If that\u2019s the person who will get the home after you pass in any case, it might seem sensible. And maybe it is, in certain circumstances. After all, probate can be time-consuming, and even contentious.<\/p>\n\n\n\n<p>But before making this decision, do you know that your child is ready and willing to own a house? And at that point, have you consulted with an attorney and tax specialist about doing things this way? Here are some key issues to spot before obtaining professional guidance.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Effects of Naming the Child as Co-Owner<\/h2>\n\n\n\n<p>A child named on your deed co-owns the real estate. Consider what this means:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If the home has a mortgage, your lender might require\u00a0<em>everyone<\/em> on the deed to be counted as a borrower.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Legally, <em>everyone<\/em> on the deed gets to decide whether to sell the home, or take a loan out on its value.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The more names on the deed, the more likely it becomes that debt or accident claims will attach to the property value.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If the child divorces or predeceases the parent, the child\u2019s ex or heirs may become unexpected co-owners.<\/li>\n<\/ul>\n\n\n\n<p>Are you single or married? If married, even a spouse who\u2019s not on the deed could have property claims in some states. Is your child an adult yet? A court might be asked to appoint a guardian to represent an underaged owner if an adult owner passes away.<\/p>\n\n\n\n<p>And remember that co-owners keep the tax basis from the home\u2019s purchase price. When one passes away, if the surviving co-owners wishes or needs to sell, capital gains taxes on years of property appreciation could create a major bill.<\/p>\n\n\n\n<p>In contrast, when a child<em> inherits<\/em> a house and sells it, there\u2019s the&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/homeowner-estate-planning-real-estate-tips\/\">capital gains break<\/a>. Your child gets a new cost basis: the value as it stands when you pass on.<\/p>\n\n\n\n<p><strong><em>Important note:<\/em><\/strong> When a deed names multiple people,&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/hows-your-property-vested-it-matters-as-much-as-your-will-or-trust\/\">vesting the deed<\/a>&nbsp;matters as much as creating it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Alternative Ways to Transfer Home Ownership to a Child<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"352\" height=\"481\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2021\/10\/alternative-ways-to-transfer-home-ownership-to-a-child.jpg\" alt=\"Close image of the kitchen area of a house showing a stove, oven, counter, and some cabinets and shelves. There\u2019s something to be said for a Last Will. It results in a deed certified by your county court, which passes the real estate neatly through its chain of title.<\/p>\n\n\n\n<p>Another key option is the <a href=\"https:\/\/www.deeds.com\/articles\/update-the-state-of-the-transfer-on-death-deed\/\">transfer on death&nbsp;deed<\/a> (a.k.a. the TOD or beneficiary deed). You\u2019ll fill in an Affidavit of Death form, to be notarized and filed with the county recorder of deeds.<\/p>\n\n\n\n<p>Think of the beneficiary forms a bank asks you to sign, so your accounts pass straight to a named recipient when you pass on. TOD works in much the same way, and is also possible for you to change if you\u2019d like to. But if the TOD isn\u2019t available and a will isn\u2019t right for you, you could consider creating:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>A\u00a0revocable\u00a0living trust.<\/strong> Like a will or the TOD described above, you can change your mind with this option any time before your death or incapacity. This option bypasses probate, but your recipient still gets the benefit of a new tax basis.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>An irrevocable trust.<\/strong> Here, the named trustee takes over right away, and even pays taxes on the real estate until the property passes to your child or children. The key advantage? Avoiding probate. The key drawback? Giving up control \u2014 for example, you can\u2019t take out home loans.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>A life estate.<\/strong> Draft a deed correctly, and you can form a life estate to let you <a href=\"https:\/\/www.deeds.com\/articles\/the-life-estate-deed\/\">stay in your home while you\u2019re living<\/a>, though the house legally belongs to your beneficiary. Life estate deeds avoid probate. What\u2019s the catch? The holder of a life estate shares rights with a co-owner.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>A testamentary trust.<\/strong> Some legal experts might recommend the use of special instruments to support a Last Will, to make sure your intended recipient(s) get specific assets. A testamentary (will) trust is only in effect\u00a0after death.<\/li>\n<\/ul>\n\n\n\n<p>Looking for further ways to hold your property during your life, yet still pass it along to your child? A real estate attorney in your locality can tell you a lot about what can work in your state and your situation.<\/p>\n\n\n\n<p><strong><em>Important note:<\/em><\/strong> In addition to personal holding options, there are business structures such as the LLC. <a href=\"https:\/\/www.deeds.com\/articles\/holding-real-estate-in-a-trust-or-an-llc\/\">See more estate planning options here<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">If You Still Want Your Child on the Deed\u2026<\/h2>\n\n\n\n<p>Remember that if you apply for Medicaid over the next five years after adding your child\u2019s name to the deed, you have likely delayed your benefits eligibility. That\u2019s because of the gift factor. You have passed part of your wealth to your child.&nbsp;You\u2019d be well advised to go over your situation and needs with a Medicaid planner or attorney.<\/p>\n\n\n\n<p>Plus, don\u2019t forget that you are conveying a gift to a non-spouse for tax purposes. While your title transfer probably won\u2019t incur a gift tax, it will use up some of your lifetime tax exclusion.<\/p>\n\n\n\n<p>Still unfazed? Well, then\u2026&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/transferring-a-deed-without-a-lawyer-heres-what-you-should-know\/\">know how to create a valid deed<\/a>, execute and notarize it, and record it promptly<a> <\/a>in the home\u2019s county. Two major kinds of deeds are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The warranty deed.<\/strong>\u00a0The\u00a0<a href=\"https:\/\/www.deeds.com\/articles\/you-have-the-deed-and-keys-to-your-new-home-what-about-a-guarantee\/\">warranty deed<\/a>\u00a0is based on a professional title search.
