Perhaps it describes the wrong parcel, or fails\nto&nbsp;reflect&nbsp;all land&nbsp;purchased in the sale.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An error in\na legal description of a property has consequences. It can\naffect&nbsp;taxes.&nbsp;As lenders extend loans based on a percentage of the\nproperty\u2019s appraised value, footage mistakes can sink a&nbsp;loan approval. If\nthe error is neglected, disputes can&nbsp;arise later, and they can become the\nstuff of nightmares.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Worst-Case\nScenarios<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Some deeds\nbear&nbsp;legal descriptions drafted using early survey methods, pre-dating GPS\nmeasurements. Some have errors in lot descriptions that get passed unwittingly\nfrom one owner to the next\u2014a sort of legal time bomb waiting to take someone by\nsurprise.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p class=\"wp-block-paragraph\">In <a href=\"https:\/\/www.vice.com\/en_us\/article\/4w538q\/when-you-buy-a-house-but-dont-actually-own-it\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">one case<\/a>, a veteran spent many years&#8217; worth of savings to buy\u00a0a single-family home, and later decided to survey the property in order to get fence lines drawn. This unearthed a serious error in the title. The legal description in the deed\u00a0represented the wrong lot\u2014not the parcel\u00a0on which the house stood. When the vet tried to swap land with the neighbors to correct the issue, the neighbors resolved to evict the vet&#8217;s family and take the home.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The vet&#8217;s\ncase is severe. Yet cases like&nbsp;it are not unusual. Survey requirements and\nrecording laws suffered neglect the real estate bubble&nbsp;frenzy from 2004 to\n2006. Inaccurate deeds have&nbsp;wreaked havoc in county recording offices ever\nsince.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Two\nWays&nbsp;to Update a Legal Description in the Deed<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When a\nmistake in the legal description comes to light, the remedies depend on the\nnature of the error. Is it a scrivener\u2019s&nbsp;error? Or is it a substantive\nissue?<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Resolving\nSmall Ambiguities: The Scrivener&nbsp;Affidavit<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Sometimes an\nomission&nbsp;attracts attention just&nbsp;after recording. It&#8217;s minor, and\neveryone knows what the description meant to say. A clarification would help,\nand would not materially change the deed. It would simply tighten up ambiguous\nlanguage in the legal description.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this\ncase, state&nbsp;law typically offers a&nbsp;straightforward and simple remedy.\nThe attorney responsible for preparing the deed signs an affidavit stating that\nthe property was intended to be described as in the affidavit. This is commonly\ncalled a&nbsp;Scrivener Affidavit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where\npermitted by law, the already-recorded deed does not need replacement with a\nnew deed. It can instead be accompanied by&nbsp;a&nbsp;Scrivener\nAffidavit.&nbsp;State law lays out the specific and&nbsp;strictly\nlimited&nbsp;types of issues&nbsp;a&nbsp;Scrivener Affidavit&nbsp;may remedy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The county\nrecorder of deeds maintains the local rules outlining&nbsp;everything that must\nbe in place when submitting the Scrivener Affidavit. The affidavit must comply\nwith local and state standards for recorded documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The state\nrequirements may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>A cover letter that states its\u00a0reason, drafted by the person who prepared the previously recorded deed. \u00a0<\/li><li>The attachment of the affidavit to the originally recorded deed. The affidavit\u00a0refers to the provision of state law that permits it, and contains the clarifying\u00a0information, certified by the person submitting it under penalty of perjury.<\/li><li>Notification to the original parties or the parties\u2019 heirs.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">To update\nthe public records, the completed affidavit, along with any necessary\nsupporting materials, must go to the county recorder of deeds.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The\nCorrection Deed: Stronger Than a Scrivener\u2019s Affidavit<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Material\nchanges to the description of the property cannot be corrected by appending an\naffidavit and cover sheet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So, for\nexample, the wrong&nbsp;lot, as in the unlucky veteran&#8217;s case, or a\ndescription&nbsp;that states the wrong compass direction and thus changes the\nboundaries of the property, cannot be rectified with an Affidavit of Correction.\nThe deed has to be replaced with a correction deed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A&nbsp;correction\ndeed&nbsp;includes the information recorded on the previously recorded\n(erroneous) deed. It notes the mistake, and the accurate legal description.\nParties may not bring&nbsp;new names onto the deed, create any other new\ninterests, or modify the substance of the deed.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">With\nmaterial errors, both parties need to be aware of the corrective action, and\nboth must agree to the correction. Otherwise, a court order may be the only\nrecourse. Through a <em>deed\nreformation action<\/em>, a court&nbsp;may order&nbsp;the clerk of the\ncourt to correct (reform) a&nbsp;deed and resolve the problem.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The\nSteps to Create and Record a Correction Deed<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To create\nand record a correction deed, the preparer should obtain a copy of the current\ndeed, and take the following steps:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Step\n1. Obtain your correction deed form.<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Download the\ncorrect form, depending on the state in which the property is located and\nthat&nbsp;state&#8217;s&nbsp;<a href=\"https:\/\/www.deeds.com\/correction-deed\/\">requirements\nfor correction deeds<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Step\n2. Execute the&nbsp;correction deed.<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Usually, the\nseller must&nbsp;execute a correction deed, in accordance with&nbsp;state\nnotary and witness requirements.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Step\n3. Record the correction deed.<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">You may be\nable to re-record the same document with corrections. You might need a\nnew&nbsp;correction deed. Not only does state law vary; in many states, such as <a href=\"https:\/\/www.deeds.com\/forms\/pennsylvania\/correction-deed\/\">Pennsylvania<\/a>, county laws vary, too.
