But in the hands of forgers and swindlers, these instruments harm people. Especially seniors, the families of deceased homeowners, and people who don\u2019t live in their homes. But actually, anyone could be caught up in a scam.<\/p>\n\n\n\n<p>Sensing an opportunity in people\u2019s fear of being swindled, deed theft prevention companies have sprung up.<\/p>\n\n\n\n<p>But governments need to step up, and protect their residents from this noxious form of <a href=\"https:\/\/www.deeds.com\/articles\/?s=fraud\">fraud<\/a>.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Untrustworthy Trust<\/h2>\n\n\n\n<p>Sometimes, swindlers can ensnare wealthy deed holders, too. Craig A. (a real homeowner) got a startling call from his homeowner\u2019s association. His multi-million-dollar Raleigh home had been transferred into a certain Dawn M. Trust.<\/p>\n\n\n\n<p>Dawn Mangum had asked the association for a gate key. That\u2019s when the association called Craig.<\/p>\n\n\n\n<p>The startled homeowner headed to the Register of Deeds of Wake County, North Carolina. What was going on? Dawn M. (a real swindler) had created a falsified deed. Wake County recorded it.<\/p>\n\n\n\n<p>In North Carolina, as in many states, county clerks take and immediately record the documents presented to them. It\u2019s not their task to validate or invalidate a deed. Nor do the deed recorders check the bona fides of the notary or the person signing a deed away.<\/p>\n\n\n\n<p>An <em>ABC11 Troubleshooter<\/em> report publicized the story. Dawn M. has now been charged under the state\u2019s criminal law. And still, the county can\u2019t invalidate the bad deed without a court order. It will cost Craig thousands of dollars to file a civil suit as the county suggested.<\/p>\n\n\n\n<p>Some states are changing this game. More and more legislatures are saying that county officers should verify the deeds they record. Which brings us to Georgia.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Misdeeds in Georgia<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full is-style-rounded is-style-rounded--2\"><img loading=\"lazy\" decoding=\"async\" width=\"600\" height=\"458\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2024\/10\/missdeeds-in-georgia.webp\" alt=\"\" class=\"wp-image-6048\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2024\/10\/missdeeds-in-georgia.webp 600w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2024\/10\/missdeeds-in-georgia-300x229.webp 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/figure>\n\n\n\n<p>Georgia lawmakers want stronger laws against fraudulent deeds. Under current law, anyone can present a deed for recording without showing an ID or proof of ownership. But now there\u2019s <a href=\"https:\/\/www.billtrack50.com\/billdetail\/1707755\" target=\"_blank\" rel=\"noreferrer noopener\">House Bill 1292<\/a>, signed into law in 2024. The new Georgia law will:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Require identification when individuals present deeds to the recorder\u2019s office.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Broaden penalties for deed forgery.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Open a pathway to the civil courts to address deed fraud, with recovery of attorney&#8217;s fees and court costs for certain <a href=\"https:\/\/www.deeds.com\/articles\/what-is-a-quiet-title-action\/\"><em>quiet title<\/em><\/a> cases.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Require notaries to keep detailed records, and take courses that cover fraud awareness.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Make electronic recording the default rule when individuals (as opposed to real estate professionals) present deeds to the recorder\u2019s office.<\/li>\n<\/ul>\n\n\n\n<p>All of this comes after <em>Misdeeds,<\/em> an Atlanta News First investigative series, highlighted Georgia\u2019s deed theft problem. The series focused on victims like:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Robert E., who had lived in the same Atlanta home for five decades when the deed was improperly transferred by his stepson.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Brenda B., whose sister\u2019s deed was stolen after her death.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Eric C., who got back from a trip to find a foreclosure auction notice on his door.<\/li>\n<\/ul>\n\n\n\n<p>The new deed protection law takes effect New Year\u2019s Day, 2025.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Order in the Court<\/h2>\n\n\n\n<p>A company called ARLO 67 LLC called Ayisha D. to say: \u201cWe purchased your uncle\u2019s interest in the house, so we own half the house.\u201d Ayisha\u2019s uncle Walter inherited the home in Brooklyn\u2019s Bedford-Stuyvesant neighborhood, along with Ayisha\u2019s mother. But Walter had long been estranged from the family. Ayisha\u2019s mother had faithfully maintained the home and paid its bills for many years.<\/p>\n\n\n\n<p>The next bombshell was the default judgment from a foreclosure court. An investor who acquires an interest in a co-owned home may ask the courts to force a <a href=\"https:\/\/www.deeds.com\/articles\/losing-the-family-home-to-partition-law\/\"><em>partition sale<\/em><\/a>; apparently, that happened here. And then the home was auctioned off to ARLO 67 \u2014 which actually proceeded to sue Ayisha for living in it.