Mortgage rates are up. Borrowers are concerned, and mortgage companies have good reasons to work hard for new customers\u2019 business. So, isn\u2019t it time borrowers researched our mortgages before signing up?<\/p>\n\n\n\n<p>Yet so few of us do. Zillow\u00ae says this could be costing homeowners hundreds of dollars each month. Let\u2019s unpack this.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Survey Says: People Spend More Time Shopping for a TV Than a Mortgage.<\/h2>\n\n\n\n<p>Zillow Home Loans recently ran a survey. Here\u2019s what it found:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>28% of people take a month or more to learn about available cars before choosing one.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>23% of people take a month or more to compare vacation alternatives before making plans.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>12% take a month or more to research a TV purchase.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Just 13% take a month to compare mortgage lending options, while more than 70% of hopeful buyers do <em>zero<\/em> comparison-shopping among mortgage lenders.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Close to half of loan borrowers apply for <em>one<\/em> mortgage only.<\/li>\n<\/ul>\n\n\n\n<p>Granted, some survey respondents had reasons for declining to comparison-shop for their mortgages. About a third of mortgage applicants said they didn\u2019t apply for multiple mortgages because they wanted to avoid inquiries on their credit profiles. But they needn\u2019t have worried! Home buyers may apply for up to 45 mortgages in a 45-day period, and that counts as only one inquiry.<\/p>\n\n\n\n<p><em>\u261b<\/em><em>&nbsp;<\/em><strong><em>Borrowers do have influence over their credit reports. People with \u201cfair\u201d ratings shell out hundreds more on their monthly mortgage payment than those rated \u201cexcellent,\u201d Zillow found. Here are the <\/em><\/strong><a href=\"https:\/\/www.deeds.com\/articles\/applying-for-a-mortgage-get-the-facts-on-credit-scores-and-how-to-improve-yours\/\"><strong>Facts on How to Improve Your Credit Profile<\/strong><\/a><strong><em>.<\/em><\/strong><strong><em><\/em><\/strong><\/p>\n\n\n\n<p>The key lesson here? Most of us can and probably should do at least some preparatory work before agreeing to the terms of a mortgage. Here\u2019s the rub, though, and we\u2019ll discuss it further below. Once a mortgage loan closes, the company who services that loan may change. (In fact, the lender can sell the loan itself on the secondary market.) And the borrower can\u2019t stop that change from occurring.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A Product and a Service: Here\u2019s What a Mortgage Customer Buys.<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"411\" height=\"535\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2022\/11\/a-product-and-a-service.jpg\" alt=\"\" class=\"wp-image-2627\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2022\/11\/a-product-and-a-service.jpg 411w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2022\/11\/a-product-and-a-service-230x300.jpg 230w\" sizes=\"auto, (max-width: 411px) 100vw, 411px\" \/><\/figure>\n\n\n\n<p>A borrower\u2019s mortgage account information is kept on the mortgage servicer\u2019s website. Also, the mortgage servicer typically holds part of the monthly payment total <a href=\"https:\/\/www.deeds.com\/articles\/all-about-escrow\/\">in escrow<\/a>&nbsp;to pay the homeowner\u2019s property taxes and insurance premiums. Servicers do take fees (and they vary widely) for various document processing tasks, and for working with tax and insurance entities on behalf of the borrowers.<\/p>\n\n\n\n<p>A borrower who runs into financial stress contacts the mortgage servicer for help to stay on track, or for things like having <a href=\"https:\/\/www.deeds.com\/articles\/a-guide-to-private-mortgage-insurance\/\">private mortgage insurance<\/a>&nbsp;removed (for qualifying borrowers). The attitude of a mortgage servicer matters to a homeowner\u2019s experience with the loan.<\/p>\n\n\n\n<p>The firm J.D. Power runs a <a href=\"https:\/\/www.jdpower.com\/business\/press-releases\/2022-us-mortgage-servicer-satisfaction-study\" target=\"_blank\" rel=\"noreferrer noopener\">mortgage customer satisfaction survey<\/a> each year. \u201cAs a recession seems increasingly likely and mortgage loan delinquencies are on the rise, customers want to be assured their mortgage servicers are on their side,\u201d says the firm. The three high-scoring mortgage servicers for 2022 are: 1. New American Funding; 2. Rocket Mortgage; and\u00a03. Huntington National Bank.