Don\u2019t even<em> think<\/em> about giving up that deed until you read this.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Look Out for Predatory Tactics, Pennsylvania Says.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Pennsylvania now regulates the \u201cwe buy your home\u201d wholesalers. These are the businesses that put up road signs, send out text messages, voicemails, and leaflets, and even go door-to-door to get owners to sign contracts. Their core goal? Snagging homes for less than fair market value.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The \u201cwe buy your home\u201d people come with purchase contracts. They are ready to give the deed holders a certain price. They also have end buyers lined up to immediately receive the homes. Some sellers have parted with their deeds, then seen their homes promptly listed on social media for substantially higher prices. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Using the wholesaling model, these salespeople don\u2019t need to hold the deeds in their own names at any point. Indeed, wholesalers tout their ability to earn profits in the real estate market by controlling deeds \u2014 but not actually buying the homes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Social media influencers promote wholesaling, offering tips and courses. But one person\u2019s profit is another person\u2019s loss. In some of these agreements, deed holders can lose as much in home value as they get from the wholesalers. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Perhaps There Ought to Be a Law&#8230;<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full is-style-rounded is-style-rounded--2\"><img loading=\"lazy\" decoding=\"async\" width=\"500\" height=\"375\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2024\/07\/perhaps-there-ought-to-be-a-law.webp\" alt=\"\" class=\"wp-image-5882\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2024\/07\/perhaps-there-ought-to-be-a-law.webp 500w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2024\/07\/perhaps-there-ought-to-be-a-law-300x225.webp 300w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">That\u2019s what Pennsylvania thought. Its governor, Josh Shapiro, just signed a bill into law that bans wholesaling without a real estate license. Wholesalers are about to be regulated. And that means, effective January 2025, the Pennsylvania Real Estate Commission will provide consumer protection for people who sell their homes to the \u201cwe want to buy your house\u201d people.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wholesalers also must explain to deed holders how the transaction works, and that sellers have a right to an attorney and an appraisal. And the law will make it easier for Pennsylvania deed holders to cancel these agreements. They\u2019ll get 30 days to change their minds, or any time up until they officially transfer the deed \u2014 whichever happens first.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All Pennsylvania\u2019s residential properties (that accommodate between one and four households) will now be afforded these consumer protections. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Philly Led; Pennsylvania Followed.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Several years ago, a collective that included Community Legal Services of Philadelphia and real estate agents\u2019 industry groups worked to get a new law in place to protect deed holders in the city. So Philly\u2019s consumer protections are already in effect. Here\u2019s what the Philly provisions mainly do:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Mandate city real estate licensing for residential real estate wholesalers.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Require wholesalers to inform the people they pitch their services to about related consumer rights.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Maintain a registry, known as the <em>Do Not Solicit<\/em> list, so deed holders may shut off unsolicited \u201cwe want to buy your home\u201d messages.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Philadelphia deed holders targeted by unlicensed wholesalers have the legal right to get out of the contracts. There\u2019s also a buffer of waiting time from when a deed holder is told their rights, and when they can sign an agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new Pennsylvania law isn\u2019t new after all. It\u2019s just following in Philadelphia\u2019s footsteps.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Oregon\u2019s Making a Similar Move.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As <em>Deeds.com <\/em>noted earlier this year, <a href=\"https:\/\/www.deeds.com\/articles\/legal-news-oregon-starts-restricting-real-estate-wholesalers\/\">Oregon\u2019s governor has signed a similar bill into law<\/a>. Oregon\u2019s law, too, goes into effect in January 2025. It\u2019s the first time Oregon has ever taken steps to hold residential real estate wholesalers accountable to a set of legal standards and limits.