(Business trusts are governed by Chapter 39, Article 8 of\nthe General Statutes.)<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>A trust is an alternate method of holding\ntitle to real property. In a trust arrangement, a settlor transfers property to\nanother person (the trustee) during his lifetime (NCGS \u00a7 36C-4-401(1)). In a\nliving trust, which takes effect during the settlor\u2019s lifetime, the settlor\ngenerally also acts as the trustee. The trustee holds title for the benefit of\nanother person or class of people, called the beneficiary. A valid trust must\nhave a definite beneficiary, as specified in \u00a7 36C-4-402(a)(3). <\/p>\n\n\n\n<p>The trust is administered by the trustee\naccording to the provisions of the trust instrument. The trust instrument is an\nunrecorded document, which means the settlor\u2019s estate plans remain private\n(unlike a will). Under \u00a7 36C-8-815(a)(2)(a), the trustee has all the general\npowers \u201cover the trust property that an unmarried competent owner has over\nindividually owned property,\u201d unless limited by the terms of the trust, along with\nspecific powers outlined in \u00a7 36C-8-816. <\/p>\n\n\n\n<p>When real property is transferred into\ntrust with a deed executed by the settlor, it is titled in the name of the\ntrustee on behalf of the trust. Sometimes title is transferred erroneously to\nthe trust as grantee instead of to the trustee; \u00a7 39-6.7 specifically addresses\ntitling of transfers to and from trusts.<\/p>\n\n\n\n<p>To convey an interest in real property held in trust in the State of North Carolina, the trustee uses either a <a href=\"https:\/\/www.deeds.com\/forms\/north-carolina\/warranty-deed\/\">general warranty deed<\/a>, a <a href=\"https:\/\/www.deeds.com\/forms\/north-carolina\/special-warranty-deed\/\">special warranty deed<\/a>, or a <a href=\"https:\/\/www.deeds.com\/forms\/north-carolina\/quitclaim-deed\/\">quitclaim deed<\/a>, depending on the situation. Depending on the situation, other parties with interest in the property may need to join the deed in order to waive their rights. Consult a lawyer with questions about the appropriate level of warranty for the transaction.<\/p>\n\n\n\n<p>A general warranty deed carries the\nbroadest warranty that the granting party will defend the title against the\nclaims of all persons, while a special warranty deed guarantees that the\ngranting party will defend the title only against claims arising under, by, or\nthrough the grantor. North Carolina also recognizes a non-warranty deed \u2013 also\nknown as a quitclaim deed \u2013 which, as the name suggests, conveys only the\ngrantor\u2019s interest, if any, with no warranties of title.<\/p>\n\n\n\n<p>Conveyances may also be named after the\ngranting party (such as \u201ctrustee\u2019s deed\u201d), but such deeds are functionally\nequivalent to deeds named after the type of warranty they convey. (Note: In\nNorth Carolina, another type of trustee\u2019s deed, or a substitute trustee\u2019s deed,\nis used to convey real property sold upon foreclosure under a deed of trust.) <\/p>\n\n\n\n<p>In addition to meeting all requirements for form and content for any conveyance of real property in the State of North Carolina, a deed executed by the trustee should name all acting trustees as grantors, as well as the trust on behalf of which they are acting.
