Why the metaphor makers didn\u2019t choose\nan enchilada is anyone\u2019s guess. It certainly would have spiced up law school\ncourses.<\/p>\n\n\n\n<p>In any case, what\u2019s in a real estate deed matters. If your\nbundle is missing a few sticks, so to speak, you might not get to use your\nproperty as planned. You could need to negotiate or compromise with another\nparty. You might learn that someone else has a conflicting interest and\npossibly always will. <\/p>\n\n\n\n<p>Ideally, the buyer of a home with a clear title receives\ncomplete ownership and the prerogative to use it as desired. In reality, things\nget complicated. Here are six of the most significant rights you can have:<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\"><strong>1.&nbsp;&nbsp;\n<\/strong><strong>Your Right of Possession <\/strong><\/h2>\n\n\n\n<p>Possession has nothing to do with a haunted house \u2014 <a href=\"https:\/\/www.deeds.com\/articles\/should-you-feel-possessed-to-buy-a-house-look-at-your-states-disclosure-laws-first\/\">usually<\/a>.\nWhen you receive the title to the real estate, you possess a piece of property.\nBy law, then, you own the place and may live there. You may have others removed\nin necessary and appropriate circumstances.<\/p>\n\n\n\n<p>If you buy with cash, and own your home free and clear, then\nyour right of possession is not subject to a mortgage lien. But if you secure a\nloan on the property, you\u2019ve traded a part of your ownership rights for a loan.\nWe\u2019ll talk a little more about this below, when we discuss the homeowner\u2019s\nright of disposition. <\/p>\n\n\n\n<p><strong><em>\u261b<\/em><\/strong><strong><em> <\/em><\/strong><strong><em>What kinds of\nliens can impact a title? <a href=\"https:\/\/www.deeds.com\/articles\/how-a-lien-affects-the-real-estate-title\/\">Read\nabout how various types of liens affect a homeowner\u2019s rights<\/a>.<\/em><\/strong><\/p>\n\n\n\n<p>In some states, a home is conveyed to a mortgage borrower\nthrough a&nbsp;<em><a href=\"https:\/\/www.deeds.com\/articles\/what-is-a-deed-of-trust\/\">deed of trust<\/a><\/em>.\nHome loans in these states differ from standard mortgage states. In deed of\ntrust states, a third party holds&nbsp;the legal title until you, the borrower,\npay off the&nbsp;loan. This way the lender can easily <em>repossess <\/em>the home\n\u2014 not by turning to the court\u2019s foreclosure process, but by simply using the&nbsp;<em>power\nof sale clause<\/em>&nbsp;in the deed of trust.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>2.&nbsp;&nbsp;\n<\/strong><strong>Your Right to Quiet Enjoyment <\/strong><\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/07\/your-right-to-quiet-enjoyment.jpg\" alt=\"A stack of documents bundled together with black twine.\" class=\"wp-image-1555\" width=\"364\" height=\"205\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/07\/your-right-to-quiet-enjoyment.jpg 485w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/07\/your-right-to-quiet-enjoyment-300x169.jpg 300w\" sizes=\"auto, (max-width: 364px) 100vw, 364px\" \/><\/figure><\/div>\n\n\n\n<p>The&nbsp;covenant of quiet enjoyment&nbsp;gives the owner or\nrenter freedom from disruptions to their right to possess or use their real\nestate. If you own your home, you can use and enjoy it free from anyone else\u2019s\nmeddling \u2014 within legal limits, of course. Zoning and local ordinances may\nprohibit you from carrying out certain activities or placing certain structures\non the real estate you own, or oblige you to apply for a permit. <\/p>\n\n\n\n<p>If you\u2019re a homeowner on a multi-unit property, everyone in\nthe community has the same right to quiet enjoyment. So, the individual\nhomeowners need to compromise on their own rights to respect the rights of the\ncollective whole. If you buy a condo, others will hear or be impacted by your\nactivities. You might be sharing walls and plumbing. Therefore, the title to\nyour property will have conditions, covenants and restrictions (CC&amp;Rs)\nlimiting the activities you can take in and around your unit.&nbsp; <\/p>\n\n\n\n<p><strong><em>\u261b <\/em><\/strong><strong><em>Home\nprices have soared. But many condo properties still offer affordable\nhomeownership. <a href=\"https:\/\/www.deeds.com\/articles\/with-home-prices-soaring-condos-are-a-relative-bargain-heres-how-their-deeds-work\/\">Read\nmore about what you get with a condo deed<\/a>.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>3.&nbsp;&nbsp;\n<\/strong><strong>Your Right of Control<\/strong><\/h2>\n\n\n\n<p>As an owner, you have the right of control. This is the\nright to make improvements and do other things you want with your real estate. Related\nrights include the right to use the air, water, or underground resources on the\nproperty.<\/p>\n\n\n\n<p>Here again, your right to control your property as you see\nfit is typically offset by certain rules and limits set by your township or subdivision,\nand by your neighborhood association or homeowners\u2019 association if you have one.\n<\/p>\n\n\n\n<p><strong><em>\u261b<\/em><\/strong><strong><em> &nbsp;<\/em><\/strong><strong><em><a href=\"https:\/\/www.deeds.com\/articles\/can-a-homeowner-get-around-a-deed-restriction\/\">Can\na homeowner get around a deed restriction? Read more here<\/a><\/em><\/strong><strong><em>.