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are other similarities between Pennsylvania\u2019s and Oregon\u2019s new deed wholesaling laws. In Oregon, both housing advocates and agents\u2019 groups pressed for regulation, calling it a matter of transparency and necessary consumer protection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Oregon\u2019s new law overhauls its real estate regulations. For starters, it requires brokers to have written agreements with their buyer and\/or seller clients. All agents and brokerages, wholesalers included, must give both sellers and buyers their contact details and other assurances of transparency and fair dealing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Other provisions in Oregon\u2019s law are about to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Bring buyers and sellers into agent fee-setting decisions. Oregon brokers may not promise to share agent commissions with buyers. They can negotiate fees, though, in an open, transparent process. So, buyers\u2019 and sellers\u2019 agents will no longer be allowed to make behind-the-scenes fee-splitting rules.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ban cash for listings. A <a href=\"https:\/\/www.deeds.com\/articles\/seniors-advocates-urge-states-to-ban-predatory-cash-for-listing-contracts\/\">cash for listing offer<\/a> commits a deed holder who accepts a sum of money to working only with one particular broker should they ever sell their homes. Marketed as \u201cbenefits\u201d to the sellers, these contracts lure elders and financially struggling homeowners into contracts that control their deeds beyond their lifetimes in some cases.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Also of note, Oregon has established a registration portal for people engaged in deed wholesaling. It\u2019s managed by the Oregon Real Estate Agency \u2014 the state office to which all brokers report.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Other States Are Weighing In.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Here are a few other states to have entered the fray:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/thechicagolandlawyer.com\/2023\/02\/19\/wholesaling-houses\/\" target=\"_blank\" rel=\"noreferrer noopener\">Illinois<\/a> was a frontrunner. Determined to stop people who preyed on struggling deed holders\u2019 home equity, the state outlawed residential real estate transactions by unlicensed people effective 2020. Hefty fines are included.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Just a bit later in <a href=\"https:\/\/oklahoma.gov\/orec\/resources\/blog\/wholesale-act.html\" target=\"_blank\" rel=\"noreferrer noopener\">Oklahoma<\/a>, lawmakers passed the Predatory Real Estate Wholesaler Prohibition Act. It went into effect in late 2021.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/blog.northstateequity.com\/south-carolina-wholesale-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">South Carolina<\/a> has effectively banned residential property wholesaling. Bad press about some actors involved in the practice influenced this lawmaking.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/josephandjoseph.com\/articles\/wholesaling-real-estate-ohio-need-brokers-license\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ohio<\/a> law penalizes abusive cases of wholesaling, with fines up to $1,000 per day.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.legis.iowa.gov\/legislation\/BillBook?ga=90&amp;ba=HF2394\" target=\"_blank\" rel=\"noreferrer noopener\">Iowa\u2019s law<\/a> regulating wholesaling just took effect in July 2024. It forces disclosures about the wholesaling model to deed holders. It allows them to cancel if wholesalers don\u2019t follow the law. It also imposes significant fines for noncompliance. <a href=\"https:\/\/www.azleg.gov\/legtext\/55leg\/2R\/laws\/0170.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Arizona<\/a> has passed a similar provision.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In <a href=\"https:\/\/www.trec.texas.gov\/article\/results-trec%E2%80%99s-wholesaling-texas-survey\">Texas<\/a>, wholesalers have to follow disclosure rules, and the practice is being studied for possible future lawmaking.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?241+sum+HB917\" target=\"_blank\" rel=\"noreferrer noopener\">Virginia<\/a> now regulates wholesalers as brokerages. In <a href=\"https:\/\/apps.legislature.ky.gov\/record\/23rs\/hb62.html\" target=\"_blank\" rel=\"noreferrer noopener\">Kentucky<\/a> and in several other states, too, unlicensed salespersons aren\u2019t permitted to engage in wholesaling.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And the <a href=\"https:\/\/www.youtube.com\/watch?v=ClNO4U7P8qQ\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">wholesaler influencers<\/a> don\u2019t seem too happy about all these regulatory moves.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">For the Wholesaling Business, Is the Writing on the Wall?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One thing seems clear. Those who market deeds they don\u2019t hold, and reassign their contracts to other buyers, could be engaging in unlicensed real estate deals. And such deals are increasingly under scrutiny.