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Is the Mortgage Servicer Actually Supposed to Be \u201cOn the Borrower\u2019s Side\u201d?<\/h2>\n\n\n\n<p>As a practical matter, a mortgage broker may play a support role for a home buyer. The representative of the loan servicing company typically meets with the borrower, reviews the borrower\u2019s finances in detail, and looks for options that fit. This representative may be the one who calls the applicant to chase down every shred of evidence of the applicant\u2019s income, credit and debt. A mortgage professional can be a talented, knowledgeable go-between who convinces the lender\u2019s underwriter that yes, the borrower <em>can and will<\/em> come through with faithful loan payments.<\/p>\n\n\n\n<p>Depending on how the law of the state categorizes this person\u2019s legally binding role, a mortgage broker may also be the agent of the borrower. An agent has a higher level of responsibility to the borrower. An agent is obliged to work on behalf of the customer\u2019s best interests in achieving the goal of borrowing funds. This obligation to represent the borrower is called the broker\u2019s <em>fiduciary duty.<\/em><\/p>\n\n\n\n<p>For example,&nbsp;under California law:<\/p>\n\n\n\n<p><em>This fiduciary duty includes a requirement that the mortgage broker place the economic interest of the borrower ahead of his or her own economic interest.&nbsp;<\/em><\/p>\n\n\n\n<p>A broker in California must be licensed, and is legally obliged to advise the borrower on how to stay safe in a financial decision, through the fiduciary duty of care.&nbsp;<\/p>\n\n\n\n<p>Mortgage customers should be aware of the duties that real estate professionals have to their clients. A lender doesn\u2019t owe the borrower any fiduciary duties, and in most cases neither does a mortgage broker or a real estate broker. An <em>agent<\/em> does have the responsibility to look out for the borrower\u2019s best interests.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What If the Selected Mortgage Servicer Falls Short in Customer Service?<\/h2>\n\n\n\n<p>Mortgage professionals have to follow an intricate set of laws. This goes for mortgage servicing companies and their employees. The&nbsp;Federal Trade Commission&nbsp;(FTC) regulates the mortgage servicing sector. Borrowers may learn about their <a href=\"https:\/\/www.consumer.ftc.gov\/articles\/0190-making-payments-your-mortgage-servicer\" target=\"_blank\" rel=\"noreferrer noopener\">rights and responsibilities<\/a> from the FTC.<\/p>\n\n\n\n<p>Note that people\u2019s mortgage accounts can be transferred among servicers. This is a common practice. Sometimes, banks have sold <a href=\"https:\/\/www.citigroup.com\/citi\/news\/2017\/170130a.htm\" target=\"_blank\" rel=\"noreferrer noopener\">servicing rights in bulk<\/a>. The borrower will receive notice of the change at least 15 days before it occurs. Of course, that\u2019s not the same as having a say in the matter!\u00a0<\/p>\n\n\n\n<p>The Urban Institute observes:<\/p>\n\n\n\n<p><em>Homeowners do not get to select who services their mortgage after they close the loan. Nor do they have a say if the loan is transferred and the loan servicer changes.<\/em><\/p>\n\n\n\n<p>And the impact on the borrower when the servicing rights shift from one company to another? Again to quote the Urban Institute:<\/p>\n\n\n\n<p><em>Confusion and delays in recording and posting borrower payments can arise when the servicer sells or transfers its servicing rights to another servicer.<\/em><\/p>\n\n\n\n<p>If the customer isn\u2019t thrilled about the change, there\u2019s usually not much to do about it. Customers are free to refinance their loans, but that has its own costs and it doesn\u2019t prevent the same thing from happening again.<\/p>\n\n\n\n<p>An exception to this industry habit is Quicken Loans \/ Rocket Mortgage, which holds onto its borrowers\u2019 accounts. \u201cRocket Mortgage is unusual among lenders in that we keep much of our mortgage servicing in-house, the company explains. \u201cWe want our customers to experience the same great service they received during the application process for the entire term of their mortgage.\u201d<\/p>\n\n\n\n<p>Will others in the sector follow Rocket Mortgage\u2019s lead? This remains to be seen.