<\/p>\n\n\n\n<p>An LLC can \u201cbury you in a mountain of paper,\u201d Doyle told the <em>Amsterdam News<\/em>. As for the work and cost of trying to recover a home: \u201cIt\u2019s just on you.\u201d &nbsp;<\/p>\n\n\n\n<p>The case, reports the <em>Amsterdam News,<\/em> has gone through five different courtrooms.&nbsp;<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background\" style=\"padding-top:var(--wp--preset--spacing--10);padding-right:var(--wp--preset--spacing--10);padding-bottom:var(--wp--preset--spacing--10);padding-left:var(--wp--preset--spacing--10)\"><em><strong>Leaving your home to multiple people? Want to avoid the risk of a partition sale? One option is to create a <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/can-i-quitclaim-my-house-into-a-living-trust\/\"><strong><em>family trust<\/em><\/strong><\/a><em><strong>.<\/strong><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Know the Score<\/h2>\n\n\n\n<p>New York Attorney General Letitia James has heard too many stories like Ayisha\u2019s. In 2023, <em>Deeds.com <\/em>readers may recall, James announced the addition of a new crime in New York: <a href=\"https:\/\/www.deeds.com\/articles\/deed-theft-crackdown-new-yorks-on-a-roll\/\">deed theft<\/a>.<\/p>\n\n\n\n<p>This year, James announced that several people including a disbarred lawyer would go to prison for a million-dollar deed fraud scheme in New York City. The disgraced lawyer pleaded guilty to forging legal documents used in the scheme.<\/p>\n\n\n\n<p>The ring \u201ctook advantage of elderly and vulnerable homeowners,\u201d said AG James when announcing the sentencing in Queens County Court.<\/p>\n\n\n\n<p>A former mortgage consultant advertised the homes to investors. Accomplices stood by, ready to impersonate the true owners at closings. The swindlers used fake IDs to open bank accounts under the true owners\u2019 names. Until the music stopped.<\/p>\n\n\n\n<p>\u201cWe are making them pay,\u201d said James.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Deeds: Can Texans Hold \u2018Em?<\/h2>\n\n\n\n<p>In Texas, the House Committee on Business and Industry recently held hearings on deed theft. They listened to disturbing testimony from people who had lost their titles to swindlers.<\/p>\n\n\n\n<p>Norma in South Dallas testified that she got a call one day, telling her that a piece of land she owned was being cleared. Norma went to the county deed recorder\u2019s office, and found out what was going on. A falsified deed had been recorded. It had clear signs of tampering \u2014 even crossed-out text. But there it was, in the official records.<\/p>\n\n\n\n<p>For most of this year, Norma has been struggling in the civil court system to recover her title. Two people have been charged in the scam.<\/p>\n\n\n\n<p>So far, Norma has spent thousands of dollars on the case. Many people lack the money it takes to deal with a case like Norma\u2019s.<\/p>\n\n\n\n<p>Now, the Dallas County District Attorney\u2019s office wants Texas lawmakers to follow New York\u2019s lead. Can the state write deed theft into the criminal code? We\u2019ll be watching.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A Detroit Nonprofit Exposed<\/h2>\n\n\n\n<p>A story out of Michigan could be the most bizarre of all. Detroit resident Zina T. was charged this year with forging more than 30 quitclaims. Most of the ill-gotten gains were transferred into a nonprofit she runs, the United Community Housing Coalition, before being sold off to buyers.<\/p>\n\n\n\n<p>The nonprofit was supposedly helping struggling deed holders avoid foreclosures. But it was actually taking those people\u2019s deeds away.<\/p>\n\n\n\n<p>Deed scams have been crushing people financially for years in <a href=\"https:\/\/www.deeds.com\/articles\/deeds-scams-are-ruining-lives\/\">Detroit<\/a>. It\u2019s been so prevalent, that people feel this is just the way things go in Detroit, and there\u2019s no one to turn to for help.<\/p>\n\n\n\n<p>But finally, House Bill 5598\/5599 could bring reforms. If passed, the amendments will:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Establish a felony for anyone attempting to <a href=\"https:\/\/fastdemocracy.com\/bill-search\/mi\/2023-2024\/bills\/MIB00024653\/\" target=\"_blank\" rel=\"noreferrer noopener\">falsify a property deed<\/a>. The crime will be \u201cpunishable by up to 10 years\u2019 imprisonment, a fine of up to $5,000, or both.\u201d<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Connect deed recorders to county prosecutors who can review property documents.<\/li>\n<\/ul>\n\n\n\n<p>This reform is in the committee review process. We\u2019ll keep you posted.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What You Can Do<\/h2>\n\n\n\n<p>Visit the website of your county Recorder of Deeds. Many counties now offer free fraud alert emails. Opt in, and you\u2019ll know if there\u2019s any activity on your deed. That can help you report a fraud <em>before<\/em> the perpetrator can pass off your deed to another buyer.<\/p>\n\n\n\n<p>If your county doesn\u2019t have an alert system, ask if and when they plan to set one up.
