Investors and second\nhomeowners have never had such great opportunities to sell their second homes \u2014\nor obtain new income by using these homes as rental properties. <\/p>\n\n\n\n<p>In 2021, groups of friends and families are looking for new\nroad-trip destinations. Avoiding air travel, they\u2019re seeking out alternatives fairly\nclose to home. These local adventurers want clean rooms, expansive,\nindoor-outdoor spaces, and versatile accommodations. Bonus points for proximity\nto water activities, ski slopes or hiking trails, and strong internet\nconnections. The trends are drawing a new set of homeowners to Airbnb, HomeAway,\nVrbo, and other online hosting platforms.<\/p>\n\n\n\n<p>At the same time, major tourist cities and surrounding\ncounties are honing their regulations to manage the trend. They\u2019re passing laws\nto head off noise complaints, to hold room-rental platforms accountable, and to\ntap into a new source of taxes. <\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Can\u2019t Beat \u2018Em? Tax \u2018Em!<\/h2>\n\n\n\n<p>Nevada is currently testing a new legal framework to regulate\nonline home rental platforms. This is after Clark County, Nevada (home of the\nLas Vegas Strip) tried in vain to simply ban short-term rentals. Thousands of\nLas Vegas short-term listings could be found online, even with the ban. It was\npatently obvious that an Airbnb ban was never going to work in Las Vegas.<\/p>\n\n\n\n<p>Nevada\u2019s lawmakers have now turned away from bans. They\u2019ve come\nup with a new regulatory framework. <\/p>\n\n\n\n<p>Under Assembly Bill 363, effective since July 1, 2021, short-term\nrental houses in Clark County and throughout the Las Vegas area are taxed as\nhotels. This could fetch some $45 million in annual room taxes \u2014 money that\ncould help pay for Nevada schools and infrastructure. On the other side of the\ncoin, the law could use close to $4 million in expenses during its initial two\nyears, as it equips the permitting agencies to deal with a booming business in home\nrentals.<\/p>\n\n\n\n<p>The Nevada Resort Association and Culinary Union are\nsupporters. They lose money when do-it-yourself tourism flourishes. &nbsp;<\/p>\n\n\n\n<p>As for Airbnb, it supports taxation of short-term rentals,\nbut doesn\u2019t care for buffer requirements and two-night minimum stays for guests.\nThe platform also claims that special limits on hosts near casinos will impede a\npost-pandemic rebound for Las Vegas. (As of July 1, no short-term rentals are being approved for properties\nlocated less than 2,500 feet from resorts.) As a general matter, Airbnb\nargues that the Nevada law appeases the big resorts at ordinary homeowners\u2019\nexpense.<\/p>\n\n\n\n<p>\u261b <strong><em>Buying a condo\nto rent out? Understand the association\u2019s short- and long-term rental rules.\nHomeowners\u2019 associations (HOAs) can simply prohibit vacation rentals, in Nevada\nand elsewhere. <a href=\"https:\/\/www.deeds.com\/articles\/homeowners-associations-an-hoa-boards-effect-on-your-property\/\">Learn more about an HOA board\u2019s authority over condo\nownership here<\/a>.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Happens in Vegas<\/h2>\n\n\n\n<p>For now, Nevada\u2019s law covers only a few highly populated counties and cities: Clark County, Las Vegas \/ North Las Vegas and Henderson. Meanwhile, in the Reno area, a separate set of rules, restrictions, and inspection processes will be <a rel=\"noreferrer noopener\" href=\"https:\/\/www.washoecounty.us\/csd\/planning_and_development\/short_term_rentals\/index.php\" target=\"_blank\">effective in Reno on August 1<\/a>. As it bars applications for new rentals inside the Reno city limits, it is drawing inevitable controversy.<\/p>\n\n\n\n<p>A number of other Nevada cities have rules already in place.\nMost focus on numerical limits to rentals per owner, noise abatement, attention\nto local zoning ordinances, and advance notification to owners in the\nsurrounding buildings. <\/p>\n\n\n\n<p>The Las Vegas area\u2019s new law adopts much of what\u2019s already\nin place throughout the Las Vegas Valley. Highlights of the Las Vegas area law\ninclude:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>A rule that the counties and cities must create\na permit system, with individual limits and fees for homeowners who use rental\nplatforms.