You might have seen detached garages turned into cottages, or finished basements converted into rental space. Town managers call these extra living spaces ADUs: <a href=\"https:\/\/www.deeds.com\/articles\/the-rise-of-accessory-dwelling-units-adus\/\"><em>accessory dwelling units<\/em><\/a><em>.<\/em><\/p>\n\n\n\n<p>A house deed typically does not point out an ADU on the property. But the additional living unit should still be registered and filed in the county records.<\/p>\n\n\n\n<p>If you\u2019re considering buying or creating a property with an ADU, read on as we do some issue-spotting, Q&amp;A style.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Will My ADU Have Its Own Deed?<\/h2>\n\n\n\n<p>No. ADUs are a type of housing unit, but they don\u2019t have their own street addresses. They can be:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Interior units. Examples include the English basement and the attic-turned-apartment.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Attached units. These self-contained living units are additions to the primary home. You\u2019ll usually see the additional unit at the side or rear of the main home, or placed above an attached garage.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Detached units: These are separate, or above separate garages. Towns may require a separate structure to be styled similarly to the main home. (Although it\u2019s possible that a detached ADU was prefabricated, mobile homes don\u2019t count as ADUs.)<\/li>\n<\/ul>\n\n\n\n<p>An ADU is <em>not<\/em> considered a duplex. An ADU can\u2019t be \u201csold separately\u201d from the primary home. Indeed, an ADU will usually share the main home\u2019s street address and utility accounts. And so, an ADU doesn\u2019t have a deed of its own.<\/p>\n\n\n\n<p>An ADU should have a <em>deed restriction<\/em>, separately recorded. We\u2019ll explain this in a minute. But first\u2026<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What\u2019s the Best Reason to Have an ADU?<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full is-style-rounded is-style-rounded--2\"><img loading=\"lazy\" decoding=\"async\" width=\"939\" height=\"859\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/02\/whats-the-best-reason-to-have-an-adu.webp\" alt=\"\" class=\"wp-image-6340\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/02\/whats-the-best-reason-to-have-an-adu.webp 939w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/02\/whats-the-best-reason-to-have-an-adu-300x274.webp 300w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/02\/whats-the-best-reason-to-have-an-adu-768x703.webp 768w\" sizes=\"auto, (max-width: 939px) 100vw, 939px\" \/><\/figure>\n\n\n\n<p>An accessory dwelling unit is a smaller living space beside, or even inside, the main home. The deed holder lives on the property \u2014 typically in the main home. The ADU exists to house an additional person or persons. So, the ADU offers extra housing. That\u2019s a very good reason to build one.<\/p>\n\n\n\n<p>Plus:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An additional living space on the property can provide rental income for a deed holder. (Note: Using a short-term home-sharing platform, like <a href=\"https:\/\/www.deeds.com\/articles\/airbnb-why-its-hot-how-it-works\/\">Airbnb<\/a>, may be locally prohibited.)<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An ADU could become a safe, affordable option to house a relative, maybe as an alternative to costly independent living developments.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A deed holder might want to house an adult child who is saving up to apply for their own mortgage.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Some deed holders simply want a little extra space for themselves. An ADU can serve as the perfect music studio, woodworking shop, or home-based office space.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Will Constructing an ADU Add Value to My Home?<\/h2>\n\n\n\n<p>Local governments often find that ADUs add marketable value to properties. Higher property values can result in increased tax revenue for a town.<\/p>\n\n\n\n<p>And so, some town governments welcome ADUs. Following a <a href=\"https:\/\/www.fastcompany.com\/91242299\/how-californias-adu-law-transforms-multifamily-real-estate\" target=\"_blank\" rel=\"noreferrer noopener\">vital trend<\/a> to seek \u201cgentle density housing,\u201d many towns across the country are now \u201cupzoning\u201d to encourage deed holders to construct ADUs.<\/p>\n\n\n\n<p>Town governments that have embraced the ADU zoning trend also point to these advantages:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Overall benefits of using land efficiently.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Filling local housing needs.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Freedom of choice for the deed holders to get more value out of their property.