But does it <em>ever<\/em> matter? Some say it does, and we\u2019ll hear from one such person in this article. Let\u2019s dive in.&nbsp;&nbsp; &nbsp;&nbsp;<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Rights? Duties? No Difference at All.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Name order has zero bearing on the deed holders\u2019 ownership rights or duties. So, if you are a co-owner who\u2019s named second on a deed, rest assured you have not given up any advantages simply because your name appears second.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nor does your name order have any effect on how real estate assets get distributed between divorcing co-owners. Or to heirs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nor does the name order have any effects on the chain of title. Nor does it make either owner less or more responsible for the taxes or any other financial commitments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a new co-owner is receiving a property interest, the earlier owner might appear first on the new deed for that reason. This could be done simply for ease of reference. Again, it says nothing about the parties\u2019 rights or responsibilities.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Turnabout Is Fair Play.<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full is-style-rounded is-style-rounded--2\"><img loading=\"lazy\" decoding=\"async\" width=\"832\" height=\"551\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2024\/08\/turnabout-is-fairplay.webp\" alt=\"\" class=\"wp-image-5957\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2024\/08\/turnabout-is-fairplay.webp 832w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2024\/08\/turnabout-is-fairplay-300x199.webp 300w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2024\/08\/turnabout-is-fairplay-768x509.webp 768w\" sizes=\"auto, (max-width: 832px) 100vw, 832px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Some lenders, real estate lawyers, and title firms print a man\u2019s name before a woman\u2019s (\u201chusband and wife\u201d) by default. But some offices have dropped the old habits \u2014 preferring to arrange deed holders\u2019 names alphabetically, or reversing the usual name order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some might use a couple\u2019s previous deeds, if there are any, and repeat the name order these co-owners used in past co-ownerships. And many firms put the person who was their first contact first on all the paperwork.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perhaps the best default of all? Let\u2019s just ask future deed holders how they would like their names to appear.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Much Ado About David?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Back in 1987, a Californian named Molly Selvin wrote an opinion piece for the <em>L.A. Times,<\/em> titled \u201cWhich Name Goes First \u2014 Hers or His?\u201d (We caught that spoiler in the title!)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The facts went like this. Selvin refinanced her solely owned deed and brought on a new co-owner, David. Selvin wrote her name on the application as borrower, and David as co-borrower.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That makes sense, right? If a sole owner brings a second owner onto the title, well\u2026 Listing that new owner second seems natural.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Later on, Selvin received mail from the lender and escrow firm. The mail would come addressed either to David alone, or with David\u2019s name appearing first. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAnd the more often I request my name first and discover it has been placed second,\u201d wrote Molly Selvin, \u201cthe more I \u2014 perhaps petulantly \u2014 want it first.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Selvin chafed at \u201cthose computers or clerks who automatically insist on putting me in second place\u201d:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>We seem to still assume that when a couple buys a house or a car, his preferences and his money dominate the decision making. We still assume, literally, that the man comes first.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Well, if you\u2019re reading this, Molly Selvin, thanks for exploring this topic in such a relatable way.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">About Your Mortgage Agreement: Talk to the Lender in Advance.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Financing your home purchase by putting an additional person\u2019s name on your mortgage application? Your co-borrower might boost your chances of getting an approval for the mortgage. But these days, many lenders will only agree to this if the co-borrower is willing to take an ownership stake in the home you choose to buy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In short, a co-borrower with strong credit can enable you to buy a home you couldn\u2019t buy alone. If you go this route, draw up a separate agreement saying who will live in the home, and who will make mortgage payments \u2014 and how much for each person. Perhaps you mutually agree that your co-borrower will pay zero. Your plan might be to refinance and get the property in your own name in, say, one year. That would be stated in your separate agreement. Have a lawyer draw up the agreement that works for both of you. &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--10);padding-right:var(--wp--preset--spacing--10);padding-bottom:var(--wp--preset--spacing--10);padding-left:var(--wp--preset--spacing--10)\"><em><strong>Life changes. Here\u2019s how to <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/taking-a-co-borrower-off-a-mortgage-three-ways\/\"><strong><em>remove a co-borrower<\/em><\/strong><\/a><em><strong> from your mortgage.<\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now, to the point. If you apply for a mortgage with a co-borrower \u2014 often a spouse, partner, or friend \u2014 you might assume the first to be named on loan documents is on the bigger hook for repayment. So, is the first-named buyer the one with the stronger credit? Or is the first-named buyer the one who will occupy the home?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not necessarily either.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lender is not interested in which name comes first on loan documents. The lender\u2019s interest involves understanding the co-applicants\u2019 credit profiles, earnings, savings, and debts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That said, some lenders show one person (usually the one who will live in the home, if just one of the two will live there) as <em>primary borrower<\/em> on the documents. Or, if a couple is buying a home to live in together, the lender might consider the person with the higher income as primary borrower. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your mortgage agreement gets recorded in the public records. It may state your sex and marital status after your name. That\u2019s not there because of a title company\u2019s call \u2014 unless the deed is moving between family members and the title agent thinks the language could show that transfer taxes are or aren\u2019t required. But the lender creates the mortgage agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So, will you have a co-borrower on your mortgage? Your mortgage will probably be issued to match the way you typed co-borrowers\u2019 names on your loan application. Want to be sure? Tell your mortgage consultant upfront how you\u2019d like your names to appear on your legal documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Note:<\/em><\/strong> A co-borrower and a co-signer aren\u2019t the same thing. With a co-borrower, both of you will typically be named on the deed <em>and<\/em> responsible for the loan repayment. If you merely get a co-signer, only you will be named on the deed, while the mortgage company can hit either of you up for the loan repayment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Let\u2019s Just Remember the Basics.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A deed transfers real estate. That\u2019s all it has to do. A valid&nbsp;deed identifies the parties so&nbsp;that a court could&nbsp;identify them. There\u2019s no rule about name order. There\u2019s no requirement to discuss gender. So it\u2019s fine to use inclusive terms on real estate papers. Are gendered terms necessary? No. Using generic terms like <em>spouses, applicants, buyer <\/em>and so forth works just fine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So there we have it, friends.
