The city District Attorney\u2019s Office includes an Economic\nCrimes Unit that goes after some of the most brazen deed thieves. On its\npayroll is an elder justice lawyer who oversees cases vulnerable older\nhomeowners. Among recently prosecuted cases:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>A series of thefts from vulnerable Philadelphians through deed fraud, forgery, theft, conspiracy, and related crimes. One of the five people arrested for <a href=\"https:\/\/www.nbcphiladelphia.com\/news\/local\/5-people-accused-of-stealing-11-philly-homes-through-deed-fraud\/2751761\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">stealing 11 Philly homes<\/a> was the notary. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>A case of a deed thief who got 14 homes. <\/li><\/ul>\n\n\n\n<p>Assistant D.A. Kimberly Esack in the Economic Crimes unit <a href=\"https:\/\/whyy.org\/articles\/philadelphia-man-charged-with-stealing-14-homes-through-deed-theft\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">cited the hot housing market<\/a> as a contributing factor to spike in deed theft.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Deed Theft Prevention Measures <\/h2>\n\n\n\n<p>In keeping with a nationwide trend, Philadelphia emails automated\nnotices to people whose names appear on real estate filings. Since 2019, the alerted\npeople are allowed to review the documents online at no charge. Before that,\nthey had to pay to look through the Philadox system. <\/p>\n\n\n\n<p>The city records department now identifies notaries in the\nsystem, too. This measure will help deter and catch fraudulent notary\nactivities.<\/p>\n\n\n\n<p><br>\nAdditionally, the Philadelphia Bar Association has convened a Fraudulent\nConveyance Task Force. In addition to representatives from the records\ndepartment, the task force includes the District Attorney\u2019s Office and the police,\nthe Register of Wills, elected representatives and government officials,\nattorneys, notaries, title insurers and nonprofit advocacy groups. Not\nsurprisingly, the task force recommends harsher penalties for deed fraud. <\/p>\n\n\n\n<p><strong><em>\u261b<\/em><\/strong><strong><em> <\/em><\/strong><strong><em>Some homeowners assume\nthe easiest way to pass the title to their home on to its next owner is by\nadding a name to the deed. Be careful. Understand the <a href=\"https:\/\/www.deeds.com\/articles\/adding-someone-to-your-real-estate-deed-know-the-risks\/#:~:text=A%20deed%20that%20conveys%20an,that%20other%20additional%20owner's%20consent.\">estate planning pitfalls of adding someone to your\nhouse deed<\/a>.<\/em><\/strong><\/p>\n\n\n\n<p>Resources for people with deed conflicts include the following options: <br><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The Philadelphia Bar Association, through its <a href=\"https:\/\/lris.philadelphiabar.org\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Lawyer Referral and Information Service<\/a>, guides people to qualified lawyers for any kind of legal problem. An initial consultation costs $35. When necessary, the connected lawyers may be able to handle cases free of charge or at deep discounts. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>The Philadelphia Department of Records publishes a deed fraud page that explains the <a href=\"http:\/\/phila.gov\/deed-fraud\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Fraud Guard email alert system<\/a>, and points to free legal services for low-income residents.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><a href=\"https:\/\/facebook.com\/PHLROW\/photos\/a.122113342753889\/284168639881691\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">The Register of Wills has a new fee deferral option<\/a> for to help people pay for the administration of the estates of deceased relatives. Through this process new deeds will be created in the names of the legal heirs. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">City Council Hears Deed Fraud Testimony<\/h2>\n\n\n\n<p>In March 2021, the Fraudulent Conveyance Task Force held a\nhearing. Attorney Judy Berkman of Pennsylvania\u2019s nonprofit Regional Housing\nLegal Services addressed Philadelphia\u2019s City Council Committee on\nIntergenerational Affairs and Aging. The passing away of a homeowner without\nanyone administering the estate and deed fraud, Berkman says, are prime cases\nof \u201ctangled title\u201d \u2014 the lack of a deed naming a current, rightful owner.<\/p>\n\n\n\n<p>As for deed fraud, says Berkman, there\u2019s an even tricker\nmatter than forgery. That is the deed theft in which a real homeowner actually\ndoes sign the deed. This arises most often when an elderly person owns and\nstill lives in the home. A caregiver (who might or might not be related to the\nhomeowner) puts pressure on the elder to sign a deed or power of attorney with\na notary present. The manipulator thereby seizes rights over the property. <\/p>\n\n\n\n<p>To rectify these situations, the homeowner would need legal\nrepresentation to show threats or coercion. Or a court would need to examine\nevidence showing the owner lacked capacity to understand the papers and the\neffect of signing them.<\/p>\n\n\n\n<p>We wonder in these cases what the notary was thinking. Some\nnotaries are simply duped. Others are in on the scheme. Still other notaries\nhave their identities stolen, and wind up mired in cases they knew nothing\nabout. There is also the matter of<em> notario<\/em> fraud, mainly among Hispanic\nhomeowners. In Spanish-speaking countries, a <em>notario<\/em> means a person with\nskills and training tantamount to a lawyer\u2019s. Because of linguistic confusion, notaries\nusing the word <em>notario <\/em>can give vulnerable people the impression they\u2019re\ndispensing legal advice.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">In Philly and Everywhere, Fraud Happens. Protect Yourself.<\/figcaption><\/figure><\/div>\n\n\n\n<p>State law controls the recording of deeds, so local\nrecording offices are not at liberty to create their own rules for sniffing out\nbad deeds. If a deed meets procedural rules, it gets recorded, and fraud\nhappens. Knowing this, what can we all do to lessen the risks? <\/p>\n\n\n\n<p>One important way for individuals to counter deed fraud is\nfor anyone buying real estate to <a href=\"https:\/\/www.deeds.com\/articles\/category\/title-insurance\/\">get title\ninsurance<\/a> when buying the home, and check in advance to be sure the\npolicy will cover deed theft and fraud. Title insurance is optional. But, for\nreasons this article underscores, it\u2019s important. Unlike the case with\nhomeowner\u2019s insurance, there is only one upfront premium to pay for a title\npolicy. And the state sets out the price. <\/p>\n\n\n\n<p>Another way we can help, Attorney Berkman points out, is to know the people in our community. We can check on the vulnerable and make sure they are safe.
