And for most people, the mortgage servicing company holds some of the owner\u2019s payment <a href=\"https:\/\/www.deeds.com\/articles\/does-your-mortgage-really-need-an-escrow-account\/\">in escrow<\/a>, and pays property taxes out of that account on behalf of the borrower as long as the mortgage exists.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But what if the mortgage servicer lets a tax payment slip through the cracks?<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Fumbles Do Happen\u2026<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Mistakes are especially possible when a loan is sold from one company to the next. And that\u2019s a frequent occurrence in the mortgage lending world, as most homeowners know.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But how would a homeowner know about a payment lapse?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a case of unpaid taxes, the homeowner should receive a past-due bill from the local tax collector. Sometimes, a homeowner is just checking up on the account, and it looks like a tax payment wasn\u2019t made.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So, check in on your escrow account from time to time, and particularly after one company sells your mortgage to the next. It never hurts to make sure your homeowner\u2019s insurance and property tax payments are on track.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Now, to Fix the Problem\u2026<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Taxes can\u2019t be ignored. A borrower with an overdue tax bill should take action without delay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Too much delay in a case of late property tax payments can lead to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A delinquency penalty from the local government.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A <a href=\"https:\/\/www.deeds.com\/articles\/know-the-facts-about-liens\/\">lien<\/a> on the home\u2019s title.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ultimately, foreclosure.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">So, be sure the issue is resolved promptly. Here\u2019s how:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Contact your mortgage company. Ask it to cover the past-due bill immediately.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If the issue isn\u2019t promptly resolved, send a copy of the tax collector\u2019s notice and a <a href=\"https:\/\/www.consumerfinance.gov\/rules-policy\/regulations\/1024\/35\/#de38a82277268f404065254dafd5d4914192d0c3b36d54d4642f206f\" target=\"_blank\" rel=\"noreferrer noopener\">notice of error<\/a> to your mortgage company for \u201c[f]ailure to pay taxes, insurance premiums, or other charges, including charges that the borrower and servicer have voluntarily agreed that the servicer should collect and pay, in a timely manner\u2026\u201d This letter should also include the borrower\u2019s name and loan number.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Under federal law, the servicer must acknowledge receipt of the notice of error within five business days. If there is a concern about imminent foreclosure, the borrower may decide to call the tax office and resolve the past-due bill.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Request a refund from the mortgage servicing company. The borrower is entitled to a refund for <a href=\"https:\/\/www.consumerfinance.gov\/rules-policy\/regulations\/1024\/17\/#k-3\" target=\"_blank\" rel=\"noreferrer noopener\">penalties<\/a> resulting from a mortgage servicing company\u2019s lapse in tax or insurance payments.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The company might also agree to reduce a future bill in light of the borrower\u2019s inconvenience. It doesn\u2019t hurt to ask. In any case, the company has 30 days to resolve an error it has made. This can be extended to a 45-day period, but the company must explain the extension to the borrower within these first 30 days.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Foreclosure Sales: When Cities Keep the Change<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Foreclosures over unpaid tax bills are distressing enough as they are. And yes, foreclosure can happen on account of a simple mistake by a mortgage servicing company which puts a homeowner into tax delinquency status. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now, we\u2019d at least expect local governments that foreclose on homes to return any profits above and beyond the unpaid debt to the people whose homes they\u2019ve seized. And yet some states have allowed local governments to keep <em>all <\/em>the proceeds from these home sales. You read that right. Multiple states allow governments to keep profits from foreclosure sales, at least in some circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This practice takes away the life savings of homeowners. The local authorities\u2019 \u201csurplus retention\u201d of equity can mean the agencies are getting many multiples of the debts owed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Building equity as a homeowner is a time-honored tradition. Yet foreclosing on homes and \u201ckeeping the change\u201d happens in more places, and more often, than most people would guess.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There\u2019s a fitting nickname for the nasty practice of surplus retention: <em>home equity theft.