The <a href=\"https:\/\/www.energy.gov\/eere\/solar\/solar-energy-united-states\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Energy Department<\/a> notes that rooftop solar costs been halved\nsince 2014, and system installations are surging across the country. Sunrun and\nSolarCity (now part of Tesla) are leading that growth. <\/p>\n\n\n\n<p>Climate-connected reasons aren\u2019t necessarily in the\nforefront of homeowners\u2019 minds when they go for it. A lot of the impetus\ninvolves blackouts after storms. Households seeking independence from\noverburdened grids are looking to generators, wall batteries, solar panels and tiles.\n&nbsp;<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Empowered Households<\/strong><\/h2>\n\n\n\n<p>The February 2021 Texas freeze was the last straw for some.\nInterest is home solar power systems spiked in the midst of the long,\nlife-threatening outages. Indeed, blackouts are becoming increasingly common\nchallenges for homeowners across the continent.<\/p>\n\n\n\n<p>Home buyers are, in a sense, taking back their power. A home\nbuyer at Alset EHome\u2019s Northpark community in Texas receives battery storage\nand car charging equipment \u2014 and&nbsp;even a <a href=\"https:\/\/cleantechnica.com\/2021\/06\/24\/alset-ehomes-is-building-homes-with-tesla-solar-and-a-tesla-vehicle-included\/\" target=\"_blank\" rel=\"noreferrer noopener\">Tesla car<\/a>.&nbsp;The draws for buyers are multifaceted:\nfreedom from overworked power grids, lowered household costs over time, climate\nawareness, and the sense of being early adopters of high-tech energy sources. <\/p>\n\n\n\n<p>Tesla Energy and Dacra are working with Brookfield Asset\nManagement on a new development in Austin, too.&nbsp;<a href=\"https:\/\/bam.brookfield.com\/press-releases\/2021\/07-09-2021-200014929\" target=\"_blank\" rel=\"noreferrer noopener\">Brookfield Asset Management<\/a>&nbsp;has announced the project\nas \u201cthe nation\u2019s most sustainable residential community.\u201d Solar-forward housing\ndevelopments could funnel surplus energy into the areas around them, creating\nmajor solar hubs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Incentives for Home Solar<\/strong><\/h2>\n\n\n\n<p>Solar panel systems can reduce household electricity costs while\nsupporting reliable, uninterrupted power. Sweetening the deals still further\nare rebates and incentives for making the solar shift.<\/p>\n\n\n\n<p>In addition to manufacturer rebates on some home systems, there are various state and city <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/freedomsolarpower.com\/solar-rebates-and-incentives\" target=\"_blank\">renewable residential energy credits<\/a> (they vary, depending when the buyer makes the shift), and the\u00a0<a href=\"https:\/\/freedomsolarpower.com\/blog\/how-does-the-solar-tax-credit-work-the-ultimate-guide\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">federal tax credit<\/a> \u2014 a 26%\u00a0break on the price of installation.<\/p>\n\n\n\n<p>Home solar systems can fully pay for themselves in a few years.&nbsp;Granted,\nmuch depends on the state where the home is. States are still all over the\nplace with their approaches. Solar incentives vary even within states \u2014 for\nexample, among <a href=\"https:\/\/www.pv-tech.org\/new-jersey-unveils-details-of-new-solar-incentives-to-support-3-75gw\/\" target=\"_blank\" rel=\"noreferrer noopener\">New Jersey homeowners<\/a>. <\/p>\n\n\n\n<p>In some states, such as <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.solarunitedneighbors.org\/virginia\/learn-the-issues-in-virginia\/solar-incentives-in-virginia\/srec-incentives-for-virginia-solar-owners\/\" target=\"_blank\">Virginia<\/a>, utilities companies must offset their carbon emissions, so they buy Solar Renewable Energy Credits (SRECs) from solar power producers. Homeowners can get in on this, and augment the returns on their solar investments. Sometimes solar incentives lose steam. Although <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=CIV&amp;sectionNum=714\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">California law<\/a>\u00a0sets forth state residents\u2019 rights to use solar power, in March 2021,\u00a0the state faced a <a rel=\"noreferrer noopener\" href=\"https:\/\/www.bloomberg.com\/news\/articles\/2021-03-16\/california-utilities-propose-reduced-payments-for-rooftop-solar\" target=\"_blank\">proposal<\/a>\u00a0from utility companies to pay less to rooftop solar owners, alas \u2014 and to add a new fee for connecting the systems. <\/p>\n\n\n\n<p>What about the heroes of our story? For the residents of Peoria, things aren\u2019t looking so sunny.\u00a0In 2016, Illinois passed the Future Energy Jobs Act, lowering home solar costs by thousands of dollars. Great! Except that the law was underfunded, and state incentives crumpled in the face of resistance from\u00a0<a href=\"https:\/\/chicago.suntimes.com\/politics\/2021\/6\/4\/22517456\/prairie-state-coal-plant-energy-bill-illinois-legislature-green-energy-air-pollution-fossil-fuels\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">fossil fuel companies<\/a>. Illinois funding woes also mean layoffs for solar technicians statewide.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Restrictive Covenants Versus Solar Access Rights<\/strong><\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/09\/restrictive-covenants-versus-solar-access-rights.jpg\" alt=\"Image of a house with solar panels.\" class=\"wp-image-1703\" width=\"379\" height=\"568\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/09\/restrictive-covenants-versus-solar-access-rights.jpg 505w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/09\/restrictive-covenants-versus-solar-access-rights-200x300.jpg 200w\" sizes=\"auto, (max-width: 379px) 100vw, 379px\" \/><\/figure><\/div>\n\n\n\n<p>Can people who own homes and condos in homeowners\u2019\nassociations (HOAs) go solar? That is, can a unit owner place solar panels on \u201ccommon\nelements\u201d of a multi-unit property?