Should I have it? If so, how do I buy it?<\/em><\/p>\n\n\n\n<p>Closing day for a home purchase is precisely when the buyer has a chance to buy an owner\u2019s title policy. Given how frenzied life can get when it\u2019s time to close on a home, it\u2019s worth knowing about this in advance.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">The Lenders Get Theirs. Should You Get Yours?<\/h2>\n\n\n\n<p><em>Loan title insurance<\/em> is something you pay for at closing. What\u2019s the point? For a lender, the point is critical. The policy would pay out the value of the mortgage balance to make the lender whole again if a claim against your home challenges your title.<\/p>\n\n\n\n<p>So, it\u2019s coverage for the outstanding loan principal, no more. And it\u2019s of no direct benefit to the homeowner \u2014 who buys it only because that\u2019s what people have to do in most states if they want a mortgage.<\/p>\n\n\n\n<p>In contrast, getting an <em>owner\u2019s title policy<\/em> isn\u2019t forced on anyone. Why buy it? Title insurance can cover past defects in your chain of title, unbeknownst to you at closing. Title defects can be quirky, out-of-the-blue issues like outstanding debts of previous property owners, or some transfer in the past with a missing signature.<\/p>\n\n\n\n<p>If it turns out you need to defend your homeownership, a title company\u2019s backing can be helpful. If you don\u2019t have that protection, can you afford to wake up one day and find out you don\u2019t legally own the home? Even though you\u2019ve been paying the mortgage faithfully and are on the hook for the outstanding balance?<\/p>\n\n\n\n<p>Without the backing of a title company, you\u2019ll be the one paying a lawyer and potentially losing your home equity and your home itself. &nbsp;&nbsp;<\/p>\n\n\n\n<p>All things considered, an owner\u2019s title insurance policy is beneficial. It\u2019s available for a simple, one-and-done payment (and the buyer may even negotiate with the seller to get the premium paid).<\/p>\n\n\n\n<p><em>\u261b<\/em> <strong><em>Before you get a title policy, you get a title commitment. It\u2019s worth reviewing, as it states the exceptions to coverage. You have a chance, before the policy is issued, to go over the exceptions with the title company. Certain exclusions can be changed, but not all. It\u2019s important to be sure the commitment covers the <\/em><\/strong><a href=\"https:\/\/www.deeds.com\/articles\/the-importance-of-a-legal-description-in-a-real-estate-deed\/\"><strong><em>correctly described property<\/em><\/strong><\/a><strong><em>.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why Would a Homebuyer Shop Around for a Title Insurer?<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2022\/08\/why-would-a-home-buyer-shope-around-for-a-title-insurer.jpg\" alt=\"\" class=\"wp-image-2416\" width=\"386\" height=\"373\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2022\/08\/why-would-a-home-buyer-shope-around-for-a-title-insurer.jpg 514w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2022\/08\/why-would-a-home-buyer-shope-around-for-a-title-insurer-300x290.jpg 300w\" sizes=\"auto, (max-width: 386px) 100vw, 386px\" \/><\/figure>\n\n\n\n<p>First, whether you can shop for the best policy deal depends on your state\u2019s customary practices and laws.<\/p>\n\n\n\n<p>For example, there\u2019s Texas. The state insurance department regulates Texas policies, word by word. All policies have the exact same provisions, and all title companies calculate the policy holder\u2019s premium with the same method (taking a percentage of the worth of the home). Following rules set forth by the the <a href=\"https:\/\/www.tdi.texas.gov\/tips\/title-insurance.html\" target=\"_blank\" rel=\"noreferrer noopener\">Texas Department of Insurance<\/a>, title professionals can only compete on the basis of their reputation for good service.<\/p>\n\n\n\n<p>Second, if you know you\u2019re going to bundle it with the lender\u2019s policy, you don\u2019t have to shop around. But you can, if you want to. You can choose any title insurer; it\u2019s your policy, after all. But \u2014 whether you decide to pay for a <a href=\"https:\/\/www.deeds.com\/articles\/home-buyers-cover-your-assets-choosing-between-standard-and-extended-title-insurance\/\">standard or enhanced owner\u2019s policy<\/a> \u2014 the price should be the same from company to company.