<\/li>\n<\/ul>\n\n\n\n<p>So, assuming the proper permitting (see below) got done, yes. An ADU can indeed add value. An appraiser can tell you how much value an existing ADU adds to the value of your home deed. <a href=\"https:\/\/myhome.freddiemac.com\/blog\/homeownership\/should-i-add-adu-my-home#:~:text=By%20adding%20an%20ADU%2C%20you,by%20as%20much%20as%2035%25.\" target=\"_blank\" rel=\"noreferrer noopener\">Freddie Mac<\/a> says: \u201cBy adding an ADU, you can increase the value of your home by as much as 35%.\u201d<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--20)\"><em><strong>Renting out space on your property? As tax season rolls around, here\u2019s a reminder about <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/schedule-e-what-people-who-rent-out-properties-need-to-know\/\"><strong><em>filing Schedule E<\/em><\/strong><\/a><em><strong>.<\/strong><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Can I Install an ADU?<\/h2>\n\n\n\n<p>Maybe. It\u2019s a matter of what your local land-use rules and zoning ordinances allow.<\/p>\n\n\n\n<p>If your local government says \u201cyes\u201d to ADUs, the town will want you to apply for a permit. Town officials usually want new construction to conform with the current appearance and customs of the area. So, expect your town to have a slew of rules, such as these examples:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An ADU must fit into the local zoning standards. Check for allowable footage, height, and <a href=\"https:\/\/www.deeds.com\/articles\/building-an-addition-shed-or-cottage-know-your-homes-setback-requirements\/\">setbacks from the edge of your lot<\/a>.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The deed holder lives on the property (whether in the main home or the addition).<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The ADU\u2019s entry does not face outward \u2014 so it\u2019s not mistaken for a home with a specific street address.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Creation of a parking space for the ADU may be necessary, and must follow the local regulations.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The ADU must be fully self-contained, with living space that includes a kitchen, bedroom and bathroom.<\/li>\n<\/ul>\n\n\n\n<p>Remember: What counts as a legitimate ADU is up to your local (county or city) government, so we\u2019re talking in broad terms. How you\u2019re permitted to make use of the ADU will also depend on your town\u2019s regulations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Are the Steps in the Process?<\/h2>\n\n\n\n<p>Check your local zoning ordinances. If they allow applications for ADUs, then the checklist goes like this:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Review the ADU requirements your town planners have established and be sure your plan will work.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Get the application form. It is published by your county or town.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Complete the form and submit it to the local authorities.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Wait for the county or city to approve your plan.<\/li>\n<\/ul>\n\n\n\n<p>Once approved, your ADU will be registered in the local records. There are typically different permit processes for attached and detached ADUs. And of course, fees! Unless the local government waives them.<\/p>\n\n\n\n<p>Do you have to go through all this red tape? Many people build unpermitted ADUs. But with the right permissions, your additional unit can be insured. That makes your property more marketable, and thus more valuable.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How Do I Know What to Do With My Deed?<\/h2>\n\n\n\n<p>The local department that approves your application files your approved form, and a writeup of the conditions under which your ADU will exist as a deed restriction. The new deed restriction, with all conditions, will be titled something like <em>Declaration of Restrictive Covenants for an Accessory Dwelling Unit<\/em>. It will state the name of the city or county that approved your ADU.<\/p>\n\n\n\n<p>Which department files this paperwork? It varies by county. For example, it may be the local auditor\u2019s office that files the deed restriction.<\/p>\n\n\n\n<p>Once recorded, your new deed restriction <em>will run with the land<\/em> as long as the ADU exists. In other words, if you transfer your property deed through a sale, the buyer will need to adhere to the conditions on the deed restriction. Leaving your property to another person as part of your estate planning? Your chosen beneficiary should understand and abide by the ADU\u2019s restrictive covenants.<\/p>\n\n\n\n<p>To boil it all down: Once your deed restriction is on the record, you have impacted the title to your home. You now have two units on your single residential property.
