Is it enough for the deed to describe an easement? Or does the title insurer need to see a recorded <a href=\"https:\/\/www.deeds.com\/easement-deed\/\">easement deed<\/a> specifically?<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>A seller asks:<\/strong> What if the easement wasn\u2019t recorded \u2014 and now I need to sell?<\/li>\n<\/ul>\n\n\n\n<p>Let\u2019s take a look at these questions. To start off, we\u2019ll look at a very common scenario. There\u2019s an easement, and it\u2019s somewhere in the language of the deed itself.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">An Easement Recorded on the Deed Shouldn\u2019t Be a Problem, Right?<\/h2>\n\n\n\n<p>If you acquire a deed, it\u2019s probably subject to easements. Almost every property is. The most common easements are utility easements (electric, gas, cables). They\u2019re expected. They don\u2019t <a href=\"https:\/\/www.deeds.com\/articles\/real-property-basics-what-is-a-clear-title\/\">cloud the title<\/a>.<\/p>\n\n\n\n<p>And sometimes a title is created for an address without access points. So an easement in the deed formalizes access rights. &nbsp;<\/p>\n\n\n\n<p>But sometimes there are separately recorded easements, and documentation is needed for financing. A separately recorded easement deed may include more details.<\/p>\n\n\n\n<p>The borrower (or, more likely, the title company hired for closing on the financing) can find the deed online. Use the deed holder\u2019s name, the parcel number, or the street address as a search term.<\/p>\n\n\n\n<p>So far, straightforward. Now, what if you\u2019re selling a home with an unrecorded easement?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">I\u2019m Selling. But First, I Need to Add This Easement. Do I Have to Create a New Deed?<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full is-style-rounded is-style-rounded--2\"><img loading=\"lazy\" decoding=\"async\" width=\"893\" height=\"595\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/02\/selling-but-need-to-add-an-easement.webp\" alt=\"\" class=\"wp-image-6327\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/02\/selling-but-need-to-add-an-easement.webp 893w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/02\/selling-but-need-to-add-an-easement-300x200.webp 300w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/02\/selling-but-need-to-add-an-easement-768x512.webp 768w\" sizes=\"auto, (max-width: 893px) 100vw, 893px\" \/><\/figure>\n\n\n\n<p>Say you live next door to a property whose owner told you long ago that you could extend part of your drainage system through their land. You had the necessary installation done. Nobody ever recorded an easement, though.<\/p>\n\n\n\n<p>What now? Do you need the neighbor to sign a separate easement deed and file it with your county recorder of deeds?<\/p>\n\n\n\n<p>Or do you need a whole new deed for the home that includes new easement language?<\/p>\n\n\n\n<p>Creating a separate easement (granted by the other owner to you) is the typical route here. The new easement deed should be created in advance of the deal. Potential buyers will find it through the title search, once you\u2019ve recorded it.<\/p>\n\n\n\n<p>You <em>could <\/em>create the easement in the deed you\u2019re giving to a buyer. But this must be handled transparently. Deed changes could impact the buyer\u2019s financing. Hiring an experienced lawyer to handle the deed transaction would be a wise move.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Are the Types of Easements?<\/h2>\n\n\n\n<p>Easements exist to enable access. They vary in their scope and sometimes they have time limits. They can form through prescription \u2014 by the parties\u2019 behavior. Or they can serve a necessity, so the property is marketable. &nbsp;<\/p>\n\n\n\n<p>There\u2019s the right of way, known as an <em>easement appurtenant<\/em>. Such easements \u201crun with the land\u201d as the property changes hands. So, the next buyer takes the deed <a href=\"https:\/\/www.deeds.com\/articles\/zeroing-in-the-subject-to-clause-in-your-real-estate-deed\/\"><em>subject to<\/em><\/a> the recorded easement.<\/p>\n\n\n\n<p>In contrast, an <em>easement in gross<\/em> benefits a particular individual, club, or other party and does not run with the land, and must therefore be separate from the deed. It spells out how the land can be crossed or used, by a specific user, for a specific need.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Could I Have a Legally Valid But Unwritten Easement?<\/h2>\n\n\n\n<p>Yes. Not all easements are written down.<\/p>\n\n\n\n<p>What about an implied easement? Maybe it\u2019s the use of a shared driveway. Or it could be a path over landlocked property that simply needs public access to be marketable. State laws generally recognize implied easements for deed holders with these obvious access needs.<\/p>\n\n\n\n<p>And what about <em>prescriptive easements<\/em>? These don\u2019t come into being through the parties\u2019 agreement. These easements come into existence because the users <em>openly act <\/em>as though they exist. The landowner never gave express permission. Prescriptive easements can be appurtenant (running with the land), or in gross (personal to the user).<\/p>\n\n\n\n<p>The user who wants to prove an easement exists must demonstrate their continual reliance on the access for the minimum time period. (That minimum number of years appears in a state\u2019s law. State law can require the use to have been going on a very long time.) Note that prescriptive easements just let a non-owner cross or use the land \u2014 <em>not<\/em> to gain ownership stake. Still, <em>prescription<\/em> is a real way for a trespasser to acquire a right to use a pathway.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--20)\"><em><strong>Buyers can ask about <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/home-buyers-cover-your-assets-choosing-between-standard-and-extended-title-insurance\/\"><strong><em>extended title policies<\/em><\/strong><\/a><em><strong>\u00a0that cover loss of land where others have trespassed for the state\u2019s minimum period of years.<\/strong><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Getting It In Writing: What Goes Into an Easement Deed?<\/h2>\n\n\n\n<p>You may create a written easement deed \u2014 separate from your property deed \u2014 by agreement of the other land owner. As it\u2019s in writing, this document will be called an <em>express easement<\/em>. This is the formal transfer of rights conveyed by the owner of one piece of land to the owner of the abutting land.<\/p>\n\n\n\n<p>Your express easement defines its scope in writing. The writing should state that this is a present \u201cgrant\u201d of \u201cright of way\u201d or \u201ceasement.\u201d It could state that the easement holder\u2019s rights extend for a specified term of years, or until a specific event occurs, and then automatically expire. Or the easement may exist for the duration, and run with the land.<\/p>\n\n\n\n<p>Must the easement agreement be signed by the land owner who\u2019s allowing the use? A title expert in your state can tell you. Typically, yes.<\/p>\n\n\n\n<p>Easement deeds are dated, notarized, stamped, and recorded with the county\u2019s register of deeds. They show addresses of the properties involved, and names of the parties and the preparer. The reason for the easement, its type and scope all appear in the writing. So do any payments, if made.<\/p>\n\n\n\n<p>A lender might request this documentation, with its official county stamp. The language in your property deed alone may not be enough to satisfy the lender.<\/p>\n\n\n\n<p>You may find and download the <a href=\"https:\/\/www.deeds.com\/easement-deed\/\">easement deed form<\/a> for your state here.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">And a Word (or Three) to the Wise\u2026<\/h2>\n\n\n\n<p>Anyone may create an easement to share rights to their own property. But the agreement should have the benefit of legal guidance. A title expert can check your title history for existing easements. This professional may recommend that you hire a surveyor to find unrecorded easements. In any case, it\u2019s not pleasant at all to have blown off the title search and end up in court over somebody\u2019s use of access.<\/p>\n\n\n\n<p>Deed holders should also discuss the tax impacts with their accountants.