<\/em><\/strong><\/p>\n\n\n\n<p>You can have an ownership interest and yet <em>not<\/em> have possession\nor control. Some co-ownerships are <a href=\"https:\/\/www.deeds.com\/articles\/hows-your-property-vested-it-matters-as-much-as-your-will-or-trust\/\">vested\nas tenancies in common<\/a> with one co-owning as an investor. That\nperson, although an owner, might live elsewhere and not have the right of\npossession.<\/p>\n\n\n\n<p>If you rent out your property, the lease will pass the\nrights of quiet enjoyment and possession to your renter. The renter will also\nget the right to exclude. As the owner, though, you keep the right of control\nover your property, and may come in \u2014 after giving the requisite advance\nnotice.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>4.&nbsp;&nbsp;\n<\/strong><strong>Your Right to Exclude Others<\/strong><\/h2>\n\n\n\n<p>As an owner of private property, you have the right to keep\ntrespassers out. Note certain exceptions for:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Utility workers and others with easements on\nyour property.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Police officers with warrants. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Governments that change homeowners\u2019 rights\nthrough rezoning, or taking property outright through <a href=\"https:\/\/www.deeds.com\/articles\/eminent-domain-an-eminence-front\/#more-88\">eminent\ndomain<\/a>.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Deed restricted properties and condo units <a href=\"https:\/\/www.deeds.com\/articles\/zeroing-in-the-subject-to-clause-in-your-real-estate-deed\/\">subject\nto<\/a> inspections for compliance with rules and safety provisions.<\/li><\/ul>\n\n\n\n<p>If you decide to rent your space out, or allow someone else\nto have an<em> easement<\/em> to use or travel across your land, you\u2019re\nvoluntarily giving up your right to exclude to that extent. But in the case of\nrenting, you\u2019re furthering your <em>right to derive income<\/em> from your real\nestate. To restore these sticks to your bundle (or these ingredients to your\nenchilada) and offer more value to the next owner, you can wait until the\nrenter\u2019s (or easement\u2019s) term is up to sell. If an easement is created without\na time limit declared at the start, and the party with right of way over the\neasement won\u2019t give it up, you may need to seek legal representation and <a href=\"https:\/\/www.deeds.com\/articles\/what-is-a-quiet-title-action\/\">pursue a\nquiet title action<\/a> in court.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>5.&nbsp;&nbsp;\n<\/strong><strong>Your Right to Encumber the Property<\/strong><\/h2>\n\n\n\n<p>This allows you, as the homeowner, to place burdens on the\nproperty. You could encumber a house with debt by taking a home equity loan out\nagainst its value, for example. <\/p>\n\n\n\n<p>Your right to encumber your real estate can also be\nintertwined with letting go of certain exclusion rights. You might agree to an easement\nso the person next door could, say, walk across a bridge on your acreage or to get\naccess to a trail.<\/p>\n\n\n\n<p><strong><em>\u261b<\/em><\/strong><strong><em> Curious about how easements work? But\nnot all homeowners\u2019 enchiladas have this ingredient! For just one example, some\ndeeds have affordable housing restrictions. Deed restrictions can prevent you\nfrom disposing of your real estate without following a set of rules or obtaining\nadvance approval from a corporate or government authority.<\/p>\n\n\n\n<p>If you rent out your property, you may also decide whether\nto grant your renter an element of your right of disposition \u2014 that\u2019s the\nability to sublet the property. <\/p>\n\n\n\n<p>As long as there is any loan debt on the home, you as a\nhomeowner don\u2019t have a full right of disposition. <\/p>\n\n\n\n<p>In most cases, you have to make a final payoff prior to\nselling, or pay the remaining debt from a portion of the real estate sale\nproceeds when you sell. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Effects of Digital Disruptions<\/strong><\/h2>\n\n\n\n<p>The idea of rights as a \u201cbundle\u201d is part of the way real\nestate works under our legal system. As newer conceptions of property emerge, investment\nproperties are poised to become more liquid and easier to invest in. The bundle\nconcept could go through some changes in the future. It\u2019s complicated to assign\nvarious ingredients in an enchilada to anyone with a share in the whole! <\/p>\n\n\n\n<p><strong><em>\u261b<\/em><\/strong><strong><em> <\/em><\/strong><strong><em>The rise of&nbsp;decentralized\nfinance is making&nbsp;blockchain part of the evolving conversation around\nproperty rights. <a href=\"https:\/\/www.deeds.com\/articles\/category\/blockchain\/\">Keep up with\nblockchain and real estate, as we see it<\/a> at Deeds.com.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>No Rights in a Vacuum<\/strong><\/h2>\n\n\n\n<p>Homeowners can be liable for damage to other parties\u2019 property\nor for injuries that occur on their premises. They pay property taxes and taxes\non title transfers. Mortgage lenders have a right to possess homes through\nforeclosure upon a borrower\u2019s default. Condo buyers must meet regular financial\nresponsibilities to the homeowners\u2019 association (HOA) \u2014 or it could place liens\non the units.<\/p>\n\n\n\n<p>Thus, the collection of rights that make up homeownership never\nexists in a vacuum.
