Buyers\nof real estate in in places where the risk of fire is \u201chigh\u201d or \u201cvery high\u201d will\nreceive information about how the seller cleared the home of surrounding debris,\nand how the buyer should continue that task, protecting the home from flames\nand embers. It\u2019s just the latest adjustment to <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201920200AB38\" target=\"_blank\" rel=\"noreferrer noopener\">California&#8217;s wildfire risk mitigation and disclosure law<\/a>,\nprompted by destructive fires in recent seasons. <\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Issue<\/strong><\/h2>\n\n\n\n<p>Tens of millions of new households have popped up in risky areas in recent years \u2014 and not only in California. Often, it\u2019s a case of follow-the-money. Local governments gain tax revenues when they green-light new developments, including in risky areas. And many, many people buy in without knowing the risks. Wildfire maps haven\u2019t caught up to the heightened risk from continued climate change, which is now causing\u00a0<a href=\"https:\/\/climate.nasa.gov\/news\/2912\/satellite-data-record-shows-climate-changes-impact-on-fires\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">major fires to keep raging at night<\/a>. <\/p>\n\n\n\n<p>Only four states have rules around development and\u00a0wildfire. Moreover, as National Public Radio has observed, <a href=\"https:\/\/www.npr.org\/2020\/10\/21\/924507691\/millions-of-homes-are-at-risk-of-wildfires-but-its-rarely-disclosed\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">most wildfire-prone states don\u2019t require disclosure to buyers or renters<\/a>. <\/p>\n\n\n\n<p>California and Oregon do have disclosure rules. In Oregon, the&nbsp;seller\u2019s\nstandard disclosure statement mentions the <em>forestland-urban interface. <\/em>Oregon\nbuyers should be on the lookout for that term. It means a known risk of fire.<\/p>\n\n\n\n<p>In an attempt to save lives and homes, <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201920200AB38\" target=\"_blank\">new wildfire disclosure law<\/a> appears in <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=1103.2.&amp;lawCode=CIV\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">California\u2019s disclosure requirements<\/a>. From 2021 on, sellers must inform a buyer if the home meets flammable brush clearing rules; and they must list the home\u2019s potential fire risks. Sellers will soon also have to say if they&#8217;ve carried out fire-prevention retrofits.<\/p>\n\n\n\n<p>Here are some details of the California laws that took\neffect in 2021.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Effective Jan. 1, 2021: Home Hardening\nDisclosure Law<\/h3>\n\n\n\n<p><strong>Home hardening means best practices to help a house,\ncondos or manufactured home stand up to fire.<\/strong> Sellers&nbsp;in&nbsp;designated\nhigh to very high fire hazard&nbsp;zones must fill out a <em>Fire Hardening and\nDefensible Space Advisory<\/em> for properties built before 2010 \u2014 when\nCalifornia established its Wildfire Urban Interface building codes. Defensible\nspace is the continually maintained clearance between anything built on the\nland, and fire-prone matter around these structures.<\/p>\n\n\n\n<p>California expects home sellers to do the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Provide proof that the home complies with\nvegetation management laws, dated within the six months leading up to the sale.\nOtherwise, the two parties must agree, in writing, that the new owner will get\ndocumentation after closing.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Give the buyer a copy of a final inspection\nreport, or instructions on obtaining a copy. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Supply a list of known features that make the\nhome susceptible to wildfire and ember storms. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Include the state\u2019s list of cost-efficient\nretrofits (included in the January provisions, but starting Jul. 1, 2025). <\/li><\/ul>\n\n\n\n<p><a href=\"https:\/\/wildfiretoday.com\/2021\/01\/07\/new-california-law-requires-seller-of-home-to-disclose-vulnerability-to-wildfires\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">View details of required home hardening disclosures here<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Effective July 1, 2021: Defensible Space Law\n<\/h3>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/08\/defensible-space-law.jpg\" alt=\"Image of a house in the woods.\" class=\"wp-image-1624\" width=\"347\" height=\"230\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/08\/defensible-space-law.jpg 463w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/08\/defensible-space-law-300x199.jpg 300w\" sizes=\"auto, (max-width: 347px) 100vw, 347px\" \/><\/figure><\/div>\n\n\n\n<p>In <a href=\"https:\/\/osfm.fire.ca.gov\/divisions\/wildfire-planning-engineering\/wildfire-prevention-engineering\/fire-hazard-severity-zones\/#:~:text=There%20are%20three%20levels%20of,major%20cause%20of%20fire%20spread.\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">State Responsibility Areas<\/a>, owners must maintain their properties so they meet California\u2019s building and fire codes. <strong>Requirements for clearing brush and debris around the home (as far as the property goes, up to 100 feet) can help halt approaching wildfires and enhance firefighter safety.<\/strong><\/p>\n\n\n\n<p>The state has added new disclosures to update the standard form for home sales in a high to very high <a href=\"https:\/\/egis.fire.ca.gov\/FHSZ\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Fire Hazard Severity Zone<\/a>. Purchase agreement documents now include California\u2019s <em>New Fire Hardening and Defensible Space Advisory, Disclosure and Addendum<\/em> to record the actions taken to maintain a buffer zone. <\/p>\n\n\n\n<p><strong><em>Pro tip: <\/em><\/strong>There are nonprofits that do free\nassessments&nbsp;for home-hardening. Ask your real estate agent about them.