The short answer: No.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Misconceptions\nand Realities<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">It is a\nmisconception that someone can be \u201cremoved\u201d from the deed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nor can a\nco-owner simply take away another party\u2019s interest in a property by executing a\nnew deed without that other party.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In short, no\none can be passively removed from a title.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.deeds.com\/articles\/adding-someone-to-your-real-estate-deed-know-the-risks\/\">Even\nif an owner \u201cadded\u201d someone else to the real estate deed<\/a> previously, the\nfirst owner cannot reconsider and take the second person off the deed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Why?<\/p>\n\n\n\n<!--more-->\n\n\n\n<ul class=\"wp-block-list\">\n<li>By conveying an interest in property ownership, the first owner legally gave the second owner the same bundle of rights held by the first;<\/li>\n\n\n\n<li>Therefore, that conveyance cannot later be undone\u2014except with the additional owner\u2019s consent.  <\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If the\nco-owners agreed to be named on the title at the time of its conveyance, and no\nowner is willing to relinquish an interest in the property, then both are, and\nboth remain, the property\u2019s legitimate owners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The only way to <strong>forcibly<\/strong> change the ownership status is through a legal action and the resultant court order. However, if an <strong>owner chooses to be removed<\/strong> from the deed, it is simply a matter of preparing a new deed transferring that owner&#8217;s interest in the property.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quiet\nTitle Actions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">What if\nsomeone\u2019s claim must&nbsp;be removed to correct the chain of title? The <a href=\"https:\/\/www.deeds.com\/articles\/what-is-a-quiet-title-action\/\">quiet title\naction<\/a> is the appropriate legal action to clear up defects on a property\ntitle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If some\nparty is improperly named on the title, can the impropriety be demonstrated in\ncourt? If so, a&nbsp;court, as a result of the quiet title action, can clear\nthe defects and legally establish a buyer\u2019s rightful place in the chain of\ntitle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example,\nforgery, coercion, or some form of deed fraud might exist in a property\u2019s\nconveyance history. If so, a successful&nbsp;quiet title action will&nbsp;clear\nup the title for good.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Divorce\nDecrees<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"512\" height=\"512\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2023\/12\/divorce-and-the-quitclaim-deed-1.png\" alt=\"\" class=\"wp-image-3533\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2023\/12\/divorce-and-the-quitclaim-deed-1.png 512w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2023\/12\/divorce-and-the-quitclaim-deed-1-300x300.png 300w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2023\/12\/divorce-and-the-quitclaim-deed-1-150x150.png 150w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2023\/12\/divorce-and-the-quitclaim-deed-1-100x100.png 100w\" sizes=\"auto, (max-width: 512px) 100vw, 512px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">In divorce, the court may order one ex-partner to execute a new deed that results in only one person retaining an interest in the home. A&nbsp;<em><a href=\"https:\/\/www.deeds.com\/quitclaim-deed\/\">quitclaim deed<\/a><\/em> is common.&nbsp;It releases (\u201cquitclaims\u201d) one partner\u2019s property interest, leaving the whole interest to the other partner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To keep the\ntitle free from ambiguity:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Both partners should sign the quitclaim deed. The spouse who is leaving the home is the <em>grantor <\/em>to the party who is receiving the entire interest.  <\/li>\n\n\n\n<li>The deed must release the <em>whole <\/em>property, and not just a half interest.<\/li>\n\n\n\n<li>Following state law, the quitclaim deed should be accompanied by the divorce decree, or refer to it\u2014including the court, case number, and the date of the decree.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In some states, divorcing spouses may use the quitclaim deed to convey property; in other states,\u00a0a <em>deed without warranty <\/em>is standard. In either case, a form is used to relinquish a\u00a0property interest without creating any new title liabilities. Divorcing parties must follow state-specific legal\u00a0formats\u00a0(such as Minnesota&#8217;s\u00a0<a href=\"https:\/\/www.deeds.com\/forms\/minnesota\/quitclaim-deed-divorce\/\">quitclaim and marital lien<\/a>\u00a0form).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An ex-spouse\nwho is ordered to relinquish the property interest but fails to do so can be\nheld in contempt of court, leading to fines, jail time, or both.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Note:\nA&nbsp;quitclaim only releases a person from the deed, not the mortgage\nliability. Therefore, refinancing&nbsp;or selling is common in divorces when\nthe home has a&nbsp;mortgage.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Partition\nActions&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A <em>partition<\/em>&nbsp;is a legal\naction that results in the court-ordered sale of a jointly owned property. When\ntwo or more owners disagree on how to use the property, any owner&nbsp;may file\na partition action. Typically, the property is then sold to a new buyer. The\nsale proceeds must be divided among the owners according to their portion of\nownership interests. In rare cases, a court may be able to order a property to\nbe physically split up for the owners to keep their own proportionate sections\nof the real estate\u2014but for obvious reasons, this is impossible to do for a\nhouse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A partition\nmay be needed, for example, when the adult children of a deceased parent\nreceive joint ownership of a family property, and disagree on what to do with\nit. When a partnership\u2014personal or commercial\u2014breaks up, a similar need can\narise to divide the ownership interest in a property that was jointly held.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No party has\nthe right to stop a court-ordered sale of the property by physically remaining\non it. Yet if&nbsp;the&nbsp;court-ordered sale is a&nbsp;public auction, rather\nthan handled through a real estate listing, an owner who does not wish to give\nup the property&nbsp;can attempt to acquire the site&nbsp;through bidding on\nit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A partition\naction may require a detailed accounting of owners\u2019 contributions to\nmaintenance, insurance, and taxes, as well as any income earned through the\nproperty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The\nattorneys may try to effect a solution in which the property is sold and\nproceeds divided without a court order, according to a settlement agreement\nsigned by all owners.
