You have options, and one of them may be a contract for deed. Also\nknown as an installment agreement or land contract, a contract for deed\ninvolves seller financing for the property. If you see a home sale ad offering\nowner financing, it\u2019s likely the seller has a contract for deed sale in mind.\nAnother advantage \u2013 the buyer and the\nseller may structure the agreement in a mutually agreeable fashion.<\/p>\n\n\n\n<p><strong>How\na Contract for Deed Works <\/strong><\/p>\n\n\n\n<p>A contract\nfor deed is not one-size-fits-all. It is an agreement tailored to the\nindividual needs of the buyer and seller, and offers great flexibility. The\ncontract for deed terms, negotiated by both parties, includes the down payment,\ninterest rates, amount of monthly house payments and how property taxes and\ninsurance are paid.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>The seller\nholds title to the property until the balance is paid. At that point, the\nseller transfers legal title to the buyer. Should the buyer default, the seller\nmay repossess the property. Depending on state law, the seller may have to\nreimburse the buyer for improvements made to the property should repossession\noccur.<\/p>\n\n\n\n<p>Keep in mind\nthat laws for contract for deeds vary by state, so it is critical to find out\nhow they are treated in the state in which the property is located. In some\nstates, the contract of deed must be registered with the county recorder within\na specific period, while in other states\nno such formal recording is necessary.<\/p>\n\n\n\n<p><strong>Contract\nfor Deed Advantages &nbsp;<\/strong><\/p>\n\n\n\n<p>For a buyer\nwho cannot obtain a traditional mortgage loan, a contact for deed offers them\nthe ability to buy a property. In addition, a contract for deed arrangement\ngenerally moves much more quickly than the mortgage process.<\/p>\n\n\n\n<p>A contract\nfor deed doesn\u2019t involve many of the expenses of a traditional mortgage,\nincluding closing costs and loan origination fees. &nbsp;While a contract for\ndeed doesn\u2019t require appraisal or home inspection, as does a traditional\nmortgage, it is a good idea for the buyer to pay for these items. You don\u2019t\nwant to find out the house is worth far less than you agreed to pay or that it\nhas serious structural defects.<\/p>\n\n\n\n<p>The buyer\ncan negotiate a down payment with the seller, which may prove far less than the\nusual 20 percent of the home\u2019s cost and won\u2019t involve costly private mortgage\ninsurance. If there is a reason a potential buyer doesn\u2019t want to reveal their\nfinancial records to a lender, that\u2019s another reason to consider a contract for\ndeed.<\/p>\n\n\n\n<p>For sellers,\none advantage of using a contract for deed is that, should the buyer default,\nthere is no long, drawn-out foreclosure process. The contract is terminated,\nand the seller gets their property back.<\/p>\n\n\n\n<p><strong>Contract\nfor Deed Disadvantages <\/strong><\/p>\n\n\n\n<p>Unlike a\ntraditional mortgage, a contract for deed is seldom in place for long periods,\nas is the case with the typical 30-year mortgage. On average, the length of a\ncontact for deed is five years, although the seller and buyer can agree to any\nterm length. The average contract for deed ends in a balloon payment at the end\nof the term.<\/p>\n\n\n\n<p>A major\ncontract for deed disadvantage is that equity is not built up in the property\nas the buyer makes payments, so if they default, they have lost any funds\ncontributed to the home purchase. There\u2019s also the question of title. A\nstandard mortgage requires clear title to the property before the lender will approve\nthe loan. That\u2019s not the case with a contract for deed, unless the buyer\ninsists, which is a wise idea. Otherwise, when that last payment is finally\nmade and the buyer thinks they own the dwelling, it could turn out that the\nproperty\u2019s title is murky. Since the seller owns the property up to that final\npayment, they could also incur liens on the property that affect the title. For\nexample, if the seller doesn\u2019t pay his federal income taxes, the IRS may put a\nlien on the property. Since the seller still owns the home, they are able to\ntake out a home equity loan on the property, and that is also a lien. That\ncould mean the buyer is out of luck when it comes to obtaining the title.<\/p>\n\n\n\n<p>For the\nseller, the biggest disadvantage of a contract for deed is that they will not\nreceive all of their funds until the end of the contract. With a traditional\nmortgage, they receive the funds for the sale at closing.<\/p>\n\n\n\n<p><strong>Contract\nfor Deed Considerations<\/strong><\/p>\n\n\n\n<p>If you\ncannot obtain a traditional mortgage, a contract for deed is a viable option.\nIf you can qualify for a mortgage, that\u2019s probably a better route.