<\/p>\n\n\n\n<p>Some association say panels mar the aesthetics of the\nbuildings, so they\u2019re ruled out (although tiles might be acceptable). Some\ndelegate the call to the architectural review groups. Some HOAs argue that\nproperty values will be impacted when owners start installing solar panels. (This\nis not a strong argument, in light of the U.S. Energy Department\u2019s observation\nthat renewable electricity <a href=\"https:\/\/www.energy.gov\/eere\/solar\/downloads\/solar-homes-sell-premium\" target=\"_blank\" rel=\"noreferrer noopener\">raises a property\u2019s value<\/a>.)&nbsp;<\/p>\n\n\n\n<p><a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.wavy.com\/news\/local-news\/chesapeake\/investigation-fight-for-light-between-homeowners-and-associations-over-solar-power-despite-new-law\/\" target=\"_blank\">Virginia<\/a>\u00a0got out ahead of the arguments in 2020, forbidding HOAs or architectural review boards from making owners remove or reposition their solar panels if the change diminishes power or raises homeowners\u2019 costs significantly. <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/programs.dsireusa.org\/system\/program\/detail\/4#:~:text=Oregon's%20solar%20access%20laws%20date,systems%20are%20void%20and%20unenforceable.\" target=\"_blank\">Oregon residents<\/a> have had the right to solar access since 1979. Today, more than half the states ensure solar access. This means associations and boards may not prohibit homeowners from using solar energy systems. (Owners might still need to <a href=\"https:\/\/www.linkedin.com\/pulse\/what-can-hoa-do-those-solar-panels-being-installed-chris\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">apply and follow reasonable direction from boards<\/a> before going ahead with installations.) <\/p>\n\n\n\n<p>So, a condo buyer should look into a few questions before\nplanning to go solar:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Does\nthe state have a solar rights law, preventing the need to butt heads with the\nassociation or review board?<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Does\nthe development have deed <a href=\"https:\/\/www.deeds.com\/articles\/deed-restrictions-how-they-impact-homeowners-and-communities\/\">rules,\ncovenants, or restrictions<\/a> could get in the way of installation, cleaning, repairs,\nreplacement or removal of the home solar equipment?<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Who\ncovers roof maintenance costs? Are they higher for owners with solar panels?<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Is there an allowance for <a href=\"https:\/\/www.hoamanagement.com\/hoa-solar-panels\/#Homeowner\u2019s_Right_to_Install_Solar_Panels\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">solar easements<\/a>, so the system can work to its full potential? For example, other homeowners might need to avoid obstructing the sunlight that hits the solar panels. An easement can ensure a lasting arrangement.<\/li><\/ul>\n\n\n\n<p>Wisconsin\u2019s laws bar subdivisions from placing any significant restrictions (other than a permit application) on the installation or use of wind or solar power, assuming there are no public health or safety issues.\u00a0<a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/docs.legis.wisconsin.gov\/statutes\/statutes\/70\/111\/18\" target=\"_blank\">Wisconsin law<\/a>\u00a0voids such restrictions, and also exempts owners of renewable energy systems from taxation on a system\u2019s value. South Carolina is also working on legislation to <a href=\"https:\/\/www.scstatehouse.gov\/sess124_2021-2022\/bills\/3979.htm\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">make HOA anti-renewable deed restrictions void<\/a>.<\/p>\n\n\n\n<p>In contrast, the <a href=\"https:\/\/www.caionline.org\/Advocacy\/Priorities\/SolarRestrictions\/Pages\/default.aspx\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Community Associations Institute<\/a> (CAI) \u201copposes government and interest group efforts to override community policy or deed restrictions on single interest issues\u201d and insists that \u200bcondo associations are \u201cthe best mechanism to enact sustainable environmental policies.\u201d So, if the state doesn\u2019t have a strong set of provisions for renewables, buyers should anticipate arguments from associations that don\u2019t give solar roofs affirmative support. <\/p>\n\n\n\n<p><strong><em>Pro tip:<\/em><\/strong>You\u2019ll likely find the greenest policies in states that let jurisdictions prohibit HOAs from obstructing home solar installations. They\u2019re listed on the <a href=\"https:\/\/www.caionline.org\/Advocacy\/Priorities\/SolarRestrictions\/Pages\/default.aspx\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Community Associations Institute<\/a> website.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Covered by Homeowner\u2019s Insurance?<\/strong><\/h2>\n\n\n\n<p>Rooftop solar systems can run\ninto the five figures. In the unusual event of damage to the system, homeowners\nmight understandably ask if insurance covers the costs of repair or replacement.\n<\/p>\n\n\n\n<p>Many homeowners\u2019 policies do cover solar equipment without\nthe need for adding coverage. Rooftop&nbsp;panels or tiles&nbsp;are often\ndeemed permanent fixtures, and might have no claim limit. <\/p>\n\n\n\n<p><strong><em>Pro tip:<\/em><\/strong> Ask your agent about what parts are\ncovered, what deductibles may apply, and what types of damage is excluded.\nLearn how to get the most from your policy before deciding on a system that\nmeets your needs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Many Reasons to Consider Home Solar <\/strong><\/h2>\n\n\n\n<p>Achieving serious reductions in home-generated greenhouse\ngas is just one (very important) reason to adopt solar power. As you can see,\nsolar power does have quite a few more points going for it. <\/p>\n\n\n\n<p>State laws are helping homeowners who wish to move in a solar-forward direction. <a href=\"https:\/\/www.solarunitedneighbors.org\/indiana\/learn-the-issues-in-indiana\/homeowners-associations-and-solar-access-in-indiana\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Activist groups<\/a> are also trying to push renewables (and homeowners\u2019 rights) forward.