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Financial Aftermath <\/strong><\/h2>\n\n\n\n<p>After a major fire damages California homes, local assessors collaborate with the California Department of Forestry and Fire Protection (<a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"http:\/\/fire.ca.gov\/\" target=\"_blank\">Cal Fire<\/a>) to determine which properties sustained at least $10,000 in structural damage. Meanwhile, the owners can proactively apply to have their houses reassessed and lower their values for tax purposes. Owners losing at least $10,000 in structural damages will qualify for tax adjustments. Homeowners should complete the <a href=\"https:\/\/sonomacounty.ca.gov\/CRA\/Assessor\/Real-Property\/Tax-Savings\/Fire-Calamity-FAQs\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Application for Reassessment of Property Damage by Misfortune or Calamity<\/a>. <\/p>\n\n\n\n<p>Regardless of where a home exists, a homeowner\u2019s insurance policy covers losses from wildfires. <a href=\"https:\/\/www.insurance.wa.gov\/wildfires-and-homeowner-insurance\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Washington State\u2019s Office of the Insurance Commissioner<\/a> points out the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>A homeowner\u2019s policy covers damage from any kind\nof fire that was not purposefully ignited by the insured person.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>It\u2019s important to review a policy from time to\ntime, and keep enough insurance for the value of the home and possessions.<\/li><\/ul>\n\n\n\n<p><strong><em>Pro tip:<\/em><\/strong> Scan your home\u2019s interior, to keep\ntrack of all your belongings, into a file on your phone. Keep a scanned copy of\nyour insurance policy on your phone, too.<\/p>\n\n\n\n<p>Note that homeowner\u2019s insurance is not the same as a title\npolicy. A title policy protects the owner\u2019s rights and covers the costs of\naddressing defects and liens on the home\u2019s title.<\/p>\n\n\n\n<p>&nbsp;<strong><em>\u261b <\/em><\/strong><strong><em>Read more information about <\/em><\/strong><a href=\"https:\/\/www.deeds.com\/articles\/home-buyers-cover-your-assets-choosing-between-standard-and-extended-title-insurance\/\"><em>standard and extended title insurance<\/em><\/a><strong><em> from Deeds.com.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Wildfire Beyond the West<\/strong><\/h2>\n\n\n\n<p>Risks are high in <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.nevadafireinfo.org\/maps\" target=\"_blank\">Nevada<\/a>\u00a0and\u00a0<a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/csfs.colostate.edu\/wildfire-mitigation\/colorado-forest-atlas\/\" target=\"_blank\">Colorado<\/a>, Texas and Arizona, Montana and Oregon, Idaho and Wisconsin, and the eastern states \u2014 and around any outer suburbs where people are building heavily. <a href=\"https:\/\/www.dcnr.pa.gov\/Communities\/Wildfire\/Pages\/default.aspx\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Most wildfires happen east of the Mississippi<\/a>. <\/p>\n\n\n\n<p>One in three U.S. homes are now in and around forested areas. As more people buy in <a href=\"https:\/\/www.iii.org\/fact-statistic\/facts-statistics-wildfires#Wildfires%20By%20State,%202020\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">these areas<\/a>, there are more power lines, more fuel and equipment being used, and, generally more risk.<\/p>\n\n\n\n<p>An emergency can happen at any time, says Pennsylvania\u2019s\nDepartment of Conservation and Natural Resources. A small yard waste burning\nsession or a fireworks display can become a fire that spreads quickly through dry\nbrush and into the nearest woods. <\/p>\n\n\n\n<p>Add in another risk factor: climate change. Greenhouse gas emissions \u2014 from the burning of fossil fuels, from our landfills, factories, and animal farming, and from wildfires themselves \u2014 are all intensifying climate change. For homeowners, the rising temperatures are increasing <a href=\"https:\/\/apps.npr.org\/us-wildfires-impact-environment-climate-change\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">fire hazards nationwide<\/a>. <\/p>\n\n\n\n<p>Need information for your own area? State natural resources\ndepartments and local fire stations have information specific to local\nprevention and mitigation. Here are some general recommendations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Home Maintenance for Fire Prevention<\/strong><\/h2>\n\n\n\n<p>Homeowners who live in fire-prone areas should:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Use fire-resistant siding and roofing, and\ngutters with closed eaves. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Regularly clean out the gutters and maintain the\nroof.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Install double-paned windows to <a href=\"https:\/\/ucanr.edu\/sites\/fire\/Prepare\/Building\/Windows\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">prevent window failures in case of fire<\/a>. Properly chosen windows keep glass from breaking or a frame from catching fire, thus keeping fire or embers from getting into a house.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Remove firewood from the areas around windows. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Clear dry foliage around the home and other\nstructures, and cut back overhanging trees.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Use weather stripping and mesh to seal doors and\nvents from embers.<\/li><\/ul>\n\n\n\n<p>Often, homes are set on fire by&nbsp;stray embers or by <a href=\"https:\/\/www.vcstar.com\/story\/news\/local\/2019\/11\/09\/woolsey-fire-california-wildfire-homes-simi-valley-los-angeles\/4027690002\/\" target=\"_blank\" rel=\"noreferrer noopener\">ember storms<\/a>. The interior of a home can start burning once\nembers get through an open chimney, a vent, or a crack in a window.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Thinking Ahead<\/strong><\/h2>\n\n\n\n<p>Out-of-control fires destroy woods and animal habitat, and\nthreaten human lives. By the time a wildfire burns out, it can ruin thousands\nof woody acres. For homeowners and renters, fire hazards in a hot climate need\nto be known and addressed. Action is needed from state and federal\nlegislatures.<\/p>\n\n\n\n<p>It\u2019s also an issue to put on our personal radar.