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>A requirement that each permitted house has\nliability coverage and a local contact, 24\/7.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>A minimum stay of two nights unless the houses\nare owner-occupied. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Rules for minimum buffers between home rentals,\nand between the rentals and hotels.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Limitations on investor-owners: each may only\nhave five short-term rental properties.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>A 10% cap on the percentage of allowed\nshort-term rentals in condo and other multi-unit properties.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>16-visitor occupancy limits.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>A provision that keeps hosting platforms out of apartment\nbuildings.<\/li><\/ul>\n\n\n\n<p>Taxation will not be retroactive. The law anticipates a\nsix-month phase-in period. Owners who already rent out their places are shielded\nfrom penalties as they enter the permit framework. But that doesn\u2019t mean\nout-of-compliance homeowners are guaranteed permits. Local authorities may also\nwithdraw permits from noncompliant homeowners. Fines for violations of the new\nlaw may range from $1,000 to $10,000, depending on what a county decides. And\nlocal governments can go after the platforms connected with problem hosts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Online Platforms Vs. Brick-and-Mortar Cities<\/h2>\n\n\n\n<p>Laws of the type Nevada is creating can be challenged in court. After <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.cnet.com\/news\/airbnb-finally-settles-lawsuit-against-nyc-and-hands-over-host-data\/\" target=\"_blank\">Airbnb sued New York City<\/a>, the parties were engaged in a long, brutal struggle before the platform finally agreed to share hosts\u2019 data with the city, allowing violators to be tracked down. The city\u2019s <a href=\"https:\/\/www1.nyc.gov\/site\/specialenforcement\/stay-in-the-know\/information-for-neighbors.page\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Office of Special Enforcement<\/a> encourages locals to submit complaints about possible abuses of the system.<\/p>\n\n\n\n<p>In 2016, <a href=\"https:\/\/beta.techcrunch.com\/2016\/06\/27\/airbnb-sues-san-francisco\/\" target=\"_blank\" rel=\"noreferrer noopener\">Airbnb challenged rental registration rules established by San\nFrancisco<\/a>. As other cities have done, San Francisco defended its\nshort-term rental rules by citing the need to protect housing stock of ordinary\nresidents over investors. Yet it supported the rights of compliant homeowners\nto supplement their income by using the rental platforms within reasonable\nbounds.<\/p>\n\n\n\n<p>Following a 2017 settlement, Airbnb created a user-friendly way\nfor San Francisco homeowners to license and register their rental businesses, and\nagreed to remove invalid listings. New hosts are notified that city officials\nreview their data. The platform has come to similar agreements with Denver,\nChicago, and New Orleans. <\/p>\n\n\n\n<p>Airbnb has sued a number of other cities, too \u2014 and sometimes\nit wins its lawsuits outright. But the typical case leads to county and city\nregistration fees; hotel-like taxes; noise limits and party home prohibitions;\nsecurity and waste collection rules; and some level of data sharing. Online platforms\ngenerally supply local officials with data on listings, reservations, owners\nand renters, and revenues. <\/p>\n\n\n\n<p>Hosts need to be licensed by the states and permitted by\ntheir counties. A jurisdiction may require platforms to vet hosts to be sure\nthey only list authorized property owners.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Forward-Looking Trend<\/h2>\n\n\n\n<p>Previously, communities have been all over the map on\nrental platform rules. Some towns have tried to ban them. Some counties have\ntaken an anything-goes approach. Las Vegas had only been allowing platforms to\nwork with owner-occupied homes. <\/p>\n\n\n\n<p>As Nevada now shows, the general thrust ahead will be\nabout balancing platform accountability, choice of fees and enforcement\nmechanisms for towns and counties, and homeowners\u2019 rights to generate profits\nfrom their homes.
