But it remains clear\nthat notarizing a document, under the laws of all states, means&nbsp;witnessing\na&nbsp;signature in real time. The notary&#8217;s witnessing role serves to verify to\nthe public that the person who signs a paper has been personally identified,\nand freely signed the document.<\/p>\n\n\n\n<p>Not to be\ndeterred, technology is changing the way society defines<em> witnessing<\/em>.&nbsp;With the\nadvancement of webcam technology and novel&nbsp;legal&nbsp;provisions, notaries\nare remotely witnessing signatures and verifying documents in several states.\nThis&nbsp;new process is known as RON remote online notarization.<\/p>\n\n\n\n<p>So far,\nreviews in the industry are mixed.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Industry\nExperts Weigh In on&nbsp;Remote Notarization<\/h2>\n\n\n\n<p>The best way to proceed at the current time, <a href=\"https:\/\/www.nationalnotary.org\/notary-bulletin\/blog\/best-practices\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">according to the National Notary Association<\/a>, is to\u00a0insist on in-person notarization.\u00a0In-person signing, it asserts, protects the public and the transaction.<\/p>\n\n\n\n<p>In contrast, the Mortgage Bankers Association (MBA) and the American Land Title Association (ALTA) jointly regard\u00a0remote online notarizations as an attractive consumer benefit. Still, the groups express concerns that different states have taken different approaches and they call for uniform standards to\u00a0be adopted.<\/p>\n\n\n\n<p>Notaries themselves <a href=\"http:\/\/forum.notarycafe.com\/t\/remote-notarization\/3788\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">point out<\/a>\u00a0that remote notarization goes beyond electronic notarization (eNotarization), which can\u00a0take place in the physical presence of the parties, using\u00a0paper or\u00a0an\u00a0electronic journal. Remote notarization raises special concerns, because the signing happens at\u00a0a distance. The notary cannot pick up and handle physical\u00a0proof of identity belonging to the signers.\u00a0<\/p>\n\n\n\n<p>Meanwhile, Wescor Land Title Insurance Company, in partnership\u00a0with Notarize, lauds\u00a0the advent of a fully electronic closing\u00a0process in which there is &#8220;<a href=\"https:\/\/www.businesswire.com\/news\/home\/20180111005806\/en\/Notarize-Westcor-Partner-Support-Online-Notarization-16\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">no scheduling required that disrupts your life and no driving to the closing<\/a>.&#8221;\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Remote\nNotarization Early Adopters<\/h2>\n\n\n\n<p>Several\nstates now allow for remote online notarizations using audio-video conference\ntechnology:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Virginia.<\/strong> In 2011, Virginia was first to enact a law allowing remote notarizations. An <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.commonwealth.virginia.gov\/official-documents\/notary-commissions\/enotary-faq\/\" target=\"_blank\">Electronic Notary in Virginia<\/a> may electronically notarize a document in the physical presence of the signer, or use audio-video conference technology to perform a remote notarization online.<\/li><li><strong>Montana.<\/strong> Since 2015, within Montana&#8217;s borders, notaries public may <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/sosmt.gov\/notary\/enotarization\/\" target=\"_blank\">perform remote notarizations<\/a> using real-time webcam technology. Remote notarization can be paired with eNotarization or traditional paper notarization. Notaries must save recordings for a significant span of time &#8211; 10 years &#8211; lest any future disputes arise about a given signature.<\/li><li><strong>Texas.<\/strong> An <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.sos.state.tx.us\/statdoc\/gettingstarted.shtml\" target=\"_blank\">Online Notary Public<\/a>, as commissioned in Texas, may perform remote notarization using audio-visual conference technology. Rather than a physical ID, verification of the signer&#8217;s identity employs knowledge-based authentication, involving a requisite number of correct answers to personal questions. This follows the <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.nationalnotary.org\/notary-bulletin\/blog\/2016\/07\/webcam-notarizations-redefining-presence-or-fraud\" target=\"_blank\">example set in Virginia<\/a>.<\/li><li><strong>Nevada.<\/strong> <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.nvsos.gov\/sos\/licensing\/notary\/enotary-faqs\" target=\"_blank\">Nevada\u2019s Electronic Notaries public<\/a> may perform their services using electronic tools or with RON through live, online audio-video calls.<\/li><li><strong>Minnesota.<\/strong> Effective Jan. 1, 2019, the state of Minnesota enacted a <a href=\"https:\/\/www.sos.state.mn.us\/notary-apostille\/notary-help\/remote-online-notarization-authorization\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">remote online notarization<\/a> provision. The notary must be registered with, and authorized by, the Secretary of State. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">More\nStates Join the&nbsp;Trend<\/h2>\n\n\n\n<p>Florida is looking at adopting remote notarization, although a\u00a0<a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2018\/771\/ByVersion\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">recent bill<\/a>\u00a0died on calendar in 2019. And\u00a0several additional states have pending legislation as of 2019:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>New<strong> <a rel=\"noreferrer noopener\" aria-label=\"Ohio (opens in a new tab)\" href=\"https:\/\/www.nationalnotary.org\/knowledge-center\/news\/law-updates\/oh-senate-bill-263\" target=\"_blank\">Ohio<\/a><\/strong> legislation is moving the commissioning of notaries from county courts of common pleas to the Ohio Secretary of State, whose office is now required to set standards for online notarizations and online notaries. This sets a good example for all states, as it locates the authority over in-person and RON within one single government office.<\/li><li><strong><a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.michigan.gov\/sos\/0,4670,7-127-1638_8736-257964--,00.html\" target=\"_blank\">Michigan<\/a><\/strong> is currently working on allowing both eNotarization and remote notarization. <\/li><li><strong><a href=\"https:\/\/www.nationalnotary.org\/notary-bulletin\/blog\/2018\/07\/5-more-states-approve-remote-notarization\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Indiana, Tennessee, and Vermont<\/a><\/strong> are also joining the trend. Significantly, Tennessee\u2019s incoming law will enable notaries located in the state to perform remote online notarizations wherever the signature physically occurs. <\/li><li><strong>Kentucky<\/strong> already allows its commissioned notaries to perform eNotarizations with the DocVerify e-Notary platform, which removes the need for paper or a rubber stamp. And the National Notary Association observes that Kentucky is among <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.nationalnotary.org\/notary-bulletin\/blog\/2019\/02\/19-more-states-propose-remote-notarization-in-2019\" target=\"_blank\">nearly half the U.S. states<\/a> that will be allowing remote online notarizations by way of audio-visual conferencing technology.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Uniformity\nin Legislative Approaches: A Pressing Need<\/h2>\n\n\n\n<p>Remote\nonline notarization is here. It will facilitate real estate closings for buyers\nand sellers. And yet, to ensure the integrity of&nbsp;land title records and\nthe secure treatment of documents, laws must be carefully\nwritten.&nbsp;Optimally, they would require RON to involve:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The continuing education of notaries public, with an eye to helping notaries detect      duress, undue influence, fraudulent intent, or fake identification, and prevent defects in notarizations.<\/li><li>Research into occurrences of RON fraud.<\/li><li>Support for the development of online fraud prevention mechanisms. <\/li><li>A notation on all notarized documents indicating whether RON or in-person notarization took place. This would be especially helpful in any fraud analysis.<\/li><li>Online recording of the full action, to make every element easily traceable.<\/li><li>Significant periods for retaining recordings. <\/li><li>Uniform means of verifying signers&#8217; identities whether for RON, in-person eNotarization, or paper.<\/li><\/ul>\n\n\n\n<p><a href=\"https:\/\/www.alta.org\/media\/pdf\/ron\/remote-online-notarization-checklist.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">ALTA offers a thorough checklist <\/a>for developing state laws.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">At<em> Deeds.com<\/em>, We Recommend\nCaution<\/h2>\n\n\n\n<p><a href=\"https:\/\/www.deeds.com\/articles\/category\/deed-fraud\/\">Deed fraud<\/a>\u00a0and related crimes are increasingly common. Fraudsters are ever vigilant for new opportunities. Proper, careful notarizations comprise a key element in preventing\u00a0fraud that can end up\u00a0invalidating\u00a0mortgages and embittering lives. Although eNotarization is becoming\u00a0a new standard in many transactions, RON\u00a0is new. It is\u00a0unsettled in law and practice. It is potentially attractive to sophisticated criminals.<\/p>\n\n\n\n<p>We note\nthat&nbsp;Virginia currently recognizes&nbsp;interstate remote notarizations as\nvalid. Usually, states that allow RON expect the notary&nbsp;and the people\nsigning documents to perform the action within the state. Virginia&#8217;s less\nrestricted approach has led to mortgage&nbsp;and notary services&nbsp;promoting\neClosings carried out online by Virginia notaries.&nbsp;Whether&nbsp;states\nother than&nbsp;Virginia must&nbsp;acknowledge the&nbsp;validity of this\npractice raises yet untested legal questions. Until we see uniformity on the\nissue, we must urge caution.<\/p>\n\n\n\n<p>Paperless eClosings may represent the trajectory of progress\u00a0in our digital age. Yet, at present,\u00a0<em>Deeds.com<\/em> does not submit documents for e-recording if they have been remotely notarized.
