Texas Association of Realtors Inc<\/em>.<\/p>\n\n\n\n<p>This one is Texas-specific.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Who\u2019s Getting Sued?<\/h2>\n\n\n\n<p>Twenty-nine named <a href=\"https:\/\/unicourt.com\/case\/pc-db5-casegu5278a46fc552-1699333\/parties\" target=\"_blank\" rel=\"noreferrer noopener\">defendants<\/a>&#8230; and counting. All of them handle real estate business in the state.<\/p>\n\n\n\n<p>Some are powerhouses. Keller Williams, HomeServices of America, and Penfed Realty are among them.<\/p>\n\n\n\n<p>And then there\u2019s the slew of Texas-based real estate groups. Some affiliates of the National Association of REALTORS\u00ae are named defendants. These include the Texas Association of REALTORS\u00ae, the MetroTex Association of REALTORS\u00ae, and the Houston Association of REALTORS\u00ae.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who Is Suing?<\/h2>\n\n\n\n<p>Two major home builders\/sellers \u2014 the QJ Team and Five Points Holdings \u2014 allege that sellers in general pay unfairly high agent fees. Home sellers must pay for their buyer\u2019s agent. If they don\u2019t, the buyer agents will likely steer clear of their listings rather than show them to clients.<\/p>\n\n\n\n<p>This could turn into a sprawling class-action suit, as it\u2019s filed on behalf of anyone who listed a Texas home with a broker named in the lawsuit \u2014 any time since November 2019.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why Are They Suing\u2014And Why Texas?<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"252\" height=\"297\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2023\/12\/why-are-they-suing.jpg\" alt=\"\" class=\"wp-image-3454\"\/><\/figure>\n\n\n\n<p>The plaintiffs object to commissions that people pay in order to get homes listed for sale, and shown to buyers. The parties <em>could<\/em> negotiate these commissions, yes. But in most real-world transactions \u2014 because the buyer isn\u2019t paying upfront for what ultimately goes into the price of a home \u2014 negotiations don\u2019t happen. And that, of course, benefits the industry, not the parties to the transaction.<\/p>\n\n\n\n<p>The lawsuit claims that the real estate groups, under the influence of rules set forth by the National Association of REALTORS\u00ae, are taking part in \u201cunconscionable action.\u201d &nbsp;<\/p>\n\n\n\n<p>They point to multiple sections of the Texas Deceptive Trade Practices Act. And their case will play out in the anti-trust division of the U.S. District Court for the Eastern District of Texas. This case has a special importance in Texas, where homes\u2019 sale prices aren\u2019t a matter of public record. To check prices, people get agents with access to the Multiple Listing Service (MLS). And the National Association of REALTORS\u00ae is the <em>de facto<\/em> gatekeeper of the key MLS system.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">So, NAR\u2019s in the Thick of It?<\/h2>\n\n\n\n<p>Yes. A big presence in this case \u2014 although it\u2019s not a named defendant \u2014 is the National Association of REALTORS\u00ae. &nbsp;The lawsuit claims NAR, Anywhere Real Estate (formerly Realogy), and RE\/MAX are conspiring in price-fixing.<\/p>\n\n\n\n<p>As we\u2019ve noted, the issue in this case is a listing system run by NAR. Sellers\u2019 agents routinely promise compensation to buyers\u2019 agents. That\u2019s the only way to list homes on the MLS. And that\u2019s the way the \u201cClear Cooperation\u201d system works, since 1996, under a system NAR set up.<\/p>\n\n\n\n<p>It\u2019s all because of this rule that your agent typically expects 3% from a transaction when you\u2019re buying or selling a home.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">But Shouldn\u2019t Real Estate Agents Get Paid?<\/h2>\n\n\n\n<p>Absolutely. Good agents are skilled negotiators. They let their clients know when some aspect of a deal could be <a href=\"https:\/\/www.deeds.com\/articles\/your-real-estate-agents-fiduciary-duties\/\">better for their client<\/a>. They know the good inspectors, and can get them on the phone. They answer tons of questions. They keep everything on an even keel whenever there\u2019s a glitch on the way to closing.<\/p>\n\n\n\n<p>The suit isn\u2019t trying to stop agents\u2019 commissions. It\u2019s asking that the parties have a fair opportunity to negotiate the commissions.<\/p>\n\n\n\n<p>The suit says sellers shouldn\u2019t have to agree to blanket commissions covering both sides\u2019 agents. Only in real estate, they observe, does one party have to pay for the other side\u2019s representative.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">If NAR\u2019s System Gets Outlawed, How Will Agents Be Paid?<\/h2>\n\n\n\n<p>If NAR\u2019s rule gets struck down, whether in Texas or nationwide, buyers will be in the position to negotiate their agents\u2019 fees. And the agents will then have to set their rates accordingly, to compete for a buyer\u2019s business.<\/p>\n\n\n\n<p>The lawsuit essentially claims that asking the seller to pay the buyer\u2019s agent is unfair. So, the question is this: Can\u2019t the buyer\u2019s agent be paid by the buyer?<\/p>\n\n\n\n<p>Buyers wouldn\u2019t necessarily be paying for their agents upfront. They could have their agent\u2019s commission folded into their mortgage payments. Perhaps that would become legal.<\/p>\n\n\n\n<p>The law needs to change to make this work. We\u2019ll be watching for this to happen.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Else Could Change on Account of This Case?<\/h2>\n\n\n\n<p>The plaintiffs say they want sellers to be charged fairly. They say they want no more steering to agents who participate in the industry\u2019s system. They say they want to spur innovation. They say they want new, lower-cost real estate services to come into the field.<\/p>\n\n\n\n<p>After all, the plaintiffs say: In this day when so much data is online and clients do so much legwork themselves, a blanket commission rule tied to the MLS is obsolete. So, the plaintiffs think that there should be cheaper alternatives to the MLS. The envision new ways for home sellers to communicate their properties\u2019 availability on the market.<\/p>\n\n\n\n<p>And more buyers and sellers might just handle their own transactions. More buyers could decide to directly hire a lawyer, and title and mortgage professionals. This could save some buyers a great deal of cash.<\/p>\n\n\n\n<p>All of this could bring down agents\u2019 rates. Some people might not jump into being real estate agents; those agents who remain would accept a more competitive field.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Is This a Lawsuit Whose Time Has Come?<\/h2>\n\n\n\n<p>Yes, it fits the mood of our times. In October, a federal jury in Missouri found that industry players had conspired to keep commissions high. The $1.8 billion bombshell verdict in that case could ultimately reshape the homebuying process, and how real estate agents are paid.<\/p>\n\n\n\n<pre class=\"wp-block-preformatted\"><strong>The real estate industry is in the throes of major change. Look for agents to clearly say their commissions are negotiable.
