In some notable updates for 2021-2022, Connecticut, New York, Massachusetts, Illinois and Texas are confronting tackling race-based covenants in deeds. Parallel provisions are already available in a handful of states, including Florida, Maryland, <a href=\"https:\/\/blog.caionline.org\/removing-discriminatory-covenants-in-hoa-documents\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Utah<\/a>, and <a href=\"https:\/\/www.deeds.com\/articles\/race-restrictions-still-appear-on-deeds-theres-a-movement-afoot-to-delete-them\/\">Washington<\/a>.<\/p>\n\n\n\n<p>And, in what might be a nationwide first, the state of\nOregon is prohibiting the practice of writing \u201clove letters\u201d to sellers in\norder to win in the home-buying arena.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Confronting the\nRemnants of Segregation<\/strong><\/h2>\n\n\n\n<p>As we\u2019ve previously noted, the language of <a href=\"https:\/\/www.deeds.com\/articles\/is-a-hurtful-deed-restriction-lurking-in-your-deed\/\">racial\nexclusion on real estate deeds<\/a> is an all-too-common problem. <\/p>\n\n\n\n<p>Of course, not all <a href=\"https:\/\/www.deeds.com\/articles\/deed-restrictions-how-they-impact-homeowners-and-communities\/\">deed\nrestrictions<\/a> are illegitimate. Various types of restrictions legally limit\nthe kind, size or number of things that may be built on a property. They set\nforth permissible lot sizes.<\/p>\n\n\n\n<p>They notify buyers of easements, acceptable and unacceptable\nland use, and so forth. But not all deed restrictions focus on limiting things\nor activities. Some have disadvantaged certain groups of people to the advantage\nof others. For a long time, the courts and the real estate industry went along\nwith this. <\/p>\n\n\n\n<p>The buck stopped on May 3, 1948, when the&nbsp;<a href=\"https:\/\/tile.loc.gov\/storage-services\/service\/ll\/usrep\/usrep334\/usrep334001\/usrep334001.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">U.S. Supreme Court held racially restrictive covenants unenforceable<\/a>&nbsp;under the 14th&nbsp;Amendment. Two decades later, the&nbsp;Fair Housing Act outlawed racial discrimination in housing. <\/p>\n\n\n\n<p>While language forbidding certain groups to move into homes\nand subdivisions is known to be unenforceable, it wasn\u2019t deleted from the\ndeeds. The doctrine of \u201ccovenants running with the land\u201d seemed to mean these\nclauses were etched in the chain of title forever. The question many people are\nasking today is this: If federal and state law rejects and renders these\nclauses unenforceable, why must they be allowed to linger uncorrected in the\nproperty records? <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Connecticut\nVoids Race Identifiers in Legal Documents&nbsp; <\/strong><strong><\/strong><\/h2>\n\n\n\n<p>Legal advocacy to denounce \u201cwhites-only\u201d and similar\nlanguage is surging this year and one of the places it\u2019s happening is\nConnecticut.<\/p>\n\n\n\n<p>David Ware, a lawyer raised in Manchester, Connecticut,\nfound out that a clause supporting racial segregation existed in his family\nhome deed, and in the deeds of several nearby subdivisions created in the\n1940s. Ware further learned that Connecticut lacked any method to remove or\ndenounce the language. Ware set out to work on a possible law that would\ndeclare these clauses void by Connecticut. <\/p>\n\n\n\n<p>Fast-forward to Jul. 1, 2021<em>. An Act Concerning the Removal\nof Restrictions on Ownership or Occupancy of Real Property Based on Race and\nElimination of the Race Designation on Marriage Licenses <\/em>became law in\nConnecticut. Under the new law, also known as HB 6665, homeowners who find\nrace-based restrictions in their deed may have an affidavit recorded in their\nhome\u2019s county, addressing and renouncing the clause.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.caionline.org\/Advocacy\/LAC\/CT\/Documents\/2021%20End%20of%20Session%20Report%20CT.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">As enacted<\/a>, the law impacts deed recording in the following ways:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The law expressly prohibits race-based deed\nrestrictions.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>The law allows for the official removal of\ndiscriminatory covenants from documents in the land records throughout\nConnecticut. Individual homeowners may file \u2014 at no charge and with no need for\nprofessional assistance \u2014 a notarized document with their county recorder that\nexpressly says the racial restriction is void. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>The law offers a legal method for homeowners\u2019 associations to vote to amend their governing documents accordingly. The <a href=\"https:\/\/blog.caionline.org\/removing-discriminatory-covenants-in-hoa-documents\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Community Associations Institute<\/a> backs this measure. CAI insists the action should <em>not<\/em> require a majority vote of approval from homeowners. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Land of Lincoln Steps Up<\/strong><\/h2>\n\n\n\n<p><a href=\"https:\/\/www.senatoradrianejohnson.com\/news\/press-releases\/88-homeowners-can-eliminate-racist-restrictive-covenants-from-their-property-deeds-under-new-johnson-law\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Illinois State Senator Adriane Johnson<\/a> also thinks \u201c[h]omeowners shouldn\u2019t have to jump through hoops to strike such harmful and antiquated provisions from their property records.\u201d<\/p>\n\n\n\n<p>So, a <a href=\"https:\/\/www.wandtv.com\/news\/racist-covenants-can-be-removed-from-property-deeds-in-new-il-law\/article_c748e10a-ec02-11eb-9581-8b1b8f001d59.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">new Illinois law<\/a> makes a form available for individuals and homeowners\u2019 associations to submit to their county recorders. Real estate instruments, deeds included, can have the language taken off in the recorder\u2019s office. The maximum fee that can be charged for a <em>restrictive covenant modification <\/em>is $10.<\/p>\n\n\n\n<p>This is HB 58, and it is effective in Illinois on Jan. 1,\n2022.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>New\nYork Gets Serious About Ending Race-Based Exclusion<\/strong><\/h2>\n\n\n\n<p>A bill is pending in&nbsp;<a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2021\/A6152\" target=\"_blank\" rel=\"noreferrer noopener\">New\nYork<\/a> to address restrictive covenants. It targets transfers of title, and\nis triggered during the sale process of deeds with restrictive covenants that\n\u201cdiscriminate on the basis of race, color, religion, sex, sexual orientation,\nfamilial status, marital status, disability, national origin, source of income\nor ancestry.\u201d <\/p>\n\n\n\n<p>Once the provision becomes law, before closing on a real\nestate sale the seller must give buyer a <em>restrictive covenant modification document.<\/em>\nCondo properties must \u201cdelete or amend\u201d the offending&nbsp;restrictions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Texas Wrangles With Racial Restrictions<\/strong><\/h2>\n\n\n\n<p><a href=\"https:\/\/capitol.texas.gov\/tlodocs\/87R\/billtext\/html\/SB00222I.htm\" target=\"_blank\" rel=\"noreferrer noopener\">SB 222 in Texas<\/a> amends the state Property Code to direct\ncounty clerks to remove void, discriminatory language from deeds. Texas already\nhas a law, enabling <em>courts<\/em> to remove the unconstitutional language from\nreal estate deeds. SB 222, though, offers a way to address the problem with a\nform at the county clerk\u2019s office \u2014 not by having to resort to a court action.\n&nbsp;<\/p>\n\n\n\n<p>Under SB 222, the deed recorder, within a month of receiving\na new deed or real estate instrument for recording, will delete any void\nclauses and attach a statement explaining the change. If a resident has\napproached the recorder\u2019s office but the language is not void (per the\nrecorder\u2019s determination), then the recorder will inform the resident that the\nlanguage has not been removed. By Dec. 1, 2021, the Texas Attorney General\u2019s office\nwill make the request forms available, so that action can be taken from Jan. 1,\n2022 on.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Oregon to Spurn Home Buyers\u2019 Love Letters<\/strong><\/h2>\n\n\n\n<p>In a national first, Oregon has outlawed home buyers\u2019 \u201clove\nletters\u201d to sellers. The new law, <a href=\"https:\/\/www.jacksonlewis.com\/sites\/default\/files\/docs\/Oregon-2021-HB2550-Enrolled.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">HB 2550<\/a>, is to take effect New Year\u2019s Day 2022. <\/p>\n\n\n\n<p>What are love letters? In a competitive market, some buyers\nwrite to sellers to present themselves as the perfect new homeowners. The&nbsp;<a href=\"https:\/\/www.nar.realtor\/fair-housing-corner\/love-letters-or-liability-letters\" target=\"_blank\" rel=\"noreferrer noopener\">National Association of REALTORS\u00ae<\/a>&nbsp;has discouraged the\npractice, because photos and letters from homebuying hopefuls might be taken, \u201cknowingly\nor through unconscious bias, as an unlawful basis for a seller\u2019s decision to\naccept or reject an offer.\u201d Oregon clearly agrees.<\/p>\n\n\n\n<p>The new law sets out to ensure seller avoid picking a buyer\nbased on \u201crace, color, religion, sex, sexual orientation, national origin,\nmarital status or familial status as prohibited by the Fair Housing Act.\u201d To\nthis end, Oregon real estate agents for sellers may not accept any personal\ndocuments coming from buyers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Williamstown, Massachusetts Stands Up for Respect\u2026<\/strong><\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright\"><img loading=\"lazy\" decoding=\"async\" width=\"258\" height=\"322\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/09\/stands-up-for-respect.jpg\" alt=\"Person sitting on a bench outside looking at a computer.\" class=\"wp-image-1663\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/09\/stands-up-for-respect.jpg 258w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/09\/stands-up-for-respect-240x300.jpg 240w\" sizes=\"auto, (max-width: 258px) 100vw, 258px\" \/><\/figure><\/div>\n\n\n\n<p>Residents of a subdivision in Williamstown, Massachusetts,\nwhich is a three-hour drive or six-hour train ride from Boston, can look\nforward to a new provision letting them strike out race-based exclusionary\nlanguage stuck in their property deeds in the 1940s. The restriction states:\n\u201cNo persons of any race other than the white race shall use or occupy any\nbuildings or any lot, except that this covenant shall not prevent occupancy by\ndomestic servants of a different race domiciled with an owner or tenant.\u201d<\/p>\n\n\n\n<p>Residents first added news language promoting inclusion.\nThen, in 2020, they went further, working for a law to allow the offensive\nlanguage to be deleted. A bill is under consideration in Massachusetts do make\nit possible.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u2026And a Note From North Carolina<\/strong><\/h2>\n\n\n\n<p>A comprehensive initiative from North Carolina\u2019s Division of\nArchives and Records and the University of North Carolina Greensboro Libraries\nwill offer a public search service so people can research the histories of\nenslaved people across the state. <\/p>\n\n\n\n<p>As part of this major work, students and historians at Shaw\nUniversity in Raleigh, NC are working with the Wake County Register of Deeds on\n<em>The Enslaved Persons Project<\/em>. Their goal? To create a catalogue of bills\nof sale and property deeds. Often, these were the only legal documents related\nto enslaved people.
