Thousands of homeowners \u2014 most of Maine\u2019s\nresidents who receive Social Security benefits \u2014 will be eligible for the\nbenefit. The provision, LD 1638, takes effect on Oct. 18, 2021. There is a\ncatch for these eligible owners, though. <\/p>\n\n\n\n<p>Here\u2019s the story. <\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Tax Bills Rising All Over<\/h2>\n\n\n\n<p>Homeowners pay into property taxes based on their homes\u2019 assessed values. This year, <a href=\"https:\/\/magazine.realtor\/daily-news\/2021\/08\/26\/property-taxes-are-about-to-rise#:~:text=Property%20taxes%20are%20expected%20to,homeowners%20appeal%20property%20tax%20bills.&amp;text=Property%20taxes%20are%20usually%20calculated,rise%2C%20they%20often%20do%20too.\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">property taxes are going up<\/a> all over the country at a rate exceeding 6% \u2014 higher than 2020\u2019s 4%. Residents in some states are paying more in property taxes than they pay on their mortgages. Of course, once a mortgage is paid off, the property tax bill is a major ongoing payment, together with homeowner\u2019s insurance and general upkeep. <\/p>\n\n\n\n<p>Even where property valuations stop rising or begin to\ndecline, homeowners can still get hit with rising property taxes. The cost of municipal\nservices can go up. Commercial property owners might lose value, leave the\narea, or otherwise fall short of paying enough to cover what townships need to\nmake a budget work. It then falls to the residential properties to pick up the\nslack. <\/p>\n\n\n\n<p>In other words, while rising home values are the usual cause\nfor property tax hikes, they\u2019re not the only impetus. <\/p>\n\n\n\n<p>When property taxes get out of hand, resident protests\nbecome more common. Maine became one\nof the especially desirable places to live. Portland received a steady influx\nof people from other states. And South Portland is experiencing rapid\ngentrification in the midst of the home buying frenzy. Statewide, buyers have\nbeen waiving contingencies and bidding against each other, driving valuations\nsky high. <\/p>\n\n\n\n<p><a href=\"https:\/\/www.pressherald.com\/2021\/05\/09\/pandemic-fueled-real-estate-boom-threatens-property-tax-hikes-for-maine-homeowners\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Property revaluations and new tax assessments<\/a> have kept rolling, tracking the stunning boom in property values. Local governments are using updated assessments, now reflecting soaring market valuations, to calculate their residents\u2019 property taxes. <\/p>\n\n\n\n<p>As homeowners&#8217; tax bills are rising 10 to 50 percent, Maine\nresidents are being squeezed to their financial limits. And that\u2019s in addition\nto the health and income struggles they may have had with virus-related shutdowns\nand slowdowns. <\/p>\n\n\n\n<p><strong><em>\u261b Under 36 Maine Revised Statutes \u00a7 151, Maine homeowners have 60 days from when they receive their tax assessments to request that the revenue department <\/em><\/strong><em><a href=\"https:\/\/www.maine.gov\/revenue\/about\/taxpayer-rights\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">reconsider the tax determination<\/a><\/em><strong><em>. <\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Impact on Maine Seniors <\/h2>\n\n\n\n<p>Maine has more than 300,000 residents aged 65+. Some are\naffluent. Some are not. Looking at the latter group:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>More than a fourth of Maine\u2019s senior population\nis living in low-income households. <\/li><li>More than a third of Maine residents aged 65+ depend\nsolely on Social Security benefits, with an average income of just over $18,000.<\/li><li>In Maine, women aged 65+ are especially likely\nto manage their homes by themselves. <\/li><li>Female seniors who live alone and have incomes\nbelow the median lack the financial resources to cover the basic staples of\nliving.<\/li><li>Struggling homeowners usually have no way to\nfind more affordable housing, as Maine is short 9,000 affordable homes needed\nby older residents.<\/li><\/ul>\n\n\n\n<p>As Maine home values keep rising, households relying on\nSocial Security are having trouble juggling basic expenses with their rising\nproperty taxes. As a general matter, these homeowners refuse to go into default\non their taxes. Some decide to skip meals or skimp on heat so they can cover\nthe tax bills.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Maine Must Address the Issue<\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/08\/maine-must-address-the-issue.jpg\" alt=\"Image of a person sitting outside in front of a garden in Maine.\" class=\"wp-image-1651\" width=\"288\" height=\"235\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/08\/maine-must-address-the-issue.jpg 384w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/08\/maine-must-address-the-issue-300x245.jpg 300w\" sizes=\"auto, (max-width: 288px) 100vw, 288px\" \/><\/figure><\/div>\n\n\n\n<p>One hundred years ago, people had a <a href=\"https:\/\/u.demog.berkeley.edu\/~andrew\/1918\/figure2.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">life expectancy<\/a> of about 60 years of age. Today, people look forward to living 80 years or more. And our preference across the country is to spend our later years in the comfort of our own homes. <\/p>\n\n\n\n<p>But here\u2019s the rub. Paying for home-based improvements and\nliving assistance will compete with covering our property taxes. This is\nalready becoming an urgent issue for the Maine. <\/p>\n\n\n\n<p>Rather than tax retirees out of their Maine homes, Sen. Donna Bailey, chief sponsor of LD 1638, said the state must step in now and act to keep the townships from deeming elder homeowners delinquent in their taxes. Lawmakers across the state agree. The new provision received strong support in both the House and Senate of Maine\u2019s legislature. Granted, Maine did have optional provisions for municipalities to offer their residents <a href=\"https:\/\/www.maine.gov\/revenue\/taxes\/tax-relief-credits-programs\/property-tax-relief-programs\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">property tax relief<\/a>. But LD 1638 forms a sturdier, statewide safety net. <\/p>\n\n\n\n<p>Sen. Bailey notes that LD 1638 law will not cap any\nhomeowner\u2019s property tax deferral allowance. Nor will seniors face a \u201cfunds\nhave run out\u201d cut-off point on the benefit. The state will use federal Covid-19\nrelief money to cover the taxes. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Tax Deferral, Not Forgiveness<\/h2>\n\n\n\n<p>This is not the first time the property tax challenge has\ncome up at the state level. Last time, the state created a property tax\ndeferral option that only lasted two years. It fell by the wayside in the 1991\nrecession. Can the new law be an enduring solution? Likely so. A companion bill,\nLD 1733, allocates more than $3 million in federal relief money over the next\ntwo years to a new Senior Tax Deferral Revolving Account. That might not seem\nlike a lot, but account funds will later be replenished by Housing\nOpportunities for Maine (HOME). Run by the Maine State Housing Authority, HOME\nreceives continual income from property transfer taxes. <\/p>\n\n\n\n<p>In any case, Maine property taxes will be deferred, not\nforgiven, for eligible homeowners. Under the new state law, the funds will be\ntied to a liens on the homes. Maine will cover taxes now, and then after the\nhomeowner passes away, the government will place an assessment on the estate. As\nelderly Maine residents pass, property tax liens will continually be paid back\nto the state.<\/p>\n\n\n\n<p>So, there\u2019s no free lunch for seniors and their families.\nBut at least this solution lets Maine residents stay in their homes while they\nlive. We can expect to see more states creating solutions for their older\nresidents as property taxes continue their upward climb.<\/p>\n\n\n\n<p><strong>Supporting References<\/strong><\/p>\n\n\n\n<p class=\"has-small-font-size\">State of Maine Legislature.
