You hold a deed, but can\u2019t keep up with your <a href=\"https:\/\/www.deeds.com\/articles\/omg-these-unbearable-housing-costs\/\">housing costs<\/a>. And you definitely want to avoid having a foreclosure on your credit history.<\/p>\n\n\n\n<p>What should you do now? A <em>deed in lieu of foreclosure<\/em>? Or perhaps a <em>short sale<\/em>?<\/p>\n\n\n\n<p>First, know that lenders tend to prefer short sales. A short sale in a time of high property values might take care of a deed holder\u2019s entire mortgage debt.<\/p>\n\n\n\n<p>Granted, pulling off a short sale takes a good deal more time than a deed in lieu. But with a deed in lieu, you give your home to the lender. This is a last-resort alternative to foreclosure.<\/p>\n\n\n\n<p>With that introduction, let\u2019s walk through a Q&amp;A.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">First, Should Foreclosure Be Avoided at All Costs?<\/h2>\n\n\n\n<p>A foreclosure hits a credit profile harder than its alternatives. But not by much. And foreclosure gets the job over and done. That said, foreclosure is an expensive, time-consuming, and all-around unpleasant experience.<\/p>\n\n\n\n<p>So, first, are you sure your situation is as serious as you think it is? Perhaps the lender would extend a repayment plan, or modify your loan. Talk to the mortgage company and be sure you understand your range of options.<\/p>\n\n\n\n<p>If you decide to try to avoid foreclosure, ask the mortgage servicer for a loss mitigation application. It will be a short sale request, or a deed in lieu request. You\u2019ll submit tax returns, account statements, and details of your monthly income and expenses.<\/p>\n\n\n\n<p>But what\u2019s the better form of mitigation: deed in lieu, or short sale? Let\u2019s take a brief look at each of these, along with their pros and cons.<strong><em><\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A Short Sale: Often the Best Way Out of Debt<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full is-style-rounded is-style-rounded--2\"><img loading=\"lazy\" decoding=\"async\" width=\"515\" height=\"772\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2024\/08\/short-sale.webp\" alt=\"\" class=\"wp-image-5953\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2024\/08\/short-sale.webp 515w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2024\/08\/short-sale-200x300.webp 200w\" sizes=\"auto, (max-width: 515px) 100vw, 515px\" \/><\/figure>\n\n\n\n<p>If you see <em>pre-foreclosure<\/em> sales, that means the deed holder is attempting a short sale. How does it work?<\/p>\n\n\n\n<p>A deed holder falls behind on a mortgage debt and goes into a &nbsp;default situation. A short sale could be the best way out of the jam. So the deed holder submits a statement declaring:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The property value falls short of the mortgage debt.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The deed holder lacks other assets to liquidate.<\/li>\n<\/ul>\n\n\n\n<p>When you apply to a lender to do a short sale, you\u2019re responsible for selling your home. This leaves you with more control than you\u2019d have if you just let a foreclosure happen.<\/p>\n\n\n\n<p>Struggling to find an offer high enough to pay off your loan balance? This setback is actually progress when you\u2019re applying for loss mitigation options. If you can find a buyer, but the sale won\u2019t cover the full mortgage balance, this would be a short sale.<\/p>\n\n\n\n<p>In short sales, buyers generally fund the inspection and repairs. But it\u2019s best to keep your home in good shape, and get a decent bid. Your short sale depends on lender approval \u2014 and your ability to actually sell your home.<\/p>\n\n\n\n<p>Assuming your lender agrees to the terms of the sale, you\u2019ll market the home and go to the closing. Your lender will get the sale proceeds and release its lien from the home title. Then you\u2019ll transfer your deed to the buyer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What\u2019s the Main Downside to a Short Sale?<\/h2>\n\n\n\n<p>Do you have other debts secured by your home? Perhaps an HOA lien, a second mortgage against your <a href=\"https:\/\/www.deeds.com\/articles\/borrowing-against-your-equity-helocs-home-equity-loansand-interest-rates\/\">home equity<\/a>, or a judgment lien? The lienholders will have to green-light any sale. They\u2019ll only do that if they think there\u2019s some advantage for them. So, your mortgage lender will likely need to offer incentives to your other creditors.