Some buyers might try to make offers despite\npending deals, eager to be runners-up just in case a sale doesn\u2019t make it to\nclosing. Here\u2019s what to know about pending offers, and whether a pending home\ncould still be available.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\"><strong>First, What Is \u201cPending\u201d in a Real Estate Deal?<\/strong><\/h2>\n\n\n\n<p>When a real estate seller and buyer agree on the terms of a\ndeal, the buyer\u2019s offer becomes <em>pending.<\/em>&nbsp;At this stage, the buyer will\nhave an appraisal and inspection done. The mortgage company will get ready to\nreview all known aspects of the home and the offer, in preparation for issuing\nthe final loan approval. <\/p>\n\n\n\n<p>The word <em>pending<\/em> generally stops further queries on\nthe home from buyers. When housing demand is very strong, though, some buyers\nmay wonder\u2026 <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Can a Buyer Still Make an Offer on a Home in <em>Pending <\/em>Status?<\/strong><\/h2>\n\n\n\n<p>And the answer is\u2026 Probably. The home might be listed as <em>accepting\nbackup offers<\/em> or&nbsp;<em>continuing to show<\/em> or otherwise <em>active <\/em>in\nthe Multiple Listing Service. Those are the clearest cues that backup offers\nare welcome. Tours \u2014 at least virtual tours \u2014 may still be available; the\nseller\u2019s agent will have specific information. <\/p>\n\n\n\n<p>To make a backup offer, the seller must prepare to follow\nthrough with it, and be ready to actually buy the home if the current deal\nfalls through. A backup offer is a contractual agreement.<\/p>\n\n\n\n<p>A hopeful buyer who is permitted to submit a backup offer\ncan, because the offer is binding, be immediately considered for the home if\nthe party who made the pending offer doesn\u2019t get to closing. Then, if the\ncurrent deal falls apart, the seller can proceed to the backup buyer without\nhaving to relist the home. Nice!<\/p>\n\n\n\n<p>Sometimes, if a home keeps showing <em>sale pending<\/em> in\nthe MLS for a prolonged period, the real estate website might be showing\nobsolete information. Usually,<em> pending<\/em> is\nthe last phase before closing. This means a runner-up buyer has a better chance\nof getting a <em>contingent <\/em>home than a home listed as <em>pending<\/em>.<\/p>\n\n\n\n<p>A<em>&nbsp;contingent&nbsp;<\/em>sale is one where the buyer\nnamed on the contract has offered a price, the seller has accepted, and the\nlisting is still on the MLS in case one or more of the contract\u2019s contingencies\ndoesn\u2019t work out. Getting to closing could hinge on a good report from a\nprofessional home inspector, or an&nbsp;appraisal that comes in and vouches for\nthe parties\u2019 agreed price. <\/p>\n\n\n\n<p>The buyer might set other contingencies \u2014 such as only\nclosing on the deal after getting a final loan approval. Or the buyer might make\nthe deal contingent on successfully selling their current home.<\/p>\n\n\n\n<p>Both the home\u2019s hopeful buyer and its current owner\nshould&nbsp;negotiate for contingencies and be sure they appear in the\ncontract, in order to reduce exposure to risks. Having a real estate agent on\neach side of the transaction is important, as local agents guide the\ncontingencies in each of their client\u2019s best interest. So, a contingency clause\nin a contract releases a party&#8217;s duty to go through with the deal if that\nagreed-upon expectation is not filled (or waived, to allow closing to proceed).\n<\/p>\n\n\n\n<p>This saves money! A contingency clause can relieve the buyer\nof penalties for backing out based on the reason specified in the contingency\n(for example, if a problematic inspection report comes back). Still, the appraisal and inspection\nprocesses have to hold up to any contingencies spelled out in their contract.\nAs the deal is not yet done, the seller might be open to backup offers from\nadditional hopeful home buyers. <\/p>\n\n\n\n<p>Even after all contingencies in the agreement are met, and\nthe sale status switches to pending, the buyer can still back out. Granted, few\nbuyers back out at the pending stage. In most cases of deals falling through,\nit\u2019s about contingencies not being met. The point is: No deal is final until\nthe parties sit down and close the deal.<\/p>\n\n\n\n<p>So, when will it all be done and final? A typical home sale takes\nunder two months. Somewhere within the 30- to 45-day range, the parties should\nbe able to sit down at the table. In a popular area, during a brisk market,\ngetting to closing could happen as soon as two weeks from the time the parties\nentered into a contract. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How Could a Home Purchase Deal Fall Apart?<\/strong><\/h2>\n\n\n\n<p>Why would the parties cancel their contract? Often, it\u2019s\nbecause the lender did not issue its final approval, so the financing\ncontingency has not been met. Being pre-approved for a loan does not always\nmean <em>getting <\/em>the loan. Perhaps the appraisal indicates that home isn\u2019t\nworth what the parties agreed to pay. A bank could decide that the asset\nsecuring the loan was not valued correctly, and the loan can\u2019t be issued.<\/p>\n\n\n\n<p>Perhaps the buyer is forced into a job change or loss of\nemployment in the days leading up to the closing date. Or the buyer, in a\nmoment of irrational exuberance, could make a large purchase using a credit\ncard, torpedoing a formerly intact credit profile. <\/p>\n\n\n\n<p>Or perhaps the buyer simply has not been able to sell a\ncurrently owned home.<\/p>\n\n\n\n<p>Home inspections can become real issues for the contingency\nphase. If any substantial safety or repair issue turns up during the\nprofessional inspection, the deal could fall apart. Given the greater room for\nsubjectivity over the home inspection, an inspection report can be a point of\ncontention. Buyers eager for prompt closings may read them flexibly. Other\nbuyers may stand firm over necessary repairs or rely on problems in the\ninspection report to walk away from a deal during the contingency period. Sometimes,\nthe buyer has found another, more appealing house they\u2019d like to buy.\nSubstantial problems on the inspector\u2019s report can present reasonable ways to\nget out of the deal without penalty.<\/p>\n\n\n\n<p>And what might still happen at the pending period? Perhaps\nthere\u2019s trouble with the seller having full rights to transfer the title. Maybe\nthere\u2019s a significant lien on the home that needs a resolution in order to\nclear the title.<\/p>\n\n\n\n<p>Now and then, a pending sale falls apart when a buyer,\nfacing buyer\u2019s remorse, a life change, or some other new circumstance, opts to give\nup the earnest money and walk away.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Know the Local Vocabulary<\/strong><\/h2>\n\n\n\n<p>Real estate listings contain different terms in different\nplaces. Subtle differences in vocabulary can be big issues for sellers and\nbuyers. <\/p>\n\n\n\n<p>When you talk to your real estate agent, ask for a rundown of\nthe local real estate vocabulary.