<\/p>\n\n\n\n<p>(An enhanced policy is meant to make you whole again if you lose your title \u2014 covering your legal defense and mortgage, and restoring your home equity to you.)<\/p>\n\n\n\n<p>If you feel strongly about selecting your title and escrow professionals, tell your agent at your first meeting. If you don\u2019t, your agent or mortgage company will pick for you.<\/p>\n\n\n\n<p><em>\u261b<\/em> <strong><em>To avert kickback schemes and costly referral fees, the <\/em><\/strong><a href=\"https:\/\/www.nar.realtor\/real-estate-settlement-procedures-act-respa\" target=\"_blank\" rel=\"noreferrer noopener\"><strong><em>Real Estate Settlement Procedures Act<\/em><\/strong><\/a><strong><em> bars home sales from being conditioned on agreeing to a specific title insurer. Violations may be reported to the Consumer Financial Protection Bureau.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">If Allowed to Shop Around, What Should a Buyer Look For?<\/h2>\n\n\n\n<p>Buyers can ask around locally to find out about other homeowners\u2019 experiences with title companies.<\/p>\n\n\n\n<p>They can also explain their purchase to the companies, and find out if they\u2019re eligible for any discounts.<\/p>\n\n\n\n<p>Will it be worth the effort to shop around? Buyers might offer differing opinions on the matter. Some people bristle because they are simply expected to sign off on the closing estimates. The choice of title companies typically isn\u2019t bought up clearly as the buyer\u2019s prerogative.<\/p>\n\n\n\n<p>In any case, the products offered by title insurers are generally similar, and the premium is not a major expense. Even if the fees can vary from company to company, shopping around costs the buyer time. &nbsp;And getting the lender\u2019s <em>plus<\/em> owner\u2019s policy from the same company will allow for a discount on the pair of policies.<\/p>\n\n\n\n<p><em>\u261b<\/em> <strong><em>Did you know? In the state of Iowa, the&nbsp;Iowa Title Guaranty is the sole title insurer. The state\u2019s&nbsp;<\/em><\/strong><a href=\"https:\/\/www.deeds.com\/articles\/the-abstract-of-title-in-real-estate-what-is-it\/\"><strong><em>abstractors<\/em><\/strong><\/a><strong><em>&nbsp;run the title searches. An Iowa home buyer can have a title insured for&nbsp;a very small sum because the state government backs the coverage.<\/em><\/strong><\/p>\n\n\n\n<p>In states where buyers have a choice of companies, the buyer needs to be sure the title company they select is licensed. State financial services\u2019 departments have websites with licensing information and help desk numbers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Do All Companies Cover the Entire Time of Ownership?<\/h2>\n\n\n\n<p>Yes, they do. An owner\u2019s policy covers the title as long as you own the land \u2014 and possibly beyond. (See \u201ccontinuation of coverage\u201d terms.) This is so although there\u2019s just one, upfront premium. So store that policy safely with the <a href=\"https:\/\/www.deeds.com\/articles\/new-homeowners-document-checklist-storage-plan\/\">documents for your house<\/a>. &nbsp;<\/p>\n\n\n\n<p>If you refinance, that\u2019s OK. Your coverage stays. If you make upgrades to your home, that\u2019s OK too\u2014although you might need to get endorsements and pay for additional coverage. If you transfer the home to a business or change the names on your title, ask your title company first, to find out whether the coverage stays.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">At the Finish Line, It\u2019s All About Priorities<\/h2>\n\n\n\n<p>If you didn\u2019t know you could choose your title insurer, and you are approaching closing, insisting on a different company will throw your closing date off. Buyers sign closing estimate papers at the beginning of their relationships with agents. When they do, they are signing up for a specific title insurance company to run the title search and issue the coverage.<\/p>\n\n\n\n<p>In most situations, that works out just fine. Title insurance companies in any given location tend to offer similar products, in similar price ranges. The main thing is that the buyer understands the importance of an owner\u2019s title policy, and the added security offered by \u201cenhanced\u201d coverage.<\/p>\n\n\n\n<p>Now that you know, it may be clearer to you why choosing a good real estate agent is so important. Agents do many tasks at once. In many transactions, connecting a buyer with a title company is one of those many tasks.
