{"id":202,"date":"2016-03-22T00:20:44","date_gmt":"2016-03-22T00:20:44","guid":{"rendered":"https:\/\/www.deeds.com\/articles\/?p=202"},"modified":"2024-04-25T23:21:32","modified_gmt":"2024-04-26T03:21:32","slug":"idaho-has-two-trustees-deeds-whats-the-difference","status":"publish","type":"post","link":"https:\/\/www.deeds.com\/articles\/idaho-has-two-trustees-deeds-whats-the-difference\/","title":{"rendered":"Idaho Has Two Trustee\u2019s Deeds \u2013 What\u2019s the Difference?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">When choosing a trustee\u2019s deed in\nthe State of Idaho, it is important to understand the difference between the\ntwo very different types of conveyances the term can refer to: the trustee\u2019s\ndeed as used in estate planning, and the trustee\u2019s deed upon sale, used in\ncases of foreclosure of a deed of trust.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p class=\"wp-block-paragraph\">Both deeds are a little different\nfrom other instruments of conveyance of real property in Idaho because they are\nnamed for the person executing them rather than the type of warranties they\ncarry. In its simplest form, the trustee\u2019s deed is a modified fee simple deed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The trustee\u2019s deed used in estate\nplanning conveys title to real property out of a trust. In this case, the\ntrustee is the person who administers the trust under the provisions of a trust\nagreement executed by the trust maker, or settlor. The settlor is the person\nfunding the trust with the real property, and who gives the trustee the power\nto convey property under the trust. A trustee often furnishes a certificate of\ntrust to verify the trust\u2019s existence and his\/her authority to act on behalf of\nthe trust.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this type of trustee\u2019s deed, the\nsettlor does not directly enter into the transaction. Rather, the trustee\nassumes the role of the grantor and transfers the settlor\u2019s interest to a\ngrantee. In many revocable living trusts, the settlor may also serve as\ntrustee, and designate a successor trustee in the trust instrument.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A trustee\u2019s deed upon sale,\nhowever, is only used when a deed of trust (also called a trust deed) has been\nexecuted. Idaho is one of a handful of states that use deeds of trust as the\nprimary form of financing purchases of real property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A deed of trust, similar to a\nmortgage, is a security instrument that, along with a promissory note, sets out\nthe terms for repaying the loan used to purchase the property. The deed of\ntrust is acknowledged by the grantor and recorded in the county in which the\nreal property is located.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The deed of trust conveys \u201creal\nproperty to a trustee in trust to secure the performance of an obligation of\nthe grantor\u2026named in the deed to a beneficiary\u201d (I.C. \u00a7 45-1502(3)). In a deed\nof trust, the grantor is the borrower of the secured real estate loan. The trustee\nis named in the deed of trust, and, as codified at I.C. \u00a7 45-1504, \u201ccan be a\nbank, lawyer, title insurance agent, or a licensed trust organization,\u201d though\nit is generally a title insurance agent [1]. In Idaho, the lender is the\nbeneficiary of the trust deed and the trustee holds the lien on the property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are two outcomes of a deed of\ntrust. Upon fulfillment of the obligation (the repayment of the loan), the\ntrustee executes a deed of reconveyance, discharging the lien. In the event\nthat the grantor defaults, however, on the terms of the deed of trust (for\ninstance, not making payments toward the loan), then the trustee is able to\nbegin a non-judicial foreclosure (a foreclosure not dependent on court) under a\npower of sale clause within the deed of trust (I.C. \u00a7 45-1503(1)). The terms\nfor curing default are stated in I.C. \u00a7 45-1506(12).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The trustee\u2019s deed under I.C. \u00a7\n45-1509, then, is used to convey the foreclosed property to the purchaser\n(highest bidder) after the trustee\u2019s sale, the procedure for which is governed\nby I.C. \u00a7 45-1506. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The trustee&#8217;s deed requires, \u201cin\naddition to a description of the property conveyed, a recital of the facts\nconcerning the default, the mailing and the publication of the notice of sale,\nthe conduct of the sale and the receipt of the purchase money from the\npurchaser\u201d (I.C. \u00a7 45-1509). From I.C. \u00a7 45-1510(1), \u201cthe recitals contained in\nthe deed&#8230;shall be prima facie evidence\u201d of their accuracy, and may be relied\non by a purchaser in good faith.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The trustee\u2019s deed should be recorded in the county in which the property is located within fifteen (15) days of the sale date pursuant to I.C. \u00a7 45-1510.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><a href=\"https:\/\/www.deeds.com\/forms\/idaho\/trustee-deed\/\">Idaho Trustee Deed Form<\/a><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><a href=\"https:\/\/www.deeds.com\/forms\/idaho\/trustee-deed-upon-sale\/\">Idaho Trustee Deed Upon Sale Form<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The information provided summarizes\nvery complicated processes, and should not be taken as legal advice.