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Supremes Weigh In\u2014Forcing Change<\/h2>\n\n\n\n<figure class=\"wp-block-image alignleft size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"326\" height=\"311\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2023\/10\/the-supremes-weigh-in-1.jpg\" alt=\"\" class=\"wp-image-3338\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2023\/10\/the-supremes-weigh-in-1.jpg 326w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2023\/10\/the-supremes-weigh-in-1-300x286.jpg 300w\" sizes=\"auto, (max-width: 326px) 100vw, 326px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">People shouldn\u2019t have to give up their life savings on account of tax bills they\u2019ve struggled to pay \u2014 or didn\u2019t even know they missed. The nation\u2019s highest court agrees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Recently, the U.S. Supreme Court called the practice unconstitutional. The Justices cited the U.S. Constitution&#8217;s Takings Clause. The Clause keeps governments from nabbing people\u2019s property without fair compensation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We covered the <a href=\"https:\/\/www.deeds.com\/articles\/latest-from-scotus-a-tale-of-two-property-rights-cases\/\">Supreme Court ruling here<\/a>. The ruling came out in May 2023.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And now, it\u2019s vital that states adjust their laws according to the Supreme Court\u2019s decision. State laws should let tax authorities and companies collect only the amount owed. Never more.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How State Lawmakers Are Responding<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Nebraska now has Legislative Bill 727 (<a href=\"https:\/\/nebraskalegislature.gov\/FloorDocs\/108\/PDF\/Slip\/LB727.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">PDF<\/a>). This law, which the governor approved in June 2023, prohibits the retention of surplus home equity. Within 30 days after recording of the tax deed, Nebraska\u2019s law now states, \u201cthe grantee shall pay the surplus to the previous owner of the property described in the deed.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The State Senate of New York is hard at work on a similar requirement. New York State Assembly Bill 2021-A10681 (<a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2021\/A10681#:~:text=2021%2DA10681%20(ACTIVE)%20%2D%20Summary,public%20auction%20of%20a%20property.\" target=\"_blank\" rel=\"noreferrer noopener\">bill summary webpage<\/a>) directs \u201cthe return of surplus proceeds from tax lien foreclosures to a former owner\u201d in addition to mandating a \u201c14-day posted notice prior to the public auction of a property.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image alignright size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"512\" height=\"316\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2023\/10\/how-state-lawmakers-are-responding.png\" alt=\"\" class=\"wp-image-3336\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2023\/10\/how-state-lawmakers-are-responding.png 512w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2023\/10\/how-state-lawmakers-are-responding-300x185.png 300w\" sizes=\"auto, (max-width: 512px) 100vw, 512px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">And then there\u2019s Massachusetts. ln light of the U.S. Supreme Court&#8217;s decision this year, Massachusetts is overhauling its surplus-retention laws and weeding out unjust tax lien provisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Massachusetts had been treating homeowners in tax lien foreclosures harshly. Its law allowed cities to receive \u201cfull title of the property\u201d they have foreclosed. That is now changing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It was the surplus retention law in Minnesota that U.S. Supreme Court struck down as unconstitutional. The decision is forcing change in foreclosure proceedings \u2014 not just in Minnesota, but also in Massachusetts, in Nebraska, in New York, and across the country.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Our Takeaway? \u201cTrust, But Verify\u201d That Your Mortgage Company Is on the Ball<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If you have a mortgage, you probably pay extra funds into your mortgage escrow account each month. And from that escrow account, the mortgage company pays your property taxes and your homeowners&#8217; insurance by their due dates. The mortgage company wants to take care of everything \u2014 and under the federal law, as long as your monthly payment isn&#8217;t 30+ days past due, it must make those payments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Just be aware that slip-ups (although rare) do happen. Now and then, an escrow disbursement doesn\u2019t get done.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A lapse in an insurance policy violates mortgage requirements and must be resolved immediately. The lender will place its own insurance policy on the home when homeowners cancel their policies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As for unpaid property taxes, these result in liens. Watch out! A property tax lien has priority even over the mortgage itself. Concerned homeowners may decide to pay a past-due bill themselves to resolve the matter quickly, and <em>then <\/em>pursue their rights with the mortgage company.