<\/p>\n\n\n\n<p>And if you can pull off a sale, here\u2019s what could be the worst rub. Depending on state law, a deed holder could face a <em>deficiency judgment<\/em>. That is, if the sale doesn\u2019t satisfy the whole debt, your lender can go after a personal judgment against you.<\/p>\n\n\n\n<p>Will the lender provide a written waiver of any deficiency in your short sale agreement? Watch closely. You might do better to let the home go into foreclosure if that lets you out of a big deficiency debt.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Deed in Lieu: When the Lender Takes Your Deed<\/h2>\n\n\n\n<p>In French, <em>lieu<\/em> (pronounced <em>loo<\/em>) means place. So, <em>in lieu of<\/em> means <em>in place of<\/em>. With a deed in lieu, a lender accepts your deed in place of foreclosure proceedings. You transfer your home\u2019s title to your lender in return for a <em>mortgage release<\/em>.&nbsp;<\/p>\n\n\n\n<p>Remember, this is the transfer of last resort. For deed holders who lack home equity, it\u2019s a way to let go of a home that\u2019s become too much of a financial burden.<\/p>\n\n\n\n<p>When the deed in lieu process concludes, you\u2019ll likely transfer your title with a&nbsp;<a href=\"https:\/\/www.deeds.com\/quitclaim-deed\/\">quitclaim deed<\/a>. A lender may consider accepting your quitclaim instead of foreclosing once your real estate agent shows records that your home\u2019s been marketed for several months.<\/p>\n\n\n\n<p>Here again, you\u2019ll fill out a hardship affidavit. Following the lender\u2019s approval, you\u2019ll receive a deed to sign and transfer to the lender. You\u2019ll get a statement explaining the terms. You\u2019ll sign, to show you agree with the terms. Look for the text saying your deed transfer satisfies the debt fully. If, instead, your lender reserves the option of pursuing a deficiency judgment, what then? Before signing the statement, ask the lender to forgive or reduce your deficiency. Remember that a foreclosure with no deficiency judgment might be preferable to a deed in lieu in this aspect.<\/p>\n\n\n\n<p>On the other hand, with the deed in lieu, a lender may grant you more time in your home than a foreclosure eviction would allow.<\/p>\n\n\n\n<p>Indeed, there\u2019s no eviction with a deed in lieu. You are letting go of your deed voluntarily. Your lender may let you buy time by renting the home to you while you prepare to move. Why would the lender agree? Because banks are not fans of foreclosing. Some will help borrowers who want to avoid foreclosures.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What\u2019s the Main Downside to a Deed in Lieu?<\/h2>\n\n\n\n<p>The deed in lieu comes with a number of drawbacks:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>With a deed in lieu, you\u2019re handing your home over to the lender. That\u2019s the main downside.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In some states, the deed holder may face a deficiency judgment. If the home can\u2019t satisfy the whole debt, a personal judgment may be filed against you for the rest.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-accent-5-background-color has-background\" style=\"padding-top:var(--wp--preset--spacing--10);padding-right:var(--wp--preset--spacing--10);padding-bottom:var(--wp--preset--spacing--10);padding-left:var(--wp--preset--spacing--10)\"><em><strong>Facing a deficiency judgment?\u00a0In some cases, a <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/can-filing-for-bankruptcy-save-a-home-from-foreclosure\/\"><strong><em>bankruptcy<\/em><\/strong><\/a><em><strong> filing makes sense. Where Do I Start?<\/h2>\n\n\n\n<p>Speak to your lender about a loss mitigation application. The lender will ask you to submit a hardship statement, backed with proof of your financial situation and recent tax returns. Set forth in writing any serious change of circumstances you\u2019ve facing \u2014 a divorce, a job disruption, or medical needs. In these situations, after a deed in lieu or short sale, you could apply for a conventional loan again sooner than the standard seven-year bar if you let the home go into foreclosure. <a href=\"https:\/\/sadeklaw.com\/2024\/03\/08\/fha-bankruptcy-waiting-period\/#:~:text=The%20waiting%20period%20can%20vary,qualify%20for%20an%20FHA%20loan.\" target=\"_blank\" rel=\"noreferrer noopener\">FHA loans<\/a> are generally available sooner (three years after a foreclosure or any of its alternatives).\u00a0<\/p>\n\n\n\n<p>Remember to ask if the lender helps borrowers who seek new housing after averting foreclosure. In any case, keep your long-term housing needs in mind